This article shall be known as the "Winter Parking Ordinance."

No person shall leave or permit to remain parked unattended any wagon, motor vehicle, truck or other vehicle on any state, county or town road in the Town of Stony Point from 2:00 a.m. to 6:00 a.m. during the period from November 1 of each year through March 31 of each year.
The violation of this article shall constitute disorderly conduct, and a person violating the same shall be deemed a disorderly person and shall be liable, upon conviction, to a penalty not exceeding $10 for each such offense.
A. 
In the event that any wagon, motor vehicle, truck or other vehicle shall be so left parked, unattended, on any such state, county or town road as aforesaid for a period of more than three hours continuously, the same shall be and is hereby declared to be a nuisance and may be removed by the Superintendent of Highways of the Town of Stony Point or his designee or such other proper town officers or their designees from said road at the expense of the owner thereof. Said vehicle so removed shall be returned to the owner thereof upon the payment of the necessary expense for the removal and care of the same.
B. 
Authority to impound vehicles.

(1) 
When any vehicle is parked or abandoned on any highway within this town during a snowstorm, flood, fire or other public emergency which affects that portion of the public highway upon which said vehicle is parked or abandoned, said vehicle may be removed by the Town Highway Department or the Police Department.
(2) 
When any vehicle is found unattended on any highway within this town where said vehicle constitutes an obstruction to traffic, said vehicle may be removed upon written authorization of the Police Department.
(3) 
When any vehicle is parked or abandoned on any highway within this town where stopping, standing or parking is prohibited, said vehicle may be removed upon written authorization of the Police Department.
