A. 
Unless the context specifically indicates otherwise, the meaning of the terms used in this chapter shall be as follows:
ACT
The Federal Clean Water Act, as amended.

ASTM
The American Society for Testing and Materials.

BASE UNIT USER CHARGE
That form of local assessment approved by the New York State Legislature (L. 1976, c. 527) as the means of raising the expense for the construction and operation and maintenance of the sewerage works.

BOARD OF TRUSTEES
The duly elected Board of Trustees of the Village of Sylvan Beach or its authorized deputy or representative.
BOD (denoting "biochemical oxygen demand")
The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20° C., expressed in milligrams per liter.
BUILDER
Any person, persons or corporation who undertakes to construct, either under contract or for resale, any habitable building.
BUILDING DRAIN
That part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five feet outside the inner face of the building wall.
BUILDING SEWER
The extension from the building drain to the public sewer or other place of disposal, and shall be the responsibility of the building owner.
COMBINED SEWER
A sewer receiving both surface runoff and sewage.
CONTAMINATION
An impairment of the quality of the waters of the state by waste to a degree which creates a hazard to the public health through poisoning or through the spread of disease.

CONTRACTOR
Any person, firm or corporation approved by the Board of Trustees to do work on the sewerage system in the village.
COOLING WATER
The water discharged from any system of condensation, air conditioning, cooling, refrigeration or other, but which shall be free from odor and oil. It shall contain no polluting substances which would produce BOD or suspended solids each in excess of 10 milligrams per liter.
DEVELOPER
Any person, persons or corporation who undertakes to construct more than one housing unit on a given tract or land subdivision.
EASEMENT
An acquired legal right for the specific use of land owned by others.

ENGINEER
The professional engineer retained as Village Engineer for the Village of Sylvan Beach.
GARBAGE
Solid wastes from the preparation, cooking and dispensing of food and from the handling, storage and sale of produce.
INDUSTRIAL WASTES
The liquid wastes from industrial processes as distinct from sewage.
MAINLINE SEWER
The sanitary sewer of a minimum inside diameter of eight inches which, in general, is located within street rights-of-way and is laid parallel to the longitudinal axis of the road. A "mainline sewer" shall terminate at a manhole.
NATURAL OUTLET
Any outlet of unpolluted surface or ground water into a watercourse, pond, ditch, lake or other body of surface or ground water.
NPDES
The National Pollutant Discharge Elimination System permit program, whether administered by the Environmental Protection Agency or the State of New York.

NYSDEC
The New York State Department of Environmental Conservation.
NYSDOT
The New York State Department of Transportation.
OWNER
Any individual, firm, company, association, corporation, society, person or group having title to real property.
PERSON
Any individual, firm, company, association, society, corporation or group.
pH
The logarithm of the reciprocal of the concentration of hydrogen ions in grams per liter of solution.
POLLUTION
The man-made or man-induced alteration of the chemical, physical, biological and radiological integrity of water.

PRETREATMENT
The reduction of the amount of pollutant properties in wastewater to a less-harmful state prior to or in lieu of discharging or otherwise introducing such pollutants into a publicly owned treatment works (POTW). The reduction or alteration can be obtained by physical, chemical or biological processes, process changes or by other means, except as prohibited by 40 CFR 403.6, General Pretreatment Regulations for Existing and New Sources of Pollution.

PROPERLY SHREDDED GARBAGE
The wastes from the preparation, cooking and dispensing of food that has been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than 1/2 inch in any dimension.
PROPERTY LINE
The edge of a sewer right-of-way in those instances where the building sewer connects to the public sewer in a sewer right-of-way or edge of a street right-of-way.
PUBLIC SEWER
A sewer in which all owners of abutting properties have equal rights and is controlled by public authority.
RESIDENTIAL USER
All premises used only for human residency and which are connected to the wastewater facilities.

SANITARY SEWER
A sewer which carries sewage and to which storm-surface and ground waters are not intentionally admitted.
SERVICE LATERAL
The sanitary sewer of a minimum inside diameter of six inches which extends from the mainline sewer toward the property being provided with sewer service. The "service lateral" shall begin at a wye or manhole in the mainline sewer and terminate within five feet of the street or sewer right-of-way.
SEWAGE
A combination of the water-carried wastes from residences, business buildings, institutions and industrial establishments.
SEWAGE TREATMENT PLANT
Any arrangement of devices and structures used for treating sewage.
SEWER
A pipe or conduit for carrying sewage.
SEWERAGE WORKS
Sewers, sewage treatment plant and all other appurtenances of the operating system for the collection, transportation and treatment of sewage.
SIGNIFICANT INDUSTRIAL USER
Any user who:

(1) 
Has a discharge flow of 25,000 gallons or more per average workday;
(2) 
Has a flow greater than 5% of the flow in the municipality's wastewater system;
(3) 
Has, in his waste, toxic pollutants as defined pursuant to Section 307 of the Act;
(4) 
Has been identified as one of the 21 industrial categories pursuant to Section 307 of the Act; or
(5) 
Is found by the county to have a significant impact, either singly or in combination with other contributing industries, on the treatment or collection system.
STANDARD METHODS
The latest edition of Standard Methods for Examination of Water and Wastewater, published by the American Public Health Association, Water Pollution Control Federation and American Waterworks Association.

STORM SEWER or STORM DRAIN
A pipe or conduit which carries storm- and surface waters and drainage, but excludes sewage and industrial wastes.
SUPERINTENDENT
The Superintendent of the Village of Sylvan Beach's Sewerage Works or his authorized deputy, agent or representative.
SUSPENDED SOLIDS
Solids that either float on the surface of or are in suspension in water, sewage or other liquids and which are removable by laboratory filtering.
UNPOLLUTED WATER OR WASTE
(1) 
Any water or waste containing none of the following.
(a) 
Free or emulsified grease or oil.
(b) 
Acid or alkali.
(c) 
Phenols or other substances imparting taste or odor in receiving waters.
(d) 
Toxic or poisonous substances in suspension, colloidal state or solution.
(e) 
Noxious or odorous gases.
(2) 
It shall contain not more than 10,000 milligrams per liter of dissolved solids, of which not more than 2,500 milligrams per liter shall be as chloride, with permissible volumes subject to review by the Superintendent, and not more than 10 milligrams per liter each of suspended solids and BOD.
(3) 
The color shall not exceed 50 milligrams per liter.
USEPA
The United States Environmental Protection Agency.
VILLAGE
The Village of Sylvan Beach, New York.[1]
WATERCOURSE
A channel in which a flow of water occurs, either continuously or intermittently.

Word usage: "Shall" is mandatory; "may" is permissive.
A. 
Notwithstanding any other local law or ordinance to the contrary, it shall be unlawful for any person to place, deposit or permit to be deposited in any unsanitary manner upon public or private property within the Village of Sylvan Beach any human or animal excrement, garbage or other objectionable waste.
B. 
Exceptions may be granted by the Board of Trustees to an owner or lessee acting in the normal course of garden operations and farming.
It shall be unlawful to discharge to any watercourse, either directly or through any storm sewer, within the village, any sewage, industrial wastes or other polluted waters. Use of separate storm sewers and sanitary sewers is mandatory for all future construction in the village. No combined sewers will be allowed to be constructed in the future.
Except as hereinafter provided, it shall be unlawful to construct or maintain any privy, privy vault, septic tank, cesspool or other facility intended or used for the disposal of sewage in the village.
A. 
The owner of any house, camp, cottage, mobile home, motor home, building or property, used for human occupancy, employment, recreation or other purposes, which generate, are capable of generating and/or discharge sewage, situated within the village and abutting on any street, alley or right-of-way in which there is located a public sanitary sewer of the village is hereby required at his expense to install suitable toilet facilities therein and to connect such facilities directly with the proper public sewer in accordance with the provisions of this chapter within two years after the date of official notice to do so, provided that said mainline sewer is located within 100 feet of the property line and said service lateral extension is within five feet of the property line within the street or sewer right-of-way.
B. 
The owner of new houses or buildings constructed within the village shall be required at his expense to install suitable toilet facilities therein and to connect such facilities directly with the proper sewer in accordance with the provisions of this chapter prior to occupancy of the house or building, provided that said mainline sewer is located within 100 feet of the property line and said sewer service extension is located within five feet of the property line and the distance across the property from the building to the property line is less than 300 feet.
C. 
No building capable of generating or discharging sewage located 300 feet or more from the property line shall be required to connect to the sewer line. However, any such building shall be served by a sewage disposal system which complies with all controlling agencies and this chapter.
D. 
If connected to a sewer, the owner shall remain connected and liable to sewer service charges unless the building or structure is demolished and notice given to the village. Disconnections of water service or removal of plumbing facilities shall not relieve the owner from the provisions of this law.
