§ 85-1 Definitions.

For the purpose of this chapter, the words and phrases used herein shall have the meanings respectively ascribed to them by Article 1 of the Vehicle and Traffic Law of the State of New York.

§ 85-2 Main arteries of travel.

A. Bridge Street. West Carthage, New York, is hereby designated as a main artery of travel, and all vehicles approaching said main artery of travel from the following streets shall, before entering the main artery, come to a full stop, unless otherwise directed by a peace officer or signal, and shall thereafter enter the street with caution:

	South Main Street
	South Jefferson Street
	Rulison Street
	Barr Street
	Potter Street
	Stone Street
	Madison Street

B. Champion Street, West Carthage, New York, from Bridge Street to North Main Street to Broad Street, is hereby designated as a main artery of travel, and all vehicles approaching said main artery of travel from the following streets shall, before entering the main artery, come to a full stop, unless otherwise directed by a peace officer or signal, and shall thereafter enter the street with caution:

C. I. Franklin Street, West Carthage, New York, from Broad Street to Madison Street, is hereby designated as a main artery of travel, and all vehicles approaching said main artery of travel from the following streets shall, before entering the main artery, come to a full stop, unless otherwise directed by a peace officer or signal, and shall thereafter enter the street with caution:

§ 85-3 Stop intersections.

A. The intersection of County Road 48 with County Road 46 is hereby designated as a stop intersection, and a stop sign shall be erected on County Road 48 at its entrance to said intersection from the west.

B. The intersection of North Main Street and Champion Street is hereby designated as a stop intersection, and a stop sign shall be erected on North Main Street at this intersection. All traffic shall come to a full stop before entering Champion Street from North Main Street, unless otherwise directed by a peace officer or signal, and shall thereafter enter the street with caution.

C. The intersection of Champion Street and Champion Street is a full-stop intersection (at the intersection of North Main and Champion Streets), and a stop sign shall be erected on Champion Street at this intersection. All traffic shall come to a full stop before entering Champion Street, unless otherwise directed by a peace officer or signal, and shall thereafter enter the street with caution.

D. The intersection of Harper's Terrace and Lathrop Street is hereby designated as a stop intersection, and a stop sign shall be erected on Harper's Terrace where it enters Lathrop Street. All traffic shall come to a full stop before entering Lathrop Street, unless otherwise directed by a peace officer or signal, and shall thereafter enter the street with caution.

E. The intersection of Madison and Franklin Streets is hereby designated as a four-way stop intersection, and stop signs shall be erected on the north and south corners of Madison Street at this intersection. All traffic shall come to a full stop before entering this intersection, unless otherwise directed by a peace officer or signal, and shall thereafter enter the intersection with caution.

F. The intersection of Tamarack Drive and Broad Street is hereby designated as a stop intersection, and a stop sign shall be erected on Tamarack Drive where it enters Broad Street. All traffic shall come to a full stop before entering Broad Street unless otherwise directed by a peace officer or signal, and shall thereafter enter the street with caution.

G. The intersection of Tamarack Drive and Bridge Street is hereby designated as a stop intersection, and a stop sign shall be erected on Tamarack Drive where it enters Bridge Street. All traffic shall come to a full stop before entering Bridge Street, unless otherwise directed by peace officer or signal, and shall thereafter enter the street with caution.

H. The intersection of the drive leading from the West Carthage Senior Citizen's Housing and Routes 26 and 126 is hereby designated as a stop intersection, and a stop sign shall be erected on the drive leading from the West Carthage Senior Citizen's Housing where it enters Routes 26 and 126. All traffic shall come to a full stop before entering Routes 26 and 126, unless otherwise directed by peace officer or signal, and shall thereafter enter the street with caution.

I. The intersection of Champion Apartments Drive and Route 126 is hereby designated as a stop intersection, and a stop sign shall be erected on Champion Apartments Drive where it enters Route 126. All traffic shall come to a full stop before entering Bridge Street, unless otherwise directed by peace officer or signal, and shall thereafter enter the street with caution.

J. The intersection of Tamarack Drive and the Tamarack Drive cul-de-sac is hereby designated as a stop intersection, and a stop sign shall be erected on the Tamarack Drive cul-de-sac where it enters Tamarack Drive. All traffic shall come to a full stop before entering Tamarack Drive, unless otherwise directed by a peace officer or traffic signal, and shall thereafter enter the street with caution.

K. The intersection of the drive leading from West Side Terrace and Madison Street is hereby designated as a stop intersection, and a stop sign shall be erected on the drive leading from West Side Terrace where it enters Madison Street. All traffic shall come to a full stop before entering Madison Street, unless otherwise directed by a peace officer or traffic signal, and shall thereafter enter the street with caution.

L. The intersection of High Street and North Jefferson Street is hereby designated as a four-way stop intersection, and stop signs shall be erected on the north, south, east and west corners of this intersection. All traffic shall come to a full stop before entering this intersection, unless otherwise directed by a peace officer or signal, and shall thereafter enter the intersection with caution.

M. The intersection of Vincent Street and Champion Street is hereby designated as a three-way stop intersection, and stop signs shall be erected on the west, north, and south corners of said intersection. All traffic shall come to a full stop before entering this intersection unless otherwise directed.

N. The intersection of High Street and Champion Street is hereby designated as a three-way stop intersection, and stop signs shall be erected on the west, north and south corners of said intersection. All traffic shall come to a full stop before entering this intersection, unless otherwise directed by a peace officer or signal, and shall thereafter enter the intersection with caution.

O. The intersection of High Street and Stone Street is hereby designated as a four-way stop intersection, and stop signs shall be erected on the north, south, east and west corners of said intersection. All traffic shall come to a full stop before entering this intersection, unless otherwise directed by a peace officer or signal, and shall thereafter enter the intersection with caution.

P. The intersection of Liberty Street and Rulison Street is hereby designated as a three-way stop intersection, and stop signs shall be erected on the east, west and north corners of said intersection. All traffic shall come to a full stop before entering this intersection, unless otherwise directed by a peace officer or signal, and shall thereafter enter the intersection with caution.

§ 85-4 Yield intersections.

A. The intersection of County Road 48 with Martin Street is hereby designated as a yield intersection, and a yield sign shall be erected on Martin Street at its entrance to said intersection from the north.[1]

[1] Editor's Note: Former § 85-4.1, No-left-turn intersections, adopted 3-28-1988 by L.L. No. 4-1988, which immediately followed this subsection, was repealed 7-9-1991 by L.L. No. 4-1991. Said local law also provided that vehicles shall be legally entitled to make a left turn from the drive leading from the West Carthage Senior Citizens Housing on Route 26 and 126.

§ 85-5 Speed limits.

A. Thirty miles per hour.

(1) Thirty miles per hour is hereby designated and established as the maximum speed at which vehicles may proceed within the corporate limits except on the below-named highways under Subsection A(2). Application of the thirty-mile-per-hour posted zones specifically applies to the following-named streets:

	Champion Street, except the area designated in (c)
	Franklin Street
	Front Street
	Harper's Terrace
	High Street
	Hubbard Street
	Lathrop Street
	Liberty Street
	Madison Street, except the area designated in (d)
	North and South Jefferson Streets
	North and South Main Streets
	Old Martin Street
	Potter Street
	Rulison Street
	Stone Street
	Vincent Street

(2) Exceptions to the above are the following:

(a) Route 26, between the southerly Village line and its intersection with Martin Street and Bridge Street.

(b) Martin Street Road to the northerly Village line.

(c) The area of Champion Street where it intersects with North Main Street and from its intersection with Martin Street Road and Broad Street westerly to the Village line.

(d) Madison Street from its intersection with Franklin Street to its intersection with Champion Street. Within the area just described, the speed limit shall be 20 miles per hour.

(e) A speed limit of 20 miles per hour shall be applied to and observed on the following streets:

[2] North Jefferson Street from Franklin Street to High Street.

B. Forty miles per hour is hereby established as the maximum speed at which vehicles may proceed within the corporate limits of the Village on the following highways:

(1) Route 26 between the southerly Village line and its intersection with Martin Street and Bridge Street.

(2) Martin Street Road to the northerly Village line.

(3) Champion Street from its intersection with Martin Street Road and Broad Street westerly to the Village line.

C. The area of Champion Street where it intersects with North Main Street is hereby designated as a slow fifteen-mile-per-hour area, and a sign so stating will be erected at the entrance to this area. All traffic will slow to 15 miles per hour upon entering this area of Champion Street where it joins North Main Street, unless otherwise directed by a peace officer or signal.

D. The area of Tamarack Drive between its intersection with Broad Street and its intersection with Bridge Street, including the Tamarack Drive cul-de-sac, is hereby designated as a twenty-mile-per-hour area, and a series of signs so stating the speed limit will be erected along Tamarack Drive in this area. All traffic will slow to 20 miles per hour upon entering Tamarack Drive or the Tamarack Drive cul-de-sac, unless otherwise directed by a peace officer or signal.

§ 85-6 All-night parking.

No person, firm or corporation shall leave any motor vehicle or other vehicle parked on any public street in the Village of West Carthage, New York, between the hours of 2:30 a.m. and 6:00 a.m. from November 1 through April 1. In the absence of the owner, operator or driver of said vehicle, it shall be lawful for the Police Department, the Fire Department or the Department of Public Works to forthwith remove said vehicle or cause the same to be removed to some suitable place, including a public garage, and the reasonable cost of such removal, including public garage storage charges, shall be borne and paid by such owner, operator or driver at the time he reclaims and takes possession of said vehicle.

§ 85-8 Stopping, standing or parking.

Except when in compliance with the directions of a police officer or when necessary to avoid conflict with other traffic, no person shall stop, stand or park a vehicle at any of the following locations:

§ 85-9 Parking between curb and sidewalk or on sidewalk.

It shall be unlawful for any person or corporation to leave, place, park or station or cause to be left, placed, parked or stationed any motor vehicle or other vehicle between the curbing of any street in the Village of West Carthage, New York, and the sidewalk of such street or upon the sidewalks of any street in the Village of West Carthage, New York.

§ 85-10 Miscellaneous parking regulations.

A. No motor vehicle or motorcycle shall be parked at any place at any time upon any public street or highway in the Village of West Carthage, New York, which has been designated by official signs and markings as a no-parking zone or at a place where it is clearly designated that parking is prohibited.

B. No motor vehicle or motorcycle shall be parked on that side of a public street in the Village of West Carthage, New York, which is to the left of the motor vehicle or motorcycle.

C. No motor vehicle or motorcycle shall be parked in such a manner as to prevent or interfere with ingress or egress of motor vehicles or motorcycles on private roadways or driveways to property adjoining the public street, nor in such a manner as to impede, obstruct or interfere with the reasonable operation of motor vehicles or motorcycles on and along any public street in the Village of West Carthage, New York.

D. One-hour parking will be permitted at the following locations:

(1) The north side of Bridge Street for a distance of 63 feet, beginning at the northwest corner of Bridge Street and Main Street.

(2) The west side of Main Street for a distance of 100 feet, beginning at the northwest corner of Main Street and Bridge Street.[1]

§ 85-10.1 Handicapped parking.

The stopping, standing or parking of any vehicle, except for a vehicle which bears a handicapped parking permit or registration issued pursuant to § 1203-a or § 404-a of the New York State Vehicle and Traffic Law and such vehicle is being used for the transportation of a handicapped person, is prohibited in the following areas:

§ 85-11 Operation of vehicles on sidewalks.

No person, firm or corporation shall operate any motor vehicle or motorcycle on, across, along or upon any public sidewalk except to cross a public sidewalk, along or upon a driveway or clearly defined passageway for motor vehicles or motorcycles, where necessary as a means of ingress or egress to property adjoining a public street or highway.

§ 85-12 Truck routes.

All through truck traffic shall be directed down Broad Street to Bridge Street, and signs stating "No Through Truck Traffic" shall be erected at the following places:

§ 85-13 Penalties for offenses.

Every person convicted of a traffic infraction for a violation of any provision of this chapter which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punished by a fine of not more than $50 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $100 or by imprisonment for not more than 45 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $250 or by imprisonment for not more than 90 days, or by both such fine and imprisonment.

§ 85-14 Penalties for parking tickets.

Every person convicted of a parking violation for any provision of this chapter other than parking in a handicap zone shall be punished by a fine of $25. Every person convicted of parking in a handicap zone shall be punished by a fine of $100.
