A certain document, three copies of which are on file in the office of the Borough Secretary of the Borough of Wilson, 2040 Hay Terrace, Wilson Borough, Pennsylvania 18042, being marked and designated as the International Property Maintenance Code and each sequential update or revision as published by the International Code Council, Inc., be and is hereby adopted as the Property Maintenance Code of the Borough of Wilson, County of Northampton, Commonwealth of Pennsylvania, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code are hereby referred to adopted and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 139-2 of this chapter.
The following sections are hereby revised:
A. 
In Section 101.1, insert "Borough of Wilson, Northampton County, Commonwealth of Pennsylvania."
B. 
In Section 103, change the heading to "Department of Code Administration."
C. 
In Section 103.1, change to read: The office of Code Administration shall be in charge of the enforcement of this Code. The Code Administrator appointed by Borough Council shall be known herein as the Code Official."
D. 
In Section 103.2, delete it in its entirety.
E. 
In Section 103.3, delete it in its entirety.
F. 
In Section 106.3, change "misdemeanor" to a "summary offense."
G. 
In Section 107.5, after the heading, change to read: "It shall be unlawful for the owner of any dwelling unit or structure who has received a compliance order or upon whom a notice of violation has been served to sell, transfer, or otherwise dispose of such dwelling unit or structure to another until the provisions of the compliance order or notice of violation have been complied with, or until such owner shall first furnish the grantee or transferee, a true copy of any compliance order or notice of violation issued by the Code Official and shall furnish to the Code Official a signed and notarized statement from the grantee or transferee, acknowledging the receipt of such compliance order or notice of violation and fully accepting the responsibility without condition for making the corrections or repairs required by such compliance order or notice of violation or as may otherwise be required by other ordinances relative to the sale or transfer or real estate."
H. 
In Section 110.3, change the word "shall" to "may."
I. 
In Section 111.25, delete it in its entirety.
J. 
In Section 111.7, after the heading, change to read: "Any person, whether or not a previous party of the appeal, shall have the right to appeal the decision of the Board pursuant to the Local Agency Law[1]"

All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any right acquired, or liability incurred, or any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in § 139-4 of this chapter; nor shall any just or legal right of remedy of any character be lost, impaired or affected by this chapter.
The fees for activities and services performed by the Borough in carrying out the provisions of the Code as referenced in Section 103.6, shall be as indicated in the following schedule:
