As used in this article, the following words
and terms shall be construed as follows:
PERSON
Includes natural persons, partnerships, organizations and
corporations.
REGULATIONS OF THE AUTHORITY
Such rules and regulations as the Chartiers Township Municipal
Authority may from time to time adopt and promulgate with respect
to any matter affecting the maintenance and operation of the sewerage
system and with respect to the collection of sewer rentals imposed
by this article.
REGULATIONS OF THE TOWNSHIP
Such rules and regulations as the Township may from time
to time adopt and promulgate with respect to any matter affecting
the maintenance and operation of the sewerage system and with respect
to the collection of sewer rentals imposed by this article.
SEWER
All sanitary sewers, all lateral sewer service connections
and all main collecting sewers and trunk lines included in the sewerage
system.
SEWERAGE SYSTEM
The existing sewerage facilities within the service area
of the Township, together with all renewals, replacements, additions,
extensions and enlargements from time to time made with respect thereto;
but does not include stormwater sewers.
TOWNSHIP
Township of Chartiers, Washington County, Pennsylvania, a
municipal body having its principal address at 2451 West Pike Street,
Houston, Pennsylvania 15342.
USERS
All persons owning or occupying property having connections
to the sewerage system.
WATER COMPANY
The Western Pennsylvania Water Company of Washington, Pennsylvania,
and any successor thereto.
The Township hereby establishes a separate sewer
district to be known as the "Veronica Drive Sewer District," which
shall be comprised of the Veronica Drive Area Sanitary Sewer System
as is defined and described in the plans and specifications and report
dated as of February 1986 of Ferrero and Associates, Inc., of McMurray,
Pennsylvania, consulting engineers.
All persons owning improved property within
the Veronica Drive Sewer District which abuts on or adjoins any street
or right-of-way in which there now is or shall hereafter be a sewer
shall, at their own expense, within three months after the construction
of any new sewer, make connection with such sewer in the manner prescribed
by this article or in accordance with the regulations of the Authority,
or its agent or assignee, for the purpose of discharge into such sewer
such drainage or waste matter as is specified in this article or as
may from time to time be specified by the regulations of the Authority,
or its agent or assignee.
From and after the effective date of this article,
it shall be unlawful for any person to discharge or to permit to be
discharged into any sewer any roof or surface water or the flow from
any groundwater collection system or any matter determined by the
regulations of the Authority to be dangerous or harmful to or the
discharge of which into a sewer would adversely affect the sewerage
system or the functioning thereof, or the process of sewage treatment
and disposal, or to discharge or to permit to be discharged into any
sewer any industrial or process waste which is not preliminarily treated
in the manner from time to time prescribed by the regulations of the
Authority in order to make it reasonably harmless to the sewerage
system and to the processes of sewage treatment and disposal.
The following schedule of sewage service rates
for the Veronica Drive Sewer System be and hereby is adopted by the
Township:

The sewage service rates imposed by §
272-99 hereof shall become effective as soon as substantial operation of the Veronica Drive Area Sewer System begins.
Bills for said sewer service shall be rendered
by and in the manner and in the form prescribed by the Township or
its designated agent, Chartiers Township Municipal Authority. All
bills for sewer service shall be rendered to the owner of the premises
to which sewer service is furnished, and such owner shall in all cases
be liable for payment of such bills.
The Board of Supervisors of the Township, or
its designated agent, Chartiers Township Municipal Authority, shall
have charge and management of the Veronica Drive Sewer System and
shall issue such rules and regulation governing the use, operation
and maintenance of said sewer system as it shall deem necessary and
which may be those governing the other sewer systems in the Township.
The Township, or its designated agent, the Authority,
shall collect and receive all sewer rates and charges prescribed by
this article. All such money shall be deposited to the credit of a
special fund designated the "Chartiers Township Sewer System Fund,"
which shall at all times be a separate and distinct fund of the Township.
The owners of properties served by the sewerage
system and users of water in or on said properties shall be jointly
and severally liable for the payment of the sewer rentals and penalties
hereby imposed.
The sewer rentals and penalties hereby imposed
shall be a lien on the property served, and all delinquent bills therefor
shall be entered as a lien against such property; and such lien shall
be filed in the Office of the Prothonotary of Washington County, Pennsylvania,
and collected in the manner provided by law for the filing and collection
of municipal claims.
Any person violating any provision of this article
shall, upon conviction thereof, be fined not to exceed $25 and/or
shall be imprisoned for a period not to exceed 25 days. Each day's
violation of such provisions shall be deemed to be a separate offense.
Sewer charges imposed pursuant to this article
shall be due and payable immediately upon receipt by the owner or
the tenant. The net bill is due and payable within 20 days following
the date of billing. The penalty for late payment of said bills shall
be 10% if the sewer charge is not paid within 20 days following the
date of the billing.
A copy of the rules and regulations governing
the imposition of charges and the use of the Veronica Drive Sewer
System shall be filed with the Township Secretary and made available
for inspection by the public.
