As used in this chapter, the following terms shall have the meanings indicated:
OFF-ROAD VEHICLES
Includes all snowmobiles, all motor-driven vehicles having two wheels commonly known as "trail bikes," "dirt bikes" and "minibikes" and all-terrain vehicles which are commonly used for off-road use and not otherwise licensed by the Commonwealth of Pennsylvania.
This chapter shall not apply to vehicles used for home lawn or garden work or maintenance or for agricultural purposes.
A. 
Off-road vehicles shall be registered with Chartiers Township.
B. 
Prior to the operation of an off-road vehicle, such vehicle shall be registered.
C. 
To register an off-road vehicle, the owner shall complete an application form provided by the Chartiers Township Police Department and return said form to the Police Department with a registration fee of $5 when plates are issued by the Township. The registration form shall contain the following information:
(1) 
The name, address and age of the owner;
(2) 
Proof of ownership;
(3) 
The vehicle identification number or serial number of the off-road vehicle;
(4) 
If the vehicle is licensed by the Commonwealth of Pennsylvania, a copy of the registration issued by the commonwealth;
(5) 
A photograph of the off-road vehicle;
(6) 
The name, address and age of all authorized operators;
(7) 
Any registration issued by state law must be affixed to the off-road vehicle.
D. 
Upon payment of the registration fee and submission of a completed registration form, a registration card and two registration plates will be issued to the applicant by the Chartiers Township Police Department. The registration plates shall be attached to the front and back of the vehicle, and the operator of the vehicle shall have the registration card in his/her possession.
E. 
Registration is not transferable and is void if transferred.
F. 
If ownership is transferred, the registration card and plates issued shall be surrendered to the Chartiers Township Police Department within 15 days of such transfer.
G. 
If the off-road vehicle is dismantled, the registration card and plates shall be surrendered to the Chartiers Township Police Department.
H. 
The registration issued by the Chartiers Township Police Department is valid for five years from the date of issue. After five years, a new registration form must be completed and filed with the Chartiers Township Police Department.
A. 
No off-road vehicle shall be operated in Chartiers Township unless registered with Chartiers Township in accordance with this chapter.
B. 
No off-road vehicles shall be operated on private property without the prior approval of the owners of private property where such vehicles operate.
C. 
No off-road vehicle shall be operated on any property owned or controlled by Chartiers Township unless such property is specifically posted to allow such operation.
D. 
No off-road vehicle shall be operated unless exempt from this chapter or registered pursuant to this chapter.
E. 
No owner of an off-road vehicle shall permit the operation of said vehicle unless it is properly registered, marked and permission to operate on private property is obtained.
F. 
No off-road vehicle shall be operated within 300 feet of any property line where permission has not previously been obtained. It shall be the responsibility of the off-road vehicle rider and/or owner to identify the owner(s) of all properties from whom permission has been obtained, as well as adjacent property owner(s) and property lines.
G. 
No off-road vehicle shall be operated within 500 feet of an occupied structure or residence unless the off-road vehicle rider/owner owns said structure or residence.
H. 
Hours of operation for off-road vehicles will be 7:00 a.m. to 7:00 p.m.
I. 
Nothing contained in this chapter shall authorize the operation of off-road vehicles on the public or private streets, roadways, or highways within Chartiers Township in such instances where said off-road vehicles could not otherwise be lawfully operated under the provisions of the Pennsylvania Motor Vehicle Code.
Any person who violates this chapter shall, upon conviction by a Magisterial District Judge, be fined up to $300 plus court costs per violation.
