A. A subdivider
may apply to the Planning Board for classification of his/her subdivision
as a boundary line change. Such application must include a survey
prepared by a surveyor licensed by the State of New York indicating:
(1) The
proposed change in the lot line.
(2) The
topography of the property to which the resulting land area is to
be added or deleted.
(3) A
notation that the area of land created by the boundary change is to
become a part of an adjacent lot.
(4) Encroachment
of structures that exist and are to be corrected or any that will
be created by the lot line change.
(5) Buried
utilities adjacent to the lot line change to confirm that the modification
will not result in encroachments or violations of regulatory agency
requirements, i.e., Health Department.
B. Where
the Planning Board believes that additional information is required,
the Planning Board or its designated representative may request such
information prior to making a decision. Application for a boundary
line change shall be submitted to the Building Department at least
15 days prior to the meeting at which a review is requested.
C. In the
event that a subdivision is classified as a boundary line change,
the Planning Board may waive the requirement for a public hearing.
