There is hereby adopted by the Borough of Towanda, Bradford County, Pennsylvania, for the purpose of establishing rules, regulations, provisions, penalties, conditions and terms for prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain fire prevention code, being marked and designated as the "2006 International Fire Code," as published by the International Code Council, Inc., of which not less than three copies have been and are now filed in the office of the Secretary of the Borough of Towanda, Bradford County, Pennsylvania, and the same is hereby adopted and incorporated as fully as if set out at length herein, and from and after the date of the passage and publication of this article, the provisions thereof shall be controlling in prescribing regulations governing conditions hazardous to life and property from fire or explosion contained within the corporate limits of the Borough of Towanda, Bradford County, Pennsylvania, and shall be known as the "Towanda Borough Fire Prevention Code." It is the intent of this article that all future additions and revisions of the 2006 International Fire Code shall be deemed to have been adopted by reference by the Council of the Borough of Towanda as soon as the same shall be published.

All reference in the Fire Prevention Code to the "Chief of the Bureau of Fire Prevention" or "Chief of the Fire Department" shall be interpreted as a reference to the "Building Codes Inspector" of the Borough of Towanda.[1]

A. 
Any person who shall violate any of the provisions of the code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the Towanda Borough Council or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance, respectively, be guilty of a summary offense punishable by a fine or not less than $25 nor more than $1,000 or by imprisonment for not more than 30 days, or by both such fine and imprisonment. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time. When not otherwise specified, each 10 days that prohibited conditions are maintained shall constitute a separate offense.

B. 
The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.
Each section of this Fire Prevention Code and every part thereof is hereby declared to be an independent section or part of a section, and if any section, subsection, sentence, clause or phrase of this Fire Prevention Code shall for any reason be held by any court to be invalid, it is the intent that the validity of the remaining phrases, clauses, sentences and subsections of the Fire Prevention Code shall not be affected thereby.
