It shall be unlawful for any person, firm, corporation or company to erect, place, maintain or cause or permit to be erected, placed or maintained upon the streets or sidewalks of Towanda Borough any structure, material, articles, goods, wares, merchandise or groups thereof, animate or inanimate, whether for sale, use or otherwise, except that in a C-2 or C-3 Zone, such structures, material, articles, goods, wares, merchandise or groups thereof, animate or inanimate, whether for sale, use or otherwise, may be allowed upon the sidewalks, provided that at least six feet of free, unobstructed space of sidewalk is available for pedestrian traffic and that the safety and convenience of motorists and pedestrians are maintained. The Borough of Towanda, by the Mayor, Borough Police, Borough Manager or their designees, shall have discretion in determining that these requirements are met. Any such structure, material, articles, goods, wares, merchandise or groups thereof being upon said streets or sidewalks in violation of these requirements are hereby declared to be a nuisance and shall be immediately removed as such.
The Borough of Towanda, by the Mayor, Borough Police or Borough Manager, are authorized and empowered to forthwith cause the removal of any obstruction mentioned and described in § 264-17 hereof, without notice, and to charge against the person, firm or corporation causing or permitting such obstruction the cost of such removal, which shall be collected as ordinary debts are collected in the State of Pennsylvania.
Any person, persons, firm, corporation or company doing, causing or permitting the construction, placing or maintenance of any construction forbidden by this article shall be subject to a fine for this offense not exceeding $5 which shall be imposed by a summary proceedings for the violation of this article.
