No person shall for any reason whatever excavate or dig any
trench or opening in any of the streets or alleys of Towanda Borough
without first obtaining a permit so to do, from the Borough Manager
or Borough Secretary.
The person desiring this privilege shall make a written application
which shall set forth the place of the proposed excavation and the
purpose thereof, together with such information as to the size of
the opening desired as it is reasonably possible to give and the time
when the street shall remain open.
The fee for such permit shall be in an amount as shall be set
from time to time by resolution of the Borough Council, and on all
streets where parking meters are installed, a fee set by resolution
per day for each meter required to be closed during the continuance
of the opening and on other streets, a fee set by resolution per day
for each day the opening remains after the second day under the permit.
Immediately after the completion of the work for which the opening
was made, the person applying for the permit shall have the opening
filled and thoroughly settled, puddled and tamped down and immediately
notify the Borough Manager when this work is completed.
As soon as the extent of the opening has been computed by the
Borough Manager, the person making the opening shall pay to him for
the use of Towanda Borough $4 per square yard for all openings in
streets which are maintained by Towanda Borough, and shall comply
with all of the regulations of the State Highway Department in regard
to openings in streets which are maintained by the Pennsylvania Department
of Highways.
No person shall move or deposit any substance on the street
in the area marked by parking meters so as to prevent the use of the
street and area by the parking meters by any person wishing so to
do. This shall include piling snow, ice or rubbish of any kind.
Any person willfully failing to comply with the provisions of
this article, on conviction before any Magisterial District Judge
of Towanda Borough or the Mayor, shall be liable to a fine of not
less than $5 nor more than $25, together with costs.
