A. 
The Board of Supervisors of Towamencin Township, the Commonwealth of Pennsylvania, adopted, pursuant to the Pennsylvania Municipalities Planning Code, as last amended,[1] regulations governing the subdivision and land development of property within the Township.

B. 
These regulations shall become effective five days after adoption, and shall remain in effect until modified, amended, or rescinded by the Board of Supervisors.
C. 
All previous Township subdivision and land development regulations and subsequent amendments thereto are hereby repealed.
The title of this chapter is "An ordinance establishing rules, regulations and standards governing the subdivision and development of land and the dedication of streets, utilities and other public improvements, setting forth the procedure to be followed by the Township Planning Commission and the Board of Supervisors in applying and administering these rules, regulations and standards, and providing penalties for the violation thereof."
This chapter shall be and may be cited as the "Subdivision and Land Development Ordinance of Towamencin Township."
The regulations are adopted for the following reasons:
A. 
To assist in the orderly, efficient, and integrated development of land;
B. 
To provide for the coordination of existing streets and public utilities with new facilities;
C. 
To provide for efficient and orderly extension of community services and facilities at minimum cost and maximum convenience;
D. 
To ensure conformance of land utilization with the Towamencin Township Comprehensive Plan, as amended, and the Towamencin Township Zoning Ordinance,[1] as amended;

E. 
To promote thereby the health, safety, and general welfare of the residents of the Township;
F. 
To secure equitable handling of all subdivision and land development plans by providing uniform procedures and standards for observance by subdividers and developers, the Township Planning Commission and the Board of Supervisors;
G. 
To provide for adequate open spaces, traffic, recreation, light and air;
H. 
To encourage and promote flexibility, economy and ingenuity in the layout and design of subdivisions and land developments, including authority for the Board of Supervisors to alter site requirements in order to encourage other practices which are in accordance with modern and evolving principles of site planning and development.
In interpreting and applying the provisions of this chapter, they shall be held to be minimum requirements for the promotion of the public health, safety, comfort, convenience and general welfare. When provisions of this chapter and all standards and specifications adopted under it impose greater restrictions than those of any statute, other ordinance or regulations, the provisions of this chapter and its standards and specifications shall be controlling unless specified to the contrary. The illustrations in this chapter are not a part of the chapter, but are included for the purposes of clarification only.
It is hereby declared to be the legislative intent that:
A. 
If a court of competent jurisdiction declares any provisions of this chapter to be invalid or ineffective in whole or in part, the effect of such decision shall be limited to those provisions which are expressly stated in the decision to be invalid or ineffective, and all other provisions of this chapter shall continue to be separately and fully effective;
B. 
If a court of competent jurisdiction finds the application of any provision or provisions of this chapter to any lot, building, or other structure or tract of land, to be invalid or ineffective in whole or in part, the effect of such decision shall be limited to the person, property, or situation immediately involved in the controversy, and the application of any such provision to other persons, their heirs or assigns, property, or situations shall not be affected.
