[Adopted 11-18-1996 by Ord. No. 12-96 (Ch. 106, Art. II, of the 1981 Code)]
A.
The owner or tenant of lands abutting or bordering upon sidewalks along the public streets of the Township shall remove all weeds and other impediments therefrom for a distance of three feet laterally on both sides of said sidewalks within seven days after written notice to remove the same.
B.
Written notice directing the removal of weeds and other impediments shall be given by or under the direction of the Township Clerk or the Health Officer and shall identify the lands abutting or bordering upon the sidewalks as heretofore provided and shall contain a short statement relating in detail the weeds or other impediments which are directed to be removed. The notice shall also contain a statement that the violation of the terms of this section is punishable by fine or community service.
C.
The notice may be served upon the owner or resident in the Township in person or by leaving the same at the owner's or resident's house or place of residence with a member of his family above the age of 14 years. In case any such owner shall not reside in the Township, such notice may be served upon him or her personally or mailed to his or her last known post office address, or it may be served upon the occupant of the property or upon the agent of the owner in charge thereof.
Any party making an excavation in any sidewalk or under a sidewalk shall, in addition to any other requirements imposed by law, provide a substantial and adequate footbridge with rail which shall be at least three feet wide and secured on each side so that pedestrians can pass over at all times.
A.
The owner, tenant, occupant or other person having charge of any dwelling, store, building or lot within the Township of Allamuchy shall, within 24 hours after the cessation of every fall of snow, slush or sleet or the formation of ice upon a sidewalk abutting any such dwelling, store, building or lot, cause the snow, slush, sleet or ice to be removed from the sidewalk to a width of at least 24 inches. In the event that ice or snow cannot be removed from the sidewalk within 24 hours due to weather conditions which make compliance with this provision impossible, sand or rock salt shall be spread on the icy or snow-covered surface in amounts sufficient to melt the ice and/or to provide traction to pedestrians so that safe passage along such sidewalk may occur.
B.
If any owner, tenant, occupant or other person having charge of any dwelling, store, building or lot within the Township shall fail to clear the sidewalk abutting such dwelling, store, building or lot within 24 hours after the cessation of every fall of snow, slush or sleet or the formation of ice upon a sidewalk, the Township of Allamuchy shall immediately cause the removal of such snow and/or ice (or provide for the treatment of the same) at the cost and expense of the owners of such lands abutting the sidewalks within the Township through the procedure set forth in §§ 270-15 and 270-16 of this chapter. The cost for such removal shall be in addition to and not in lieu of any fee or other penalty imposed upon such owner by virtue of the owner's failure to comply with this section.
[Amended 5-21-2013 by Ord. No. 2013-05]
A violation of any provision of this article shall, upon conviction thereof, be punishable pursuant to the general penalty in Chapter 1, Article II, General Penalty, of the Township Code.
