It shall be unlawful for any person to engage in the business for or operating an establishment where tattooing, body piercing, ear piercing or the application of permanent cosmetics is performed as governed by Chapter VII, NJ State Sanitary Code (N.J.A.C. 8:27-1 et seq.) without first obtaining a license from Health Services to engage in such business in accordance with the provisions concerning operations and maintenance of the same as contained in the aforementioned Chapter VIII of the State Sanitary Code.
An application for an initial license to conduct an establishment where tattooing, body piercing, ear piercing or the application of permanent cosmetics is performed shall be accompanied by a fee of $450. The licenses issued aforesaid shall be affective for the calendar year, expiring on the 31st day of December of the year of issue, and shall be renewable for a succeeding calendar year thereafter. The fee for license renewals shall be $200 due and payable on or before the first day of February in the year of renewal. Establishments in operation at the time of enactment of this article shall be required to procure licensing within 30 days of enactment.
A fifty-dollar late fee which or not paid on or before February 1 of the license year. An additional $50 shall be charged for each thirty-day period that the license is not paid after February 1 of the license year.
Any license issued under the terms and provisions of this chapter may be suspended or revoked, after a public hearing by the Monmouth County Board of Health for the violation by the license of any provision of this article or Chapter VIII of New Jersey State Sanitary Code or whenever it shall appear that the business, trade, calling, professions or occupation of the person, firm or corporation to whom such license was issued is conducted in a disorderly or improper manner or in violation of any law of the United States, the State of New Jersey or any ordinance of this municipality.
The provisions of Chapter VIII, NJ State Sanitary Code (N.J.A.C. 8:27-1 et seq.) which govern the operation of establishment that engage in the practices of tattooing, body piercing, ear piercing and the application of permanent cosmetics are hereby annexed as part of this article and are made part of this article by reference and the required number of copies have been placed on file in the office of the Monmouth County Board of Health.
Pursuant to the provisions of N.J.A.C. 8:27-9.1, establishments and individuals that pierce the ear lobe only shall be exempt from the requirements of this article.
