A. 
Fence required. Every person, every member of a partnership and every corporation that owns, directly or indirectly, or operates or uses or has custody or control of or has the right to use any outdoor private swimming pool located in the Village of Rothschild shall erect and maintain a fence or barrier around such swimming pool. A swimming pool is defined as a pool of water 18 inches or more in depth and with a surface area of 48 square feet or more.
B. 
Specifications. Every outdoor private swimming pool shall be completely surrounded by a fence or wall not less than four feet in height, which shall be constructed without openings, holes or gaps larger than four inches in any dimension, except for doors and gates; if a picket fence is erected or maintained, the horizontal dimension shall not exceed four inches. A dwelling house or accessory building may be used as a part of such enclosure. All gates or doors in such enclosure shall be equipped with self-closing and self-latching devices for keeping such gates or doors securely closed when not in actual use.
C. 
Exceptions. No fence or barrier is required for aboveground swimming pools with a height of 42 inches or more from ground level.
D. 
Existing pools. Existing outdoor private swimming pools not fenced shall comply with the terms of this chapter within 60 days from its publication.
A. 
Jurisdiction. The Village of Rothschild Board of Appeals shall have jurisdiction to grant specific variances from the terms of this chapter where it is shown that unique physical circumstances applying to a lot cause hardships to the owner under this chapter. The Board of Appeals shall follow the appeal procedure set forth in Chapter 590, Zoning, of this Code.
B. 
Specific variances. Specific variances, and no others, to be considered by the Board of Appeals shall be with respect to the height, nature or location of the fence, wall, gates or latches, provided that the protection required by this chapter is not reduced by the granting of any variance. A decision of the Board of Appeals shall be final.
Any person violating any of the provisions of this chapter shall, upon conviction, be fined not less than $25 nor more than $200; each day shall be considered a separate offense for purposes of this chapter.
