A. 
Wisconsin Fuel and Light Company, its successors and assigns, is hereby granted a franchise with full right, power and authority to establish, construct and maintain facilities for a natural gas distribution system, and extension thereof, and to sell natural gas to consumers within the Village of Rothschild and for such purpose to enter upon and use and occupy the streets, alleys, bridges, avenues and public places of said Village and to lay, maintain, operate and extend thereon, through and thereunder such mains, pipes, apparatus and appliances as may be necessary for the sale, distribution and delivery of natural gas to consumers within the Village, subject, however, to the restrictions hereinafter set forth.
B. 
For the purpose of carrying into effect the franchise and privileges granted by Subsection A hereof, Wisconsin Fuel and Light Company, its successors and assigns, is hereby authorized to make all necessary excavations in streets, alleys, avenues and public grounds, which shall be done with reasonable dispatch and with the least possible interference with, or inconvenience to, the rights of the public; provided, however, that, except in case of emergency when imminent danger requires immediate action, said company shall first obtain a permit therefor and shall otherwise comply with other ordinances of the Village of Rothschild now in effect or hereafter adopted regulating excavation in streets, provided further that the company shall not be required to furnish surety or other security for restoration of the streets after excavation as therein required. C. 
Wisconsin Fuel and Light Company, its successors and assigns, shall restore all streets, alleys, avenues and public grounds when excavated by it to their original condition of safety and utility. If Wisconsin Fuel and Light Company shall use any bridges or viaducts over which to lay mains or its other facilities, it shall lay or place such mains or other facilities over or upon any bridge or viaduct with the least practicable interference with, or inconvenience to, the rights of the public.
D. 
Except in emergencies, Wisconsin Fuel and Light Company will give the official or committee designated by the Village 24 hours' notice of its intention to excavate in a street, alley, avenue or public place, and such excavation shall be made on the sides or portions of said streets, alleys, avenues or public ground as may be directed by such official or committee.
E. 
Prior to Wisconsin Fuel and Light Company introducing natural gas into the Village of Rothschild and commencing the construction of its distribution system and facilities, it shall procure from the Wisconsin Public Service Commission or any other regulatory body having jurisdiction such certificate or certificates of authority or permits as may be required by law authorizing it to sell and distribute natural gas to customers within the Village of Rothschild.
F. 
If, prior to commencing construction of a gas distribution system and other facilities within the Village of Rothschild, Wisconsin Fuel and Light Company determines that it would not be economically feasible for it to sell and deliver gas to consumers within the Village of Rothschild, it shall have the right to surrender this franchise upon giving the Village of Rothschild notice in writing of its determination to surrender the same, and this franchise thereupon shall become null and void.
G. 
If Wisconsin Fuel and Light Company does not commence the construction of its distribution system and facilities and introduce natural gas into the Village of Rothschild within 12 months of the date when natural gas is delivered by a pipeline to Wisconsin Fuel and Light Company at the City of Wausau, Marathon County, Wisconsin, for sale and distribution by Wisconsin Fuel and Light Company to customers in the City of Wausau and vicinity, or shall discontinue such service, the Village of Rothschild shall have the option to terminate and cancel this franchise upon giving Wisconsin Fuel and Light Company and the Wisconsin Public Service Commission 90 days' written notice of its election so to do.
