The municipal parking lot, also known as the Stockham lot, is hereby designated to permit overnight parking between the hours of 11:00 p.m. and 6:00 a.m., subject to the terms and conditions contained in this section.
A. 
Issuance of overnight parking permits shall be issued only to residents of the Borough, pursuant to a licensing agreement between the resident and the Borough.
B. 
Overnight parking in designated municipal parking lots is limited to vehicles displaying valid placards issued by the Borough.
C. 
Permits for overnight parking in designated municipal parking lots shall be issued on a first-come, first-served basis to any Borough resident submitting a permit application on a form specified by the Borough, together with submission of two valid and current forms of identification indicative of residency within the Borough of Morrisville, a copy of the resident's valid Pennsylvania driver's license, a copy of a valid vehicle registration and a copy of a valid insurance card for such vehicle.
D. 
Subject to availability, no more than two parking permits shall be issued to any Borough household.
E. 
A permit fee, as established from time to time by Borough Council, shall be submitted with an application for a parking permit.
A. 
Permit placards shall be visibly displayed upon the interior windshield of the vehicle.
B. 
Any vehicle parked in the designated municipal parking lot during the permitting hours without displaying a valid permit placard shall receive a summons and shall be towed by the Borough at the owner's expense.
C. 
No person shall authorize, permit, allow or suffer the storage, repair, service, maintenance or overhaul of any motor vehicle of any description upon a designated municipal parking lot.
D. 
Availability of parking in a designated municipal parking lot is not guaranteed by the Borough.
E. 
Permit parking is limited to 24 spaces in the designated municipal parking lot, as identified by appropriate signage.
F. 
Morrisville Borough does not assume responsibility for any vehicle parked in a designated municipal parking lot or for the contents of any such vehicle, and residents submitting applications for permit placards shall be required to execute a waiver agreement indemnifying the Borough against any liability for loss or damage to any permitted vehicle or its contents.
A. 
Any person, firm, corporation or organization violating or failing to comply with any of the provisions of this article shall, upon summary conviction before a District Magistrate having jurisdiction, be punishable by a fine in an amount not less than $25 nor more than $75; upon a second violation, a fine in an amount not less than $75 nor more than $300; and/or a period of community service not to exceed 10 days. Whenever such person shall have been officially notified or by service of a day's continuance of such violation shall, after such notification or service, such person shall be guilty of a separate offense, punishable by a like fine or penalty.
B. 
In addition, Morrisville Borough may institute an action for injunctive relief to prohibit or abate any activity in violation of the provisions of this article when repeated violations by the same person, firm, corporation or organization occur.
