The lawful use of land or of a building existing on September
1, 1988, although such use or building does not conform to the provisions
hereof, may be continued. The mere change of tenancy of ownership
of land or of a building shall have no effect upon the continued permissive
exercise and enjoyment of a nonconforming use existing on September
1, 1988. If no structural alterations are made, a nonconforming use
of a building or land may be changed to another nonconforming use
of the same classification.

Whenever the use of a building or land become nonconforming
to the provisions of this Chapter by reason of a change in the zoning
regulations of district boundaries by amendment of this Chapter, such
use may be continued and the provisions of this Article shall govern
such nonconforming use.

Whenever the use of a building or land becomes nonconforming
to the provisions of this Chapter by reason of annexation to the City,
such use may be continued and the provisions of this Article shall
govern such nonconforming use.

Whenever a nonconforming use of a building or land has been
discontinued for a period of twelve (12) consecutive months, such
discontinuance shall constitute an abandonment of such nonconforming
use and such nonconforming use shall not be re-established and any
use of the building or land thereafter shall be in conformity with
the provisions of this Chapter including the use regulations of the
district in which said building or land is located.

The rebuilding, reconstruction or restoration of a nonconforming
building or structure damaged or destroyed by fire, explosion, wind
or other casualty or act of God, shall be permitted and such nonconforming
use may be continued thereafter subject to the provisions of this
Article.
