No person, persons, partnership, firm, corporation, or association shall, within the City of Herculaneum, Missouri, for himself, herself, themselves or itself, either in person or by agent, directly or indirectly, allow intoxicating liquor to be consumed on premises which are made available for rental or lease to persons or organizations for receptions, meetings or other similar activities without having in his, her, their or its possession a City license.

The term "intoxicating liquor" as used in this Chapter shall mean and include alcohol for beverage purposes, alcoholic, spirituous, vinous, fermented, malt or other liquors, a part of which is spirituous, vinous or fermented, and all preparations or mixtures for beverage purposes, containing in excess of three and two-tenths percent (3 2/10%) of alcohol by weight.

Every person to whom a license is issued under the provisions of this Section shall keep the same conspicuously posted and displayed at the place of business for which such license is issued.

It shall be the duty of the Collector to collect all monies for licenses issued under the provisions of this Section, and said Collector shall keep a complete and accurate account and list of all such licenses issued hereunder so that at any time such list will clearly show, what licenses have been issued, for what purposes issued, the period of time for which issued and the amount paid.

All licenses granted under the provisions of this Chapter shall commence on the 1st day of June in each and every year, and shall expire on the 31st day of May of the year following the date of issuance. Any license purchased for less than twelve (12) months shall be pro-rated on a monthly basis.

No license granted under the provisions of this Chapter shall be assigned or transferred, and no refund shall be made on any license on account of the person to whom such license is issued discontinuing or retiring from the business for which the license was issued.

All licenses issued by the City shall run in the name of the City, be signed by the Mayor, be attested by the City Clerk and shall bear the Seal of the City. The form of such license shall designate to whom issued, the period of time for which issued and the amount paid.

It shall be unlawful for any person, persons, partnership, firm, corporation, or association within the City of Herculaneum, Missouri, to allow the consumption of alcoholic beverages on premises used as set forth above without having first obtained a license to conduct such business within the City, in accordance with the terms of this Chapter, and the violation of this Chapter shall be a misdemeanor punishable by a fine from ten dollars ($10.00) to one hundred dollars ($100.00), and each day of violation may be deemed a separate violation.

For each license for the consumption of intoxicating liquor on premises described as set forth above, there shall be paid the sum of fifty dollars ($50.00) per year.

No person, persons, partnership, firm, corporation, or association having a license under the provisions of this Section shall allow the consumption upon or about the licensed premises of any intoxicating liquor as defined herein in any quantity in violation of Chapter 311, Revised Statues of Missouri.
