For the purpose of this article, terms are defined as follows:
ALLEYWAYS
A narrow street or passageway between or behind a building.
EMERGENCY VEHICLE
A motorized piece of equipment to transport emergency personnel such as police, firefighters, or medical technicians.
The owner, occupant or tenant of any real estate fronting upon or alongside any alleyway located within the Borough of Kenhorst which is provided for the ingress and egress of responding emergency personnel, local residents and the traveling public shall, at the expense of the property owner or occupier, maintain all alleyways in direct connection with said properties as referenced below. Maintenance shall include the repairing of alleyway surfaces which would impede the ingress and egress of emergency response vehicles and personnel; cutting of grasses, weeds and shrubs; the trimming of trees; and parking within alleyways. The specifics of this article are as follows:
A. 
All alleyway surface areas shall be kept in good repair and free of indents and potholes greater than four inches in depth.
B. 
All alleyways shall be maintained free of weeds or plant growth in excess of 10 inches in height. All noxious weeds shall be prohibited.
C. 
All branches of trees shall be maintained to a clearance of no less than 13 feet above the grade of the street or alleyway for the entire distance of the alleyway; and 10 feet from the center line of any alleyway that is 20 feet in width or 7.5 feet from the center line for any alleyway that is 15 feet in width. Alleyways must be free of all obstructions such as fences, sheds, retaining walls and garages located within these distances. Borough Council may designate a higher clearance where conditions or circumstances warrant.

Any person or persons violating any of the provisions of this article shall be punishable as provided in Chapter 1, Article I, Enforcement; General Penalty, of this Code.[2]
