There is hereby created and established the office of City Administrator.

A qualified person shall be appointed City Administrator by the City Council, with the approval of the Mayor. The person so appointed shall serve at the pleasure of the appointing authority.

The person appointed to the office of City Administrator shall be at least twenty-one (21) years of age and shall be chosen solely on the basis of his/her executive and administrative qualities. The person appointed to the office of City Administrator shall reside within the City limits while in office and shall devote his/her full time to the performance of the duties of his/her office.

The City Administrator shall be compensated for his/her services as determined annually by the City Council.

A. 
Administration. The City Administrator shall be the Chief Administrative Assistant to the Mayor and as such shall be the Administrative Officer of the City Government. He/she may head one (1) or more departments and shall be responsible to the Mayor and City Council for proper administration and management of the government business, officers and employees of the City.
B. 
Appointment, Suspension, Removal Of Officers And Employees.

The City Administrator shall appoint all officers and employees of the City, except elected officers and those City employees whose appointment is covered elsewhere in this Code. All appointments by the City Administrator of department heads, department directors and other workers paid an annual salary must be approved by the City Council. All other employee appointments may be made by the City Administrator with approval of the Mayor, but without approval of the City Council. All appointments by the City Administrator shall be made only after the applicable provisions of Article IV of the Personnel Manual have been followed. The Mayor and the City Administrator may be involved, at their discretion, in the selection process in Article IV, Section C of the Personnel Manual.

In cases involving a vacated employee position other than an officer of the City, the City Administrator, with approval of the Mayor, shall have the authority to appoint a current employee to temporarily act in that capacity without City Council approval. The duration of such appointment shall be only until a permanent appointment can be made and shall not exceed three (3) months without approval of the City Council.

The City Administrator shall have the power as provided in the Personnel Manual to suspend or remove all officers and employees of the City except those officers and employees whose suspension or removal is covered elsewhere in this Code.
C. 
Supervision, Control Of Departments. The City Administrator shall coordinate and control the activities of administrative, Street, Park, Water, Sewer, Fire and Police Departments, and shall have the power to alter, amend and set aside orders, rules and policies issued and set by department heads. Coordination and control shall be exercised through the department heads or foremen of the respective departments, if any, and if none, then directly subject to the rules and regulations that may be prescribed from time to time by the City Council.
D. 
Purchasing. The City Administrator shall supervise the purchase of all materials, supplies and equipment for which funds are provided in the budget. He/she shall have the power to purchase materials, supplies and equipment to amounts up to and including five thousand dollars ($5000.00) and all amounts over five hundred dollars ($500.00) shall be subject to approval of the respective committees, unless the health or safety of the citizens of the City are involved, then this limit shall not apply. Contracts for services, construction and items of equipment purchased by sealed bids must be approved by the City Council.
E. 
Supervision Of Bidding. The City Administrator shall supervise the preparation of all bid specifications for services, construction and equipment.
F. 
Right Of Access. The City Administrator or his/her delegates shall have the right of free access to the property of utility consumers during all reasonable hours of the day for the purpose of examining pipes, connections and meters.
G. 
Council Meetings. The City Administrator shall attend all meetings of the City Council and have the right to appear before and address the Council at any meeting.

A. 
Personnel Policy Recommendations. The City Administrator shall recommend for adoption by the City Council standard personnel procedures to include position classifications and pay schedules for all employees covered in the City's personnel program and shall cause to be prepared written job descriptions for all regularly employed City personnel.
B. 
Budget. The City Administrator shall, in cooperation with the Finance Committee, prepare the proposed budget annually and submit it to the City Council, together with a message describing its important features. The budget shall be supported by appropriate schedules and analysis, and the City Administrator shall be designated the Budget Officer of the City.
C. 
Financial Recommendations. The City Administrator shall keep the City Council advised of the financial condition and future needs of the City, and make such recommendations as he/she may deem desirable.
D. 
Rule Making. The City Administrator shall prescribe such rules and regulations as are necessary or expedient for conduct of administrative departments or agencies subject to his/her authority, and he/she shall have the power to revoke, suspend or amend any rule or regulations of the administrative service prescribed by himself/herself or any subordinate.
E. 
Investigations. The City Administrator shall investigate, examine or inquire into the affairs or operations of any department, and when so authorized by the City Council, he/she shall have power to employ consultants and professional counsel to aid in such investigations, examinations or inquiries.
F. 
Utility, Street Supervision. The City Administrator shall supervise the proper operation of the water plant and water distribution system, the sewer plants and sewer distribution system, and the maintenance and repair of streets.
G. 
Supervision Of Assistants. The City Administrator shall supervise all assistants, laborers or helpers who shall be responsible to him/her and who may be discharged by him/her for cause deemed sufficient. Any assistant, laborer or helper who has been discharged by the City Administrator shall have the right to appeal his/her dismissal to the City Council if his/her appeal or complaint is filed in writing with the Council within fifteen (15) days after the date of dismissal.
H. 
Control Of City Property. The City Administrator shall have responsibility for all real or personal property of the City, except as excluded herein, and shall have responsibility for all inventories and upkeep of this property. Personal and real property may be sold by the City Administrator only with approval of the City Council.
I. 
Other Duties. The City Administrator shall perform such other duties as may be required by the City Council, not inconsistent with State Statutes, this Code or other City ordinances, and shall account to the Mayor and City Council for any actions taken when requested to do so, and at all times shall be subject to supervision, control and direction of the Mayor and City Council.

No City Councilperson shall directly interfere with the conduct of any department or duties of employees subordinate to the City Administrator, except at the express direction of the City Council as a body.
