There is hereby established the Scenic Corridor Overlay District, a district subject to the regulations of this Zoning Code.

This district is intended to protect and promote the health, safety and general welfare of the public; to enhance the visual appearance of the corridor; to protect and promote the character and vistas, and prevent unnecessary clutter and congestion along the corridor and the surrounding neighborhoods.

The Scenic Corridor Overlay District boundaries shall be two hundred (200) feet from the property boundary of any park owned and operated for recreational purposes by the government of the United States, any State or any agency thereof.

The Scenic Corridor Overlay District is here established. It shall be in addition to and shall overlay all other zoning districts where it is applied so that any parcel of land lying in the Scenic Corridor Overlay District shall also lie within one (1) or more of the other zoning districts provided by this Title. The effect shall be the creation of a new zoning district consisting of the regulations and requirements of both the underlying district and the Scenic Corridor Overlay District.

Where the standards of the Scenic Corridor Overlay District and the underlying districts differ, the more restrictive standard shall apply.

A. 
The following uses are permitted in the Scenic Corridor Overlay District:
1. 
Uses Permitted By Right. The uses permitted in the Scenic Corridor Overlay District shall be the same uses permitted in the applicable underlying zoning districts, with a vegetative buffering.
2. 
Permitted Accessory Uses. The accessory uses permitted in the Scenic Corridor Overlay District shall be the same as the accessory uses permitted in the applicable underlying zoning districts, with a vegetative buffering.
3. 
Uses Permitted By Conditional Use Permit. The conditional uses permitted in the Scenic Corridor Overlay District shall be the same as the conditional uses permitted under the applicable underlying zoning districts, with a vegetative buffering.

A. 
In all instances vegetative buffering shall consist of a screened yard of vegetative plantings along and adjacent to any State or Federal park boundary. Planting design for vegetative buffering shall be as follows:

The arrangement and spacing of the vegetative buffer shall be provided in such a manner as to screen the activities of the subject lot.

Preservation of existing trees is encouraged to provide continuity, improved buffering ability, pleasing scale and image along and within the Scenic Corridor Overlay District. Any healthy existing tree may be included for credit towards the requirements of this Chapter if the intended effect of this Chapter is maintained.

To ensure adequate space when the vegetative buffer is required, no paving or off-street parking facilities shall be located within any vegetative buffer.

A. 
Landscaping shall be at the outer boundaries and shall be provided except where driveways or other openings are required. Plantings shall be in an irregular or staggered line. Clustering of plant and tree species shall be required. For the purpose of this Section, the following definitions shall be applicable:
1. 
Large Deciduous Tree. A large deciduous tree shall be of a species having an average minimum mature crown spread of greater than thirty (30) feet. A minimum caliper of at least two and one-half (2 1/2) inches at the time of planting shall be required.
2. 
Small Deciduous Tree. A small deciduous tree shall be of a species having an average minimum mature crown spread of greater than twelve (12) feet. A minimum caliper of at least one (1) and three-fourths (1 3/4) inches at the time of planting shall be required.
3. 
Evergreen Trees. Evergreen trees shall have a minimum height of at least six (6) feet at the time of planting.
4. 
Medium Shrubs. Shrubs and hedge forms shall have a minimum height of at least two (2) feet at the time of planting.
B. 
For one-story structures:
1. 
At least one (1) small deciduous tree for each fifty (50) lineal feet and at least one (1) evergreen tree for each thirty (30) lineal feet shall be planted.
2. 
At least one (1) medium shrub for each twenty (20) lineal feet shall be planted.
C. 
For structures over one-story:
1. 
At least one (1) large deciduous tree for each fifty (50) lineal feet and at least one (1) evergreen tree for each thirty (30) lineal feet shall be planted.
2. 
At least one (1) small deciduous tree for each fifty (50) lineal feet shall be planted.
3. 
At least one (1) medium shrub for each twenty (20) lineal feet shall be planted.

Signage shall be subject to the regulations of Chapter 535 of the City Code.

Any building, structure or use existing within the City limits at the effective date of this Section (October 14, 1997) may continue and may be maintained, repaired and improved even though it does not conform to the requirements of this Section. Property annexed into the City after October 14, 1997, shall be governed by the terms and conditions set out in this Section.
