A. 
Every outdoor swimming pool constructed so as to permit a depth of water in excess of twenty-four (24) inches, shall be completely surrounded by a fence, including gates, not less than four (4) feet in height with horizontal openings between the vertical slats if a wooden type fence or wires or iron if a wire or iron type fence of not to exceed four (4) inches. A dwelling house or accessory building may be employed as a part of such enclosure.
B. 
In the event any such pool is constructed above ground with pool walls of not less than forty-eight (48) inches above ground level, no additional fence shall be required except around the ladder or stair access to such pool which shall be enclosed by a forty-eight (48) inch high fence with gates as herein described set back at least three (3) feet from such ladder or stairs. A natural barrier or other protective device approved by the Building Commissioner may be used so long as the degree of protection afforded by the substitute device or structure is not less than the protection afforded by the fence, gate and latch as described.

All gates or doors providing access to such pool shall be equipped with a self closing-self latching device and lock and shall be kept securely closed and locked at all times, except when the pool is in actual use. Latches shall be at least four (4) feet above the ground.
