From and after the adoption of this article, no person shall install an individual or community sewage disposal system or construct any building within the Borough of Tamaqua in which a disposal system is to be installed without first obtaining a permit indicating that the site, plans, and specifications of such system are in compliance with the provisions of the Sewage Facilities Act of the Commonwealth of Pennsylvania[1] and the standards adopted pursuant to said Act.

Applications for permits shall be in writing to the Council of the Borough of Tamaqua, and shall be made on forms provided by the Borough of Tamaqua or the Enforcement Officer and shall include such data as shall be prescribed by the Sewage Facilities Act, including the site, plans, specification, and technical standards for construction.

A. 
No person shall install an individual or community sewage disposal system or construct any building in the Borough of Tamaqua, Schuylkill County, Pennsylvania, in which an individual or community sewage disposal system is to be installed, or make repairs to any sewage disposal system without first obtaining a permit indicating that the site, plans, and specifications of such system are in compliance with Act No. 537, entitled the "Pennsylvania Sewage Facilities Act," its supplements and amendments, and the rules and regulations adopted pursuant to said Act. No. 537, its supplements and amendments.
B. 
The following fees for the services indicated are hereby established, said schedule of fees to remain in force and effect until such time as the Council, by resolution, may adopt a new or additional schedule of fees for applications, permits, licenses and approvals required by the Pennsylvania Sewage Facilities Act, as amended.
(1) 
A fee in the sum of $150 payable to the Borough of Tamaqua shall be paid to the Borough Enforcement Officer at the time of making application for a single-family dwelling unit with a conventional sewage disposal system.
(2) 
A fee in the sum of $200 payable to the Borough of Tamaqua shall be paid to the Borough Enforcement Officer at the time of making application for any sewage disposal system other than a single-family dwelling unit. In the event that the actual cost to the Borough shall exceed the fee paid by the applicant, then the applicant shall promptly pay such excess to the Borough.
(3) 
A fee in the sum of $25 payable to the Borough of Tamaqua shall be paid to the Borough Enforcement Officer at the time of making application for repairs to any sewage disposal system.
C. 
The current schedule of fees adopted by the Council of the Borough of Tamaqua shall be maintained, at all times, at the office of the Borough.
Permits shall be issued or denied within seven days after the receipt of application unless the data submitted on the application shall be incomplete, then the time for acting thereon shall be extended seven days beyond the date of adequate supplementary or amendatory data. The denial of a permit by an Enforcement Officer shall be supported by a statement, in writing, of the reasons therefor.
No system or structure designed to provide individual or community sewage disposal shall be covered from view until approval has been given by the Borough of Tamaqua or the Enforcement Officer; provided, however, that if 48 hours has elapsed (Sundays and holidays excluded) since notice of the completion of construction to the Borough of Tamaqua or the Enforcement Officer, then the applicant may cover said system or structure unless permission has been refused by the issuing body.
The right of a hearing or appeal from the denial or revocation of a permit shall be as prescribed and set forth in the Sewage Facilities Act.
The applicant for a sewage disposal permit and for the issuance of a permit must in all respects comply with the Sewage Facilities Act of the Commonwealth of Pennsylvania and of all the rules and regulations adopted by the Department of Health under and in pursuance of said Act.

Any person who shall install or construct an individual or community sewage disposal system or construct any building in which an individual or community sewage disposal system is to be installed without first obtaining a permit in accordance with this article and under the Pennsylvania Sewage Facilities Act of the Commonwealth of Pennsylvania, or any person who constructs a sewage disposal system not in accordance with the standards prescribed under the Pennsylvania Sewage Facilities Act and rules and regulations of the Pennsylvania Department of Health, shall, upon conviction before a Magisterial District Judge, Alderman, or Magistrate, pay a fine of not less than $300 and costs and not more than $400 and costs or, in default thereof, shall be confined in the County Prison for a period not in excess of 30 days.
