The code hereby adopted may be known and cited as the "Air Pollution Code of the Town of Irvington, 1973 Edition."
There is hereby adopted by the Municipal Council of the Town, pursuant to N.J.S.A. 40:49-5.1, an air pollution code for the purpose of controlling and reducing atmospheric pollution, establishing standards governing the installation, maintenance and operation of equipment relating to combustion, known as the "Air Pollution Code of the Town of Irvington, 1973 Edition." Said code permits access to make inspections and provides penalties for violation of the provisions thereof.

Upon final adoption and approval hereof, three copies of the Air Pollution Code of the Town of Irvington, 1973 Edition, shall be placed on file and remain on file in the office of the Department of Housing Services and in the office of the Clerk of the Town for use and examination by the public so long as this chapter shall continue in effect.

Section 3 of the Air Pollution Code of the Town of Irvington, 1973 Edition, is hereby supplemented by adding the following sections:
A. 
Section 3.1. No person shall engage in or permit the work of sandblasting exteriors of buildings and structures unless and until such person has applied for a permit therefor and such permit has been issued by the Director of the Department of Housing Services to the applicant.

B. 
Section 3.2. Before issuing the permit required by Section 3.1 of the Air Pollution Code, the applicant shall submit proof to the Director of the Department of Housing Services that the applicant owns or will provide and install sufficient safety equipment such as windbreaks and/or source enclosures to reduce surface wind speed and contain or limit the emission of dust particles and such other safety measures necessary to safeguard all persons and property affected and in the vicinity of the building or structure being sandblasted.

C. 
Section 3.3. The hours during which sandblasting operations may be conducted are limited between 8:00 a.m. and 4:00 p.m. and the days limited to Monday through Friday.
D. 
Section 3.4. The fee for the annual permit required under the provisions of Section 3.1 shall be $50.[1]
