GENERAL REFERENCES

As used in this article, the following terms shall have the meanings indicated:
PUBLIC RECORDS
All records which are required by law to be made, maintained or kept on file by any board, body, agency, department, commission or official of the Township of Washington, except as may be otherwise provided by statute, rule of court, any federal law, regulation or order or by any regulation promulgated under the authority of any statute or executive order of the Governor of the State of New Jersey.
Every citizen of this state, during the regular business hours maintained by the custodian of any public records, shall have the right to inspect such records. Every citizen of this state shall also have the right, during such business hours and under the supervision of a representative of the custodian or the custodian, to copy such records by hand or to purchase copies of such records.

Copies of records shall be made available upon payment to the custodian of such records of the following fees:
A. 
Open public records requests. Copies of records shall be made available in accordance with the Open Public Records Act upon payment to the custodian of the following fees which shall at all times be consistent with the Open Public Records Act (N.J.S.A. 47:1A-5b), as may be amended from time to time. See Chapter 212, Fees, for current fees.

B. 
Tax Collector. Fees collected by the Tax Collector for duplicate tax bills, tax information and list of addresses required under the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.) are included in Chapter 212, Fees.

C. 
Photographs. Fees for photographs are included in Chapter 212, Fees.

D. 
For birth, marriage and death certificates: See Article II of this chapter.
All fees received by any custodian pursuant to this article shall be turned over and deposited into the general treasury of the Township of Washington. All cash receipts shall be acknowledged by a receipt duly signed by the custodian of such records and the person paying the fee.
In the event the record or records which are sought to be examined shall pertain to an investigation in progress by any such body, agency, commission, board, authority or official, the right of examination herein provided for may be denied if the inspection, copying or publication of such record or records shall be inimical to the public interest; provided, however, that this provision shall not be construed to prohibit any such body, agency, commission, board, authority or official from opening such record or records for public examination if not otherwise prohibited by law.
