The purpose of this chapter is to act as a supplement to the New Jersey Code of Criminal Justice, N.J.S.A. 2C:1-1 et seq., and any provisions hereof shall be construed so as not to be conflicting with or preempted by any provisions of said code or with the policy of the State of New Jersey as expressed in said code. The provisions of this chapter shall be construed so as to promote the peace, order, health, safety and general welfare of the Township of Washington and the inhabitants thereof.
Any person who violates any of the provisions of this chapter shall, upon conviction, be punishable in accordance with § 1-1 of Chapter 1, General Provisions, of the Code of the Township of Washington. In connection with any provision of this chapter which deals with property, each and every day of violation shall constitute as separate offense, for which a separate penalty may be imposed.
A. 
In this chapter, unless a different meaning plainly is required, the following terms shall have the meanings indicated:
ACT or ACTION
A bodily movement, whether voluntary or involuntary.
CONDUCT
An action or omission.
OMISSION
A failure to act.
PERSON
Includes any natural person and, where relevant, a corporation, unincorporated association or other entity.
B. 
The singular shall include the plural, and the masculine shall include the feminine and neuter.
A person who engages in the following conduct within the limits of the Township of Washington shall be guilty of a violation of this chapter:
A. 
A person who, knowing that he is not licensed or privileged to do so, enters or surreptitiously remains in any structure or a separately secured or occupied portion thereof.
B. 
A person who, knowing that he is not licensed or privileged to do so, enters or remains in any place as to which notice against trespass is given by:
(1) 
Actual communication to the person;
(2) 
Posting in a manner prescribed by law or reasonably likely to come to the attention of intruders; or
(3) 
Fencing or other enclosure manifestly designed to exclude intruders.
C. 
A person who purposely or knowingly damages tangible property, real or personal, of another or damages such property by reckless conduct.
D. 
A person who, with purpose to cause public inconvenience, annoyance or alarm or reckless creating a risk thereof:
(1) 
Engages in fighting or threatening or in violent or tumultuous behavior;
(2) 
Creates a hazardous or physically dangerous condition by any act which serves no legitimate purpose of the person;
(3) 
In a public place and with purpose to offend the sensibilities of a hearer or in reckless disregard of the probability of so doing, addresses unreasonably loud and offensively coarse or abusive language, given the circumstances of the person present and the setting of the utterance, to any person present;
(4) 
Makes or causes to be made a communication or communications anonymously at an extremely inconvenient hour or in offensively coarse language or in any manner likely to cause annoyance or alarm;
(5) 
Subjects another to striking, kicking, shoving or other offensive touching or threatens to do so;
(6) 
Engages in any other course of alarming conduct or of repeatedly committed acts with purpose to alarm or seriously annoy another person;
(7) 
By conduct either unlawful in itself or unreasonable under all the circumstances, knowingly or recklessly creates or maintains a condition which endangers the safety or health of a person or number of persons; or
(8) 
Permits any tenant, lessee, guest, invitee or owner to engage in any of the aforesaid proscribed conduct.
E. 
A person who interferes with, hampers or obstructs or attempts to interfere with, hamper or obstruct any official of the Township of Washington, police officer, special police officer, crossing guard, constable, fireman or official agent or employee who discharging or attempting to discharge his duties within the Township of Washington or who fails to obey and carry out any lawful or reasonable instruction or command given to him by any such individual.
F. 
A person who interferes with the proceedings of any court held by any Municipal Court Judge or hampers or obstructs or attempts to hamper or obstruct any such proceedings, either physically or verbally, including the use of any offensive or abusive language.
G. 
A person who alters, tears or otherwise destroys any summons, warrant or any other process duly issued within the Township of Washington.
H. 
A person who, without a duly issued permit therefor, promotes, establishes, conducts or maintains any street parade, show or exhibition or promotes, establishes, conducts or maintains any show, entertaining or exhibition at or to which admission is charged.
I. 
A person who shall, with purpose to prevent or disrupt a lawful meeting, procession or gathering, does an act to obstruct or interfere with the same.
