As used in this article, the following words and phrases shall have the meanings ascribed to them by this section:
COMMERCIAL VEHICLE
A motor vehicle displaying any advertising, including but not limited to the commercial lettering, name and/or address of an individual or entity, or commercial graphics or other medium, or which bears a license plate reflecting or consistent with commercial usage or which has more than four wheels.
ECOLOGY FACILITY
The compaction equipment heretofore installed by the Township of Washington for the receiving, compacting and removal of garden debris and light trash.
NONCOMMERCIAL VEHICLE
A motor vehicle not coming within the definition of "commercial vehicle" set forth in this section. Illustrative of noncommercial vehicles are passenger automobiles, vans, minivans and trucks not classified as a "commercial vehicle" under this section.
The use of the ecology facility for depositing garden debris and light trash is hereby restricted to residents of the Township of Washington depositing garden debris and light trash from their homes in Washington Township and transported to the ecology facility in their noncommercial vehicles.
The following persons are prohibited from using the ecology facility:
A. 
Persons who do not reside in the Township of Washington.
B. 
Persons depositing garden debris or light trash from places other than their homes in Washington Township.
C. 
Persons transporting garden debris and light trash to the ecology facility in commercial vehicles.
D. 
Persons depositing garden debris and light trash from a business activity.
A. 
Residents of the Township of Washington using the ecology facility shall obtain from the Township of Washington an identification sticker which shall be affixed to the left rear window of any noncommercial vehicle used to transport garden debris or light trash to the ecology facility. No more than two vehicle identification stickers per residence shall be issued. Any person using the ecology facility shall present proof of residence in the Township of Washington when using the ecology facility when so requested by any Township of Washington official. In addition, any resident using the ecology facility may be required to sign a certification as to any matters related to the use of the ecology facility.
B. 
There shall be a fee as set forth in Chapter 212, Fees, for each replacement identification sticker issued.

Noncommercial vehicles fitting in the category of vans and trucks shall not be permitted to use the ecology facility without the owner of any such vehicle first having applied for, and having received, an identification sticker therefor from the Police Department, which identification sticker shall be affixed to the left rear window of any such vehicle. The application for such identification sticker shall be formulated by the Township Council, and the application process shall be conducted by the Police Department to ensure that any such van or truck is not, and is not being used as, a commercial vehicle. All applications under this section shall be accompanied by an administrative fee as set forth in Chapter 212, Fees. Any identification sticker issued by the Police Department under this section shall be subject to revocation by the Police Department in the event that it determines that the subject vehicle is, or is being used as, a commercial vehicle.

The Township Council may from time to time, by resolution, establish such rules and regulations for the control and use of the ecology facility as it may deem necessary or appropriate. Copies of such rules and regulations shall be filed with the Township Clerk and made available to the public, and pertinent provisions of such rules and regulations shall be posted at the ecology facility. The Department of Public Works shall administer the use of the ecology facility in accordance with this article and such rules and regulations adopted by the Township Council.

This article shall be enforced by the Department of Police and the Department of Public Works, which have concurrent jurisdiction, and each of which shall be authorized to have a summons issued for any violation of this article.
Any person who violates any provision of this article or any rules and regulations issued pursuant hereto shall be subject to punishment in accordance with § 1-1 of Chapter 1, General Provisions, of the Code of the Township of Washington.
