The Township of Washington recognizes the value of recycling on the environment, and wishes to advance the benefits of recycling in conjunction with solid waste collection within the Township. It has been the experience of the Township that recycling is enhanced under the per-bag system of solid waste collection. It is the purpose of this article to enhance the Township of Washington's compliance with the New Jersey Statewide Mandatory Source Separation and Recycling Act, as amended, and to supplement the regulation of the disposal of solid waste within the Township by requiring that every responsible solid waste generator shall arrange to have regular collection and/or disposal of all solid waste generated on or about property owned, occupied or leased within the Township in the manner prescribed herein.
The following words for the purpose of this article shall have the following meanings:
REGULAR SOLID WASTE COLLECTION SERVICE
The scheduled pickup and removal of solid waste from residential or commercial premises located within the boundaries of the Township at least once per week.
RESPONSIBLE SOLID WASTE GENERATOR
Any property owner, tenant or occupant of any single-family dwelling or multiple dwelling, or the owner of any commercial building or structure located within the boundaries of the Township, who or which generates solid waste at those premises.
SOLID WASTE
Garbage, refuse, and other discarded materials resulting from residential, domestic or commercial activities.
SOLID WASTE COLLECTION
The activity related to pickup and transportation of solid waste from its source or location to a state-sanctioned solid waste facility or other destination.
SOLID WASTE COLLECTOR
Any person or entity authorized by the State of New Jersey, and any applicable agency thereof, to perform waste collection services within the Township.
SOLID WASTE CONTAINER
A receptacle or container suitable for the depositing of solid waste.

In the case of single-family residential housing located within the Township, each responsible solid waste generator shall enter into a contract for regular solid waste collection service with any person or entity lawfully authorized to provide solid waste collection services within the Township, provided that such solid waste collector shall have in effect a system wherein sealed plastic bags are used for waste collection.[1]

In the case of multiple-dwelling complexes located within the Township, each responsible solid waste generator shall enter into a contract for regular solid waste collection service with any person or entity lawfully authorized to provide solid waste collection services within the Township. In addition to the foregoing, it shall be the responsibility of the owner of a multiple dwelling to provide a sufficient number of appropriate solid waste containers for the deposit of nonrecyclable waste materials to be disposed of as solid waste.
In the case of commercial buildings and structures located within the Township, each responsible solid waste generator shall enter into a contract for regular solid waste collection service with any person or entity lawfully authorized to provide solid waste collection services within the Township.
A. 
Any person who, after receipt of not less than 10 days' notice of noncompliance with the terms of this article, violates or fails to comply with the provisions of this article shall be subject to the following penalties:
(1) 
First offense: fine of $25.
(2) 
Second offense: fine of $50.
(3) 
Third offense: fine of $100.
B. 
Any person(s) who continues to be in violation of the provisions of this article, after a third offense shall be subject to a fine not to exceed the maximum penalty permitted under § 1-1 of Chapter 1, General Provisions, of the Code of the Township of Washington. Such person may also be ordered to perform community service in a recycling program for a period of time not to exceed 240 hours of community service.
