Editor's Note: This ordinance provided that changes to the Borough's permitted parking system shall be effective 7-1-2024, with the current Code permitted parking provisions remaining in effect until such time.
As used in this article, the following terms shall have the meanings indicated:
BOROUGH MANAGER
The appointed Manager of the Borough of Narberth or the Manager's designee.
NEIGHBORHOOD
Areas of the Borough of Narberth separated for the purpose of establishing permitted areas and the administration and enforcement of the Borough's residential parking permit program. Neighborhoods shall be determined based upon the location within the Borough and shall be classified as either central, north, or south.
PERMITTED AREAS
The streets, sides, blocks, and other similar locations throughout a neighborhood as identified in § 475-21 that provide for parking time limitations in such designated areas, excluding metered spaces.
RESIDENTIAL DWELLING UNIT
A building or an individual residential dwelling within a building used for a residential use within the Borough of Narberth, including residential units within a one-family dwelling, a two-family dwelling, a multiple family dwelling, or the residential units within a mixed-use building type, as such terms are defined in Chapter 500, Zoning, of the Code of the Borough of Narberth.
RESIDENTIAL INVITEE
A visitor, invitee, or guest of a residential occupant.
RESIDENTIAL OCCUPANT
A domiciled occupant of a residential dwelling unit located within a neighborhood. Commercial building owners, or persons occupying or leasing a commercial building or portion of a building for commercial purposes shall not be considered a residential occupant under this article.
VEHICLE
An operational motor vehicle primarily used for the transportation of passenger(s) other than any bicycle or scooter that is not required to be registered in the Commonwealth of Pennsylvania.
A. 
This article shall be administered by the Borough Manager, who shall prepare and issue such application forms and permits as may be necessary for the operation and enforcement of this article, and who shall keep suitable records of permits issued and outstanding, and of fees paid.
B. 
The application fees for a residential occupant or residential invitee parking permit, if any, shall be payable to the Borough of Narberth and shall be in amounts established by resolution of Borough Council, as may be thereafter amended. The fee may provide for increasing permit fees for each vehicle associated with the residential dwelling unit.
C. 
Upon application to the Borough Manager, payment of the established permit fee(s), and presentation of a current motor vehicle registration card or other proof of current residency acceptable to the Borough Manager, a residential occupant shall be allowed to receive a parking permit allowing such residential occupant's vehicle(s) to park in a permitted area located within the residential occupant's neighborhood without regard to the established parking time limits for the permitted area. Only vehicles that are used by a residential occupant for their own personal transportation or use shall be eligible for a parking permit.
D. 
The address on the current motor vehicle registration card provided to the Borough Manager to obtain a permit to park a vehicle in a permitted area shall match the address provided by the residential occupant on the permit application. If the addresses do not match, additional information or documentation shall be provided to the Borough Manager to satisfy the Borough Manager, in the Borough Manager's sole discretion, that the applicant is and will be domiciled in a residential dwelling unit for the applicable permit period. No permits shall be issued for an unregistered, unlicensed, or inoperable vehicle.
E. 
The maximum number of vehicles associated with a residential dwelling unit that are allowed to receive a parking permit, and the time period(s) the parking permit shall remain valid, shall be established by resolution of Borough Council, as may be thereafter amended.
F. 
Upon application to the Borough Manager and the payment of any applicable fees, a residential occupant shall be allowed to receive one or more permits allowing a residential invitee of the residential occupant to park their vehicle(s) for a permitted duration of time to be established by resolution of Borough Council, as may be thereafter amended, within a permitted area in the residential occupant's neighborhood without regard to the established parking time limits for the permitted area. Only vehicles that are used by a residential invitee for their own personal transportation or use shall be eligible for a parking permit.
G. 
Except for permits specified for short-term residential invitee parking that may be utilized by different guests of a residential occupant (that is, by hangtag, placard or other transferable item), a permit shall otherwise be valid only for the vehicle and license plate originally associated with the permit and shall be nontransferable either from person to person or from vehicle to vehicle. A replacement permit must be obtained from the Borough if a residential occupant or residential invitee changes a vehicle or license plate that was previously permitted. Additional permits must be obtained if a residential occupant increases the number of vehicles desired to park in a permitted area. Permit fees are nonrefundable.
H. 
A residential invitee permit shall not be required for any business, contractor, or other similar persons parking a conspicuous vehicle or oversized vehicle for the purpose of actively rendering services to owners or occupants of buildings, structures, and properties within the Borough.
A. 
Neighborhoods are hereby established within the Borough of Narberth for the purpose of establishing and administering permitted parking areas throughout the Borough. A residential occupant or residential invitee shall only be allowed to receive a parking permit to park a vehicle within a permitted area located within the residential occupant's neighborhood without regard to the established parking time limits for the permitted area. A map depicting the neighborhoods shall be approved by resolution of Borough Council and shall be maintained by the Borough for public inspection. Amendments to the neighborhood map that do not result in conflicts or inconsistencies with this chapter may be made through a resolution of Borough Council.
B. 
Two-hour parking. Two-hour parking limits are hereby established upon and along portions of certain streets in the Borough of Narberth in the permitted areas as set forth in the table below. It shall be unlawful, and a violation of this article, for any vehicle to remain parked on the same block for more than two hours without possessing a valid permit from the Borough to park in such permitted area during the enforcement period times established below:

A. 
Unless otherwise specified herein, it shall be unlawful, and a violation of this article, for any vehicle to park in any permitted area in excess of the applicable parking time limitations established under this article without possessing a valid permit from the Borough to park in such permitted area. Each hour that the vehicle remains parked in a permitted area in excess of the permitted parking time limitation without possessing a valid permit for such permitted area shall be considered a separate violation of this article and shall be subject to the fines and penalties as set forth in § 475-25B below.
B. 
It shall be unlawful, and a violation of this article, for any vehicle to remain in any permitted area in excess of the applicable parking time limitations established under this article after a previously valid permit to park in such permitted area has expired.
C. 
An electric vehicle shall be permitted to park in a permitted area in excess of the permitted parking time limitation without possessing a valid permit for such permitted area when the electric vehicle is occupying an electric vehicle charging station parking space and is connected to an electric charging station for the purpose of charging the electric vehicle in accordance with the provisions of § 475-33 below.
D. 
All vehicles receiving any permit to park in a permitted area must have a valid motor vehicle license plate that is clearly visible and readable from the exterior of the vehicle. In addition to any other applicable violations of commonwealth law, it shall be unlawful, and a violation of this article, for any vehicle to park in a permitted area in excess of the parking time limitation established under this article without a valid motor vehicle license plate clearly visible and readable from the exterior of the vehicle, even if the vehicle has a permit to park in such permitted area.
It shall be the duty of the police officers and parking enforcement officers of the Borough of Narberth to enforce all violations of any provision of this article, indicating in each issued ticket or notice of violation:
A. 
An identification of the permitted area where the violation occurred;
B. 
The state license number of such vehicle in violation of this article;
C. 
The date and hour of the violation and, if known, the length of time during which such vehicle is parked in violation; and
D. 
Any other facts, a knowledge of which is necessary for a thorough understanding of the circumstances attending such violation.
A. 
Any person or entity violating the provisions of this article, or aiding, abetting or assisting in the violation of this article, shall receive a parking citation in the amount of $20 for the offense unless a different specific fine amount is otherwise provided herein. Each police officer or the parking enforcement officer shall place on a vehicle in violation of this article a notice to the owner thereof that such vehicle has been parked in violation of the provisions of this article and instructing such owner as to provisions for payment of such violation(s) or penalties for failure to pay such violation(s). Each such owner may, within 10 days of when such notice was attached to such vehicle, pay the citation amount(s) at the Borough office or in a designated payment box, as provided on the parking citation(s), as a penalty for and in full satisfaction of such violation(s).
B. 
If any vehicle without a valid permit remains parked in a permitted area in excess of the parking time limit established under this article, or if any vehicle remains parked in a permitted area beyond the maximum time permitted by a permit, such vehicle shall be subject to a $20 fine and penalties after the vehicle exceeds its permitted occupancy of the permitted area and for every day thereafter.
C. 
The failure of a vehicle owner to make payment as designated on any of the parking citations issued within the ten-day period shall render such owner subject to additional court costs and fees associated with the filing and prosecution of the violation. After such ten-day period, such owner shall, upon conviction, be sentenced to pay a fine of $20 for each offense (or the applicable, cited fine for a separate offense), and all costs related thereto.
D. 
In addition to any applicable civil or criminal penalties set forth under the law or within this article, it shall be unlawful for any person to intentionally misrepresent their or another person's address or residency on a parking permit application or to assist with the issuance of a parking permit by intentionally misrepresenting that a person is their residential invitee during a period when such person is not their visitor, invitee, or guest. Such misrepresentation on a permit application shall result in a $500 fine and all costs related thereto. Further, upon conviction, any such persons involved in the misrepresentation, and those residing in the same residential dwelling unit of such person, shall be excluded from receiving future parking permits for vehicles owned, used or controlled by them.
