Prior to the final approval of subdivision and/or land development plans, or the issuance of any permit, or the commencement of any land disturbance activity, the owner, subdivider, developer or his agent shall submit a stormwater management plan to the Borough for approval.
A. 
Appropriate sections from Chapter 480, Subdivision and Land Development, and other applicable local ordinances, shall be followed in preparing the SWM plans.
B. 
The Borough shall not approve any SWM site plan that is deficient in meeting the requirements of this chapter. At its sole discretion and in accordance with this chapter, when a SWM site plan is found to be deficient, the Borough may either disapprove the submission and require a resubmission, or in the case of minor deficiencies Borough may accept submission of modifications.
C. 
Provisions for permanent access or maintenance easements as determined necessary by the Borough for all physical SWM BMPs, such as ponds and infiltration structures, to implement the operation and maintenance plan.
D. 
The following signature block for the municipality: "(Municipal official or designee), on this date (signature date), has reviewed and hereby certifies that the SWM site plan meets all design standards and criteria of the Municipal Ordinance No. (number assigned to ordinance)."
E. 
The following items, where appropriate, shall be included in the plan:
(1) 
General.
(a) 
General description of project.
(b) 
General description of erosion and sedimentation controls.
(c) 
The overall stormwater management concept for the project.

(d) 
A determination of site conditions in accordance with the BMP Manual. A detailed site evaluation shall be completed for projects proposed in areas of carbonate geology or karst topography, and other environmentally sensitive areas, such as brownfields.
(e) 
General description of stormwater controls both during and after development.
(f) 
Pertinent design data summarized in table format for both pre- and post-development conditions, including sub-watershed name or number, drainage area (in acres), curve number or runoff coefficient, time of concentration, peak discharge rate and total discharge volume for each required design storm.
(g) 
Stormwater runoff design computations and documentation as specified in this chapter, or as otherwise necessary to demonstrate that measures have been taken to meet the requirements of this chapter, including the recommendations and general requirements in § 460-14.
(h) 
Expected project time schedule, including anticipated start and completion dates.
(i) 
Training and experience of person(s) preparing the plan.
(j) 
Subdivision and land development plans submitted in conjunction with a stormwater management plan must contain a clear depiction, in plan, profile, and section of all stormwater management facilities, drainage and conveyance facilities, stormwater BMPs, indicating all pertinent invert and water surface elevations. In addition, the plans must indicate the location and pertinent elevations of any site features, which may interfere with the construction of the proposed improvements, or be necessary to evaluate the suitability of the proposed improvements.
(k) 
SWM site plan shall show the locations of existing and proposed on-lot wastewater facilities and water supply wells.
(l) 
The SWM site plan shall include an operation and maintenance (O&M) plan for all proposed physical stormwater management facilities (see Appendix A).[2] This plan shall address long-term ownership and responsibilities for operation and maintenance as well as schedules for O&M activities.

(m) 
A description of permanent stormwater management techniques, including the construction specifications of the materials to be used for stormwater management facilities.
(n) 
A notarized signature of the owner of the parcel for which the SWM site plan is proposed indicating that they are aware of, and will be responsible for, operation and maintenance of the facilities.
(o) 
Existing and proposed land uses.
(p) 
A hydrogeologic assessment of the effects of stormwater runoff on sinkholes where present.
(q) 
The effect of the proposed regulated activity in terms of runoff volumes and peak flows on adjacent properties and/or any existing municipal stormwater collection system that may receive runoff from the project site.
(r) 
A justification must be included in the SWM site plan if BMPs other than green infrastructure methods and LID practices are proposed to achieve the volume, rate and water quality controls under this chapter.
(2) 
Map(s) of the project area showing:
(a) 
The location of the project relative to highways, municipalities or other identifiable landmarks.
(b) 
Existing contours at intervals of two feet. In areas of steep slopes (greater than 15%), five-foot contour intervals may be used.
(c) 
Streams, lakes, ponds or other bodies of water within the project area, or which will be affected by runoff from the project.
(d) 
Other physical features including existing drainage swales and areas of natural vegetation to be preserved.
(e) 
Locations of proposed underground utilities, sewers and water lines.
(f) 
An overlay showing soil types and boundaries.
(g) 
Proposed changes to land surface and vegetative cover.
(h) 
Areas to be cut or filled.
(i) 
Proposed structures, roads, paved areas and buildings.
(j) 
Final contours at intervals of two feet. In areas of steep slopes (greater than 15%), five-foot contour intervals may be used.
(k) 
A note on the plan indicating the location, and responsibility for maintenance of, SWM facilities and/or easements that would be located on adjoining properties as a result of proposed regulated activities, and the location of such facilities and/or easements.
(l) 
Drainage flow pathways.
(m) 
SWM site plan shall show the locations of existing and proposed on-lot wastewater facilities and water supply wells.
(n) 
Plan and profile drawings of all SWM BMPs, including drainage structures, pipes, open channels, and swales.

(3) 
Erosion and sedimentation controls.
(a) 
The staging of all earthmoving activities must be described, including cuts and fills, streets, underground utilities, sewer and water lines, buildings, driveways, parking areas, recreational areas, other structures, etc.
(b) 
The type, location and extent of all erosion and sedimentation control measures must be shown on a map and described, including all calculations, assumptions and criteria used in designing the controls, and a schedule for their implementation.
(c) 
An erosion and sedimentation control plan must be reviewed and approved by the Cumberland County Conservation District for all projects proposing a disturbed area of 5,000 square feet or more.
(4) 
Stormwater management controls.
(a) 
All stormwater management controls must be shown on a map and described, including:
[1] 
Groundwater recharge methods such as seepage pits, beds or trenches. When these structures are used, the locations of septic tank infiltration areas and wells must be shown.
[2] 
Other control devices or methods such as rooftop storage, semipervious paving materials, grass swales, parking lot ponding, vegetated strips, detention or retention ponds, storm sewers, etc.
[3] 
Schedule for installation of the control measures and devices.
(b) 
All calculations, assumptions and criteria used in the design of the control device or method must be shown.
(5) 
Maintenance program. A maintenance program for all stormwater management control facilities must be included. This program must include the proposed ownership of the control facilities and detail the financial responsibility for any required maintenance.
A. 
Five copies of the SWM site plan shall be submitted as follows:

(1) 
Two copies to the Borough.
(2) 
One copy to the Borough Engineer.
(3) 
One copy to the Cumberland County Planning Department when a SWM site plan accompanies a subdivision/land development plan application.
(4) 
One copy to the County Conservation District.
B. 
Additional copies shall be submitted as requested by the Borough or DEP.
C. 
The Borough may establish a fee schedule for the review of SWM plans, the amount of which shall be set by resolution of the Borough Council.
D. 
An electronic copy of the approved SWM plan and supporting documents shall be furnished to the Borough in an electronic PDF copy.
E. 
For any SWM site plan that proposes to use any BMPs other than green infrastructure and LID practices to achieve the volume and rate controls required under this chapter, the municipality will not approve the SWM site plan unless it determines that green infrastructure and LID practices are not practicable.
F. 
If the municipality disapproves the SWM site plan, the municipality will state the reasons for the disapproval in writing. The municipality also may approve the SWM site plan with conditions and, if so, shall provide the acceptable conditions for approval in writing.
A. 
The SWM site plan shall be reviewed by a qualified professional for the Borough for consistency with the provisions of this chapter. After review, the qualified professional shall provide a written recommendation for the Borough to approve or disapprove the SWM site plan. If it is recommended to disapprove the SWM site plan, the qualified professional shall state the reasons for the disapproval in writing. The qualified professional also may recommend approval of the SWM site plan with conditions and, if so, shall provide the acceptable conditions for approval in writing. The SWM site plan review and recommendations shall be complete within the time allowed by the Municipalities Planning Code[1] for reviewing subdivision plans.

B. 
For SWM site plans that do not require subdivision and land development approval, the Borough shall notify the applicant in writing within 45 calendar days whether the SWM site plan is approved or disapproved. If the SWM plan involves a subdivision and land development plan, the notification period is 90 days. If a longer notification period is provided by other statute, regulation, or ordinance, the applicant will be so notified by the Borough. If the Borough disapproves the SWM plan, the Borough shall cite the reasons for disapproval in writing.
C. 
For any SWM site plan that proposes to use any BMPs other than green infrastructure and LID practices to achieve the volume and rate controls required under this chapter, the municipality will not approve the SWM site plan unless it determines that green infrastructure and LID practices are not practicable.

D.

A modification to a submitted SWM site plan that involves a change in SWM BMPs or techniques, or that involves the relocation or redesign of SWM BMPs, or that is necessary because soil or other conditions are not as stated on the SWM site plan as determined by the municipality, shall require a resubmission of the modified SWM site plan in accordance with this chapter.
A disapproved SWM site plan may be resubmitted, with the revisions addressing the municipality's concerns, to the municipality in accordance with this article. The applicable review fee must accompany a resubmission of a disapproved SWM site plan.
The Borough's approval of an SWM plan authorizes the regulated activities contained in the SWM plan for a maximum term of validity of five years following the date of approval. The Borough may specify a term of validity shorter than five years in the approval for any specific SWM plan. Terms of validity shall commence on the date the Borough signs the approval for an SWM plan. If an approved SWM plan is not completed according to § 460-28 within the term of validity, then the Borough may consider the SWM plan disapproved and may revoke any and all permits. SWM plans that are considered disapproved by the Borough shall be resubmitted in accordance with § 460-30 of this chapter.
A. 
The developer shall be responsible for providing as-built plans of all SWM BMPs included in the approved SWM plan. The as-built plans and an explanation of any discrepancies with the construction plans shall be submitted to the Borough.
B. 
The as-built submission shall include a certification of completion signed by a qualified professional verifying that all permanent SWM BMPs have been constructed according to the approved plans and specifications. If any licensed qualified professionals contributed to the construction plans, then a licensed qualified professional must sign the completion certificate.
C. 
After receipt of the completion certification by the Borough, the Borough may conduct a final inspection.
