For the purposes of this chapter, the following terms or words will have the following definitions, unless the context clearly indicates that a different meaning is intended:
PAWNSHOPS
Any establishment the primary business of which is to engage in the business of lending money in exchange for personal property deposited with said establishment that can be kept or sold if the borrower fails or refuses to repay the loan and/or that provide cash in exchange for gold or jewelry, except that establishments engaged in the primary business of the retail sale of jewelry, gold, or similar items and commonly referred to as a jewelry store are not included within the foregoing definition.
Establishments that engage in the business of lending money in exchange for personal property deposited with said establishment that can be kept or sold if the borrower fails or refuses to repay the loan and/or that provide cash in exchange for gold or jewelry, except for jewelry stores, are hereby prohibited within the Borough of Roselle.
Any pawnshop/cash-for-gold or cash-for-jewelry stores currently established within the Borough of Roselle as of the date of adoption of this article may continue said operation.
Any business operating pursuant to § 338-6 shall be permitted to conduct business only between the hours of 10:00 a.m. to 12:00 noon and 3:00 p.m. to 6:00 p.m., Sunday through Saturday.
The penalty for a violation of § 338-5 or § 338-7 shall be in accordance with the general penalty provision of the Borough Code established by Ordinance No. 2346-09.[1]
