For the purposes of this article, the following definitions
shall be applicable:
DWELLING UNIT
Any single-family house, an apartment in a duplex, an apartment
in a multifamily structure, or other living quarters of whatsoever
kind.
OWNER
Any person who alone, jointly, or severally with others,
shall have legal title or equitable title to any dwelling unit, with
or without accompanying actual possession thereof, and shall include
his duly authorized agent or attorney, devisee, fiduciary and any
person having a vested or contingent interest in the property in question.
Owner also includes a tenant occupying a dwelling unit who places
or causes to be placed refuse containers or garbage receptacles at
curbside.
PERSON
Includes a corporation, firm, partnership, association, organization,
any other group acting as a unit, as well as individuals. "Person"
shall also include an executor, administrator, trustee, receiver,
or other representative appointed according to law. Whenever the word
"person" is used in any section of this article prescribing a penalty
or fine, as to partnerships or associates, the word shall include
the partners or members thereof; as to corporations, shall include
the officer, agents or members thereof who are responsible for any
violation of this article.
The owner of every dwelling unit within the Borough shall be
responsible for timely placing and removing sufficient refuse containers,
garbage receptacles and recycling containers for each dwelling unit
and placing the same at curbside pursuant to the following time restrictions:
A. Refuse containers, garbage receptacles and recycling containers shall
not be placed at curbside before 5:00 p.m. the day before the scheduled
day of garbage pickup; and
B. Refuse containers, garbage receptacles and recycling containers must
be removed from curbside within 24 hours after garbage pickup.
The Code Enforcement Officer of the Borough of Millvale is hereby
authorized to issue a citation against any person who violates or
fails to comply with any provision of this article and any amendments
or supplements thereto and, if necessary, prosecute offenders in summary
proceedings before the Magisterial District Judge.
