This chapter shall be known and may be cited as the HMDC Public Safety Code.

a. 
The provisions of this chapter shall be constructed as follows:
1. 
Words and phrases shall be read and construed within their content and shall, unless another or different meaning is expressly indicated, be given their generally accepted meaning, according to the approved usage of language. Technical words and phrases, and words and phrases having special meaning in the law, shall be construed in accordance with such technical or special and accepted meaning.
2. 
Any term in the singular shall include the plural.
3. 
Any terms or words in the masculine shall include females as well as corporations, partnerships, associations, and other artificial persons.
4. 
Any terms in reference to personage shall not discriminate against race, color, national origin, religion, age or handicap.
5. 
Any requirements or prohibition of any act shall, respectively, extend to and include the causing or procuring, directly or indirectly, of such act.
6. 
No provisions hereof shall make unlawful any act necessarily performed by any law enforcement officer, emergency personnel, or employee of the Township of Lyndhurst or HMDC in the line of duty or work as such, or by any person, his agents, or employees, in the proper and necessary execution of the terms of any agreement with the HMDC.
b. 
This chapter shall be effective within all the property, buildings, facilities, waterways, parks, parkways, and playgrounds which are owned, leased, or otherwise under the control of the HMDC.
c. 
Complaints for the violation of the provisions of the within chapter shall be cognizable in the county district court pursuant to N.J.S.A. 2A:6-37 or in the municipal court of the Township of Lyndhurst. The provisions of this chapter shall be enforced by the Township of Lyndhurst police and by any other law enforcement officer having the powers of peace officers as defined by the laws of the State of New Jersey.
d. 
If any section, article, or provision of this chapter, or the application thereof to any person or circumstances, shall be declared to be invalid or inoperative by any court of competent jurisdiction, the remaining sections, articles, or provisions, to the extent that they are not invalid or inoperative, shall not be affected nor invalidated thereby and shall be enforced and effectuated.
e. 
Any person who is found guilty of committing an act which is prohibited or which is declared to be unlawful or an offense or is found guilty of violating either a rule or regulation promulgated pursuant to the chapter and for which the chapter provides no specific penalty, shall be punished pursuant to Section 3-1.3 of these Revised General Ordinances and, shall further be subject to the replacement, repair or restoration of any damaged HMDC property.

Unless otherwise expressly provided, or unless there is something in the subject or context repugnant to such construction the following words and phrases when used in this chapter shall have the meaning herein given:
ANIMALS
Shall mean and includes cats, dogs, horses, any fowl or birds — any living creatures within jurisdiction of the park, other than people.
BEVERAGE CONTAINER
Shall mean a container designed to contain beer malt beverage, wine, distilled spirits, and other alcoholic beverages, mineral water, soda water, or other carbonated drinks or noncarbonated drinks of any variety in liquid form and intended for human consumption.
BICYCLE
Shall mean any device or conveyance upon which a person may ride propelled wholly or in part by human muscular power and having one or more tandem wheels.
DOG
Shall mean any dog, bitch, or spayed bitch.
DRIVER, OPERATOR
Shall mean as defined in Title 32 of the Revised Statutes of New Jersey.
LITTER
Shall mean any refuse, garbage, rubbish, paper, metal, wood, beverage container, cans, glass, or other material or substance which is thrown, deposited or permitted to collect or remain in any place, on HMDC property, which may affect the health, welfare or safety of the public or renders the roadways, parks, playgrounds, or other property unsightly.
LOITERING
Shall mean remaining idle in essentially one location, including the concept of spending time idly, loafing, or walking aimlessly. It shall also include the colloquial expression "hanging around." Standing or speaking in a reasonable, orderly, lawful manner shall not be included in the loitering hereafter dealt with.
MOTOR VEHICLE
Shall mean as defined in Title 39 of the Revised Statutes of New Jersey.
MOTORCYCLE
Shall mean as defined in Title 39 of the Revised Statutes of New Jersey.
MOTORIZED BICYCLE
Shall mean as defined in Title 39 of the Revised Statutes of New Jersey.
MUNICIPALITY
Shall mean Township of Lyndhurst.
OWNER
Shall mean, with respect to ownership of vehicles, as defined in Title 39 of the Revised Statutes of New Jersey. When applied to proprietorship of a dog or other animal, owner shall mean and include every person having a right of property in such dog or other animal and every person who has such dog or other animal in his care, custody, control or keeping.
PARK
Shall mean any park, parkway, waterway, playground, reservation, or other recreational facility, owned, leased, or otherwise under the control of HMDC, which is devoted to active or passive recreation.
PATH
Shall mean any path, footpath, walk or walkway maintained for pedestrians.
PEDESTRIAN
Shall mean as defined in Title 39 of the Revised Statutes of New Jersey.
PERMIT
Shall mean any written license issued by or under the authority of the HMDC permitting the performance of a specified act or acts.
PERSON
Shall mean any natural person, corporation, company, association, firm, or partnership - masculine or feminine.
POLICE or OFFICERS
Shall mean a Township of Lyndhurst police officer or a county police officer.
RECREATIONAL MOTOR VEHICLE
Shall mean, but is not expressly limited to, motorcycles, motorized dirt bikes, motor bikes, mopeds, mini bikes, motor scooters, go-carts, motorized skate boards, dune buggies, swamp buggies, all terrain vehicles, and any other similar motor vehicle of the type that are normally used on land for recreation, entertainment, or pleasure.
ROADWAY
Shall mean as defined in Title 39 of the Revised Statutes of New Jersey.
SAFETY ZONE
Shall mean that area or space officially set aside for the exclusive use of pedestrians which is so plainly marked or indicated by proper signs as to be plainly visible at all times while set apart as a safety zone.
SNOWMOBILE
Shall mean as defined in Title 39 of the Revised Statutes of New Jersey.
STOPPING or STANDING
When prohibited shall mean any cessation of movement of a vehicle occupied or not, except when necessary to avoid conflict of other traffic.
TRAFFIC
Shall mean pedestrians or vehicles (either singly or together) while in the confines of the park's jurisdiction.
TRESPASS
Shall mean to remain without permission in any building or upon any land or recreational facility owned, leased, or otherwise under the control of the HMDC after said building, land or recreational facility is closed.
VEHICLE
Shall mean any wheeled conveyance, except a baby carriage and/or wheelchair, including but not limited to bicycles, motorcycles, motorized bicycles, motor vehicles, push carts, sleds, sleighs or tricycles or any other conveyance whether motor powered, animal drawn or self propelled. The term shall also include any trailer in tow of any size, kind or description.

a. 
Permits shall be obtained by application to the HMDC and may be issued for a variety of purposes including, but not limited to: special use/access to properties owned, leased, or otherwise under the control of the HMDC; specific recreational, educational, and commercial activities on said properties; limited reserved use of public lands and waterways.
b. 
Permits shall bear:
1. 
The name of the permitted group or individual;
2. 
The day and hours for which the permit is granted;
3. 
The park or recreational area or portion of area for which the permit is granted;
4. 
Any other information that is requested by the HMDC that is pertinent.
5. 
The HMDC has the right to request liability insurance covering injuries to members of the general public.
6. 
Applications for permits shall be made to the executive director of the HMDC, or a designated HMDC staff member; and the decision whether or not to grant same shall rest within his/her sole discretion.
c. 
A permit to do any act shall authorize the same only insofar as it may be performed in strict accordance with the terms and conditions thereof. Any violation by its holder or his agents, servants, and/or employees of any term or condition thereof shall constitute grounds for its revocation by the HMDC or by its authorized representative, whose action shall be final.
d. 
A permit is violated when the group arrives more than one hour late to use a reserved area and when the attendance exceeds the conditions of the permit and/or the capacity of the park area for which the permit was issued.
e. 
The HMDC retains the power to restrict or limit the use of certain recreational facilities or park lands for specific purposes, provided that said rules and regulations are not in conflict with this chapter and provided further that same shall be posted in a conspicuous place.
f. 
In the event of issuance of a permit, all person, persons, employees, and/or servants shall follow these standards:
1. 
The granting of a permit for a specific activity is separate and distinct from the granting of any other permit available from the HMDC.
2. 
The proposed activity, or use, in the park or recreational facility will not unreasonably interfere with or detract from the general public's enjoyment of the park.
3. 
The proposed activity or use will not unreasonably interfere with or detract from the promotion of public health, welfare, safety, and recreational or educational use of the park.
4. 
The proposed activity or use will not include violence, crime, disorderly conduct, or destruction to HMDC property or surrounding areas.
5. 
The permit shall be available to any police officer or park official. Failure to produce and exhibit any permit results in immediate removal from that designated area.

a. 
No person owning or having a dog in his care, custody, control or keeping shall cause, suffer, or allow such dog to soil, defile or defecate on any thoroughfare, sidewalk, passageway, play area, park or place where people congregate, unless that person shall immediately remove any feces deposited by such dog in a sanitary method. The feces so removed shall be disposed of in a sanitary manner. If removal is not initiated, a fine consistent with that promulgated by the Township of Lyndhurst Municipal Ordinance will be levied to the person owning, or having a dog in his care, custody, control or keeping.
b. 
No person shall cause or permit any dog or other animal owned by him or in his care, custody, control or keeping to go or be at large or run free; and each dog or other animal so found at large may be seized and disposed of as provided for by law or ordinance covering the disposal of stray animals. The cost of recovery is to be funded by the owner or the person having a dog or animal in his care, custody, control or keeping.
c. 
Every dog shall be restrained by a leash not exceeding six feet in length and shall wear a collar with appropriate license tag affixed thereto of the municipality wherein its owner resides.
d. 
No person shall bring a dog or other domestic animal into areas that are clearly marked by signs bearing the words "Domestic Animals Prohibited in this Area."
e. 
No person shall tie or hitch any animal to any tree or plant or leave any animal unattended.

a. 
No person shall hunt, molest, kill, wound, trap, abuse, shoot, pursue, or throw missiles at, remove, or have in his possession any animal, reptile, or bird found within the HMDC facilities, nor disturb its habitat, or knowingly buy, receive, have in his possession, sell or give away any such animal, reptile, bird, or eggs so taken, except as may be specifically provided for and being in accordance with state/federal fish and game laws.
b. 
No person shall give or offer or attempt to give or offer any animal or bird, any tobacco, alcohol, or other known noxious substances.
c. 
No person shall kill, wound, discharge, or throw missiles at any fish in such waters, or place therein any piscivorous fish, poison, or any other substance injurious to fish.
d. 
No person shall at any time set or use a trap of any kind designed or intended to take, hold, capture, or kill any bird or animal unless it is used in accordance with the regulations of the State Division of Fish, Game and Wildlife. Whenever a trap, the use of which is prohibited, shall be found within the parks, same may be confiscated by any Township of Lyndhurst police officer or other law enforcement officer, including NJ Fish and Game Wardens.
e. 
No person shall crab or fish in any area owned or leased by the HMDC. Sale of all fish and crabs from the tidal Passaic River and the Hackensack River and its estuaries is prohibited by state law.
f. 
Unauthorized release of orphaned, injured, or abandoned wildlife is prohibited.

a. 
Plant and animal wildlife are protected in all park areas. Any person found abusing the sanctuary and damaging trails will be prosecuted to the fullest extent of the law.

a. 
All bicycles which are operated on property owned or under the control of the HMDC shall be subject to inspection at any time to ascertain whether the bicycle:
1. 
Is properly registered in the owner's municipality;
2. 
Has the proper license plate attached in a conspicuous location;
3. 
Is in proper mechanical condition to be operated safely;
4. 
Has an altered, mutilated or destroyed serial number on its frame.
b. 
In the event that a bicycle has an altered, mutilated, or destroyed serial number (except if altered by a municipal police department), or if the bicycle does not conform to any of the above requirements, the Township of Lyndhurst police or other law enforcement officer may confiscate and impound said bicycle, and any expenses involved in the impoundment or storage of said bicycle shall be paid by the owner.
c. 
The owner of the confiscated or impounded bicycle may redeem said bicycle provided that the necessary requirements listed above have been fulfilled and ownership has been proven.
d. 
No operator of a bicycle shall have a bicycle laying, or standing upon any sidewalk, footpath, footbridge, roadway, bridle path or any other public land or in any building owned by the HMDC; which land is commonly used for pedestrian or vehicular traffic, in such a manner as to hinder or impede pedestrian or vehicular traffic.
e. 
No person shall operate a bicycle on a roadway, except as a thoroughfare, and no person shall operate a bicycle upon any sidewalk, path, nature trail, footpath, footbridge, or boardwalk, except those that are specifically set aside for bicycle use.
f. 
Every person operating a bicycle on a roadway shall ride as near to the right side of the roadway as practicable and persons riding bicycles upon a roadway shall ride in single file. When a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway. All bicycles shall be ridden with reasonable regard for the safety of others.

It shall be unlawful for any person to operate or allow, permit or suffer another to operate a motor vehicle or recreational motor vehicle on any sidewalk, path, nature trail, footpath, footbridge, boardwalk, bicycle path, lawn, wooded area, park, playground or any other property, owned, leased, or otherwise under the control of the HMDC, except that the operation of a motorized bicycle, shall be permitted while being operated on the public roadway and only if in compliance with all the requirements of Title 39 of the Revised Statutes of New Jersey.

a. 
No person or persons shall operate a snowmobile on any property owned or leased by the HMDC, except a police officer actually on duty, other on duty emergency personnel and those persons directly involved with the repair and maintenance of any snowmobiles owned by law enforcement departments.
b. 
The Township of Lyndhurst police or a county police officer may impound and confiscate any such snowmobile operated on state property and remove same to a suitable storage place, and any expenses involved in the impoundment or storage thereof shall be borne by the owner.

a. 
No person shall leave a vehicle standing or parked at night in established parking areas or elsewhere in the park area. No motor vehicle shall be parked in said park areas from one-half hour after sunset until sunrise, except as otherwise permitted.
b. 
No person shall drive a vehicle on any area except the paved park roads or parking areas, or such areas as may on occasion be specifically designated as temporary areas, authorized by the HMDC.
c. 
No person shall exceed the speed limits posted on roadways. That said person can be fined by Township of Lyndhurst police officers as well as any county or state officers.

Any person or persons who violate any of the provisions of this section shall, upon conviction, be punished by a fine as established by the Municipal Court of the Township of Lyndhurst.

It is unlawful for any person to make, continue or cause to be made or continued any loud, unnecessary or unusual noise, or any noise which either annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others.

The following acts are hereby declared to be examples of loud, disturbing and unnecessary noise in violation of this chapter:
a. 
The using, operating, or permitting to be played, used or operated, of any radio receiving set, television, musical instrument, phonograph, loud speaker, sound amplifier or other machine or device for the producing or reproducing of sound, in such a manner as to disturb the peace, quiet and comfort of neighboring inhabitants, or with louder volume than is necessary for convenient hearing for the person or persons who are voluntary listeners thereto. The operation of any such set, instrument, phonograph, loudspeaker, sound amplifier, machine or device in such a manner as to be plainly audible at a distance of 25 feet from the place where it is located, shall be prima facia evidence of a violation of this chapter.
b. 
Yelling, shouting, hooting, whistling or singing at any time or place so as to annoy or disturb the quiet, comfort or repose of persons in the vicinity.

Nothing herein contained shall be construed to apply to church bells or chimes, or to prohibit playing by a band or orchestra in a hall or building or in the open air at HMDC or Township of Lyndhurst authorized events.

Any person or persons who are found guilty of violating any of the provisions of this section shall be immediately ejected from the area. If a refusal occurs or the act is repeated, the person or persons shall receive a fine as established by the Municipal Court of the Township of Lyndhurst. Each day such violation is committed or is permitted to continue shall constitute a separate offense and shall be punishable as such.

a. 
No person shall cause, allow or permit a motor vehicle to be abandoned or junked on any property owned, leased or otherwise under the control of the HMDC.
b. 
A motor vehicle which has remained on HMDC property without consent for a period of more than 48 hours, or for any period without current license plates, shall be presumed to be an abandoned motor vehicle.

a. 
No person shall wash or repair a motor vehicle in the park system or on any other property which is owned, leased, or otherwise under the control of the HMDC, except for such repairs as are reasonable and necessary to repair a specific defect which has caused the vehicle to become immobilized and which will remove such impediment to permit removal of said vehicle.

a. 
No person shall fail to observe, remove or change any safety barricade, sign, sign case, or other road, trail or park marking indicating that a road, path, drive or parkway is closed or otherwise restricted as to traffic.
b. 
No person shall, without permission, except in the event of immediate emergency, barricade, close, or place any sign or marker on any road, path, drive or parkway indicating that said road, path, drive or parkway is closed or otherwise restricted as to traffic, nor shall any person place broken glass, nails, tacks or other substance upon any road, parkway, path, boardwalk, or other recreational facility so as to render same dangerous or hazardous.

a. 
No person shall willfully mark, deface, disfigure, injure, tamper with or displace or remove any buildings, bridges, tables, benches, fireplaces, fences, railings, signs, monuments, boardwalks, paving or paving materials, water lines or other public utilities or parts or appurtenances thereof, plaques, stakes, or other boundary markers or any other structure or equipment owned or otherwise under the control of the HMDC.
b. 
No person shall dig or remove any soil, rock, stones, trees, shrubs, grass or plants, nor shall any person cut timber or other wood or make any excavation or in any other way remove, injure, impair or destroy the natural resources or impair the natural beauty or usefulness of any area located in any facility owned or leased by the HMDC.
c. 
No person shall construct or erect any building or structure of any kind, whether permanent or temporary in character, or run or string any public service utility into, upon or across such lands, except with a special written permit issued by the HMDC, through the executive director, and on any property owned, leased or otherwise under the control of the HMDC.
d. 
No person using the restroom or washroom facilities owned or leased by the HMDC shall fail to cooperate in maintaining said restroom or washroom in a neat and sanitary condition.
e. 
No person shall damage, cut, carve, transplant or remove any tree or plant or injure the bark, or pick flowers or seed of any tree or plant, dig in or otherwise disturb grass areas, or in any other way injure the natural beauty or usefulness of any area.
f. 
No person shall climb any tree or walk, stand or sit upon monuments, vases, planters, fountains, railing, fences or upon any other property not designated or customarily used for such purposes.
g. 
No person shall throw, discharge, or otherwise place or cause to be placed in the waters of any fountain, pond, lake, stream or other body of water in any park or any tributary stream, storm sewer, or drain flowing into such water, any substance, matter or thing, liquid or solid, which will or may result in the pollution of said waters.
h. 
No person shall dump in, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage, or refuse, or other trash. No such refuse or waste shall be placed in any waters in any park, or left anywhere on the grounds thereof, but shall be placed in the proper receptacles where these are provided; where receptacles are not provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence, and properly disposed of elsewhere. A fine will be issued to any person or persons who leave or purposely throw, deposit, drop or dispose of rubbish or waste in any area other than those areas designated above.
i. 
Any person found guilty of defacing state property must repair, replace, or pay for damages of said property.

a. 
No person shall bring into or have in his possession or control while on any property or in any park or recreational facility owned, leased or under the control of the HMDC any explosives, fireworks, or compound or substance or mixture having properties of such a character that alone or in combination with other substances, may decompose and suddenly generate sufficient heat, gas or pressure, or any or all of the three, to produce a rapid flaming, combustion, or noise.
b. 
No person shall carry or have in his possession, while on any property owned, leased or otherwise under the control of the HMDC, any dangerous weapon or any gun, pistol or revolver in which or upon which loaded or blank cartridges may be used.
c. 
It shall be unlawful to discharge any firearms on any property owned, leased or otherwise under the control of the HMDC, except as authorized by law. Notwithstanding the above provisions, it shall be lawful to utilize a starter's blank gun during HMDC and Township of Lyndhurst authorized events.
d. 
No person shall shoot into park areas from beyond park boundaries. No person shall carry or possess firearms of any description, or air-rifles, spring-guns, bow and arrows, slings, or any other form of weapons potentially inimical to wildlife and dangerous to human safety, or any instrument that can be loaded with and fire blank cartridges, or any kind of trapping device, except as may be specifically provided for and being in accordance with state and federal fish and game laws.

a. 
No person shall throw or deposit or permit any servant, agent or employee to throw or deposit any litter or beverage containers upon any street, roadway, park, playground or other facility owned, leased or under the control of the HMDC, except in public waste receptacles.
b. 
No person shall throw or deposit any litter or beverage containers in any sewer, fountain, pond, lake, stream or other body of water on property owned or otherwise under the control of the HMDC.
c. 
No person shall drive or remove any truck or other vehicle within property owned or maintained by the HMDC, unless such vehicle is so constructed or loaded as to prevent any load or contents of litter from being blown or deposited upon any roadway, park, playground or other facility owned or controlled by the HMDC.
d. 
No person, while a driver or passenger in a motor vehicle or aircraft, shall throw or deposit any litter, handbills or other objects upon any property owned or otherwise under the control of the HMDC.
e. 
No person shall deposit or dump truckloads or bagfuls of grass clippings, tree clippings, leaves, or other debris upon any roadway, park, playground or other facility owned, leased or under the control of the HMDC, nor shall any person bring garbage from their home or business to be deposited in HMDC refuse containers. Nor shall any person, corporation, partnership or association, permit any of its agents, servants and/or employees, to deposit or dump truckloads or bagfuls of grass clippings, tree clippings, leaves or other debris upon any roadway, park, playground owned or under the control of the HMDC.
f. 
Any person who is found guilty of violating any of the provisions of the above section shall, upon conviction, be punished by a fine as established by the Municipal Court of the Township of Lyndhurst and shall further be subject to pay the costs of removing or cleaning said debris or litter from HMDC property.

a. 
Whenever any HMDC staff or Township of Lyndhurst law enforcement officer shall, in the exercise of reasonable judgement, decide that the presence of any person in any public place is causing or likely to cause any of the conditions enumerated in this section, he shall, if he deems it necessary for the preservation of the public peace and safety, order that person to leave that place. Any person who shall refuse to leave after being ordered to do so by a police officer shall be guilty of a violation of this section.
b. 
No person shall loiter in a public place in such a manner as to:
1. 
Clearly cause an immediate, actual, physical, violent reaction from a reasonable person, which violent reaction will cause a threat to the peace and order of the public;
2. 
Obstruct the free passage of pedestrians or vehicles;
3. 
Obstruct, molest, interfere with any person lawfully in any public place;
4. 
Cause excessive noise or disorder so as to interfere with the sleep or peace and quiet of any person or neighborhood.
c. 
No person shall make unsolicited remarks of an offensive, disgusting or insulting nature or which are calculated to annoy or disturb the person or persons to whom they are made or in whose hearing they are made.
d. 
No person shall, except where specifically permitted by the Traffic Ordinance of the Township of Lyndhurst, between one hour after sunset and 11:00 p.m., remain in any unlighted vehicle or otherwise, at any place, or, between 11:00 p.m. and sunrise, or except in emergency, cause or permit any vehicle, during any part of the period between one hour after sunset and one-half hour before sunrise, to remain standing for a longer period than 30 minutes except when its occupants are attending a gathering or function held pursuant to a permit.
e. 
No person shall annoy, interfere with or harass any other person using the parks or other facilities owned or under the control of the HMDC nor shall any person do anything or any act tending to or inciting others to commit a breach of the peace.
f. 
No person shall fail to obey the lawful instructions of any police officer or interfere with said officer in any way, either directly or indirectly, in the proper performance of his duties.

a. 
No parent or guardian or custodian of any minor shall permit or allow him to do any act prohibited by this chapter.
b. 
Coherent signs shall be placed in any area where minors must be accompanied by an adult.

a. 
No person shall expose or offer for sale any article or thing, nor shall be station or place any stand, cart, or vehicle for the transportation, sale, or display of any such article or thing. Exception is hereby made as to any regularly licensed concessionaire acting by and under the authority and regulation of the HMDC.
b. 
No person shall hand out or distribute or sell any commercial handbill on any land owned, leased, or otherwise under the control of the HMDC; however, it shall not be deemed unlawful for any person to hand out or distribute, without charge, to the receiver thereof, any noncommercial handbill to any person willing to accept it.
c. 
No person shall throw or deposit any handbill, circular, or advertisement in or upon any vehicle within the confines of property owned or otherwise under the control of the HMDC. It shall not be unlawful for a person to hand out or distribute without charge to the receiver thereof, a noncommercial handbill to any occupant in a vehicle who is willing to accept it.
d. 
No person shall post, affix, or paint any notice, poster, or other paper or device calculated to attract the attention of the public to any lamppost, public utility pole, tree, or on any public structure or building owned, leased, or otherwise under the control of the HMDC except as may be authorized or required by law or except pursuant to a permit issued by the HMDC.
e. 
No person shall solicit alms or contributions for any purpose while on property owned, leased, or otherwise under the control of the HMDC.
f. 
No person, corporation, partnership, or association, charitable or otherwise, shall engage in any business or commercial venture or transaction, whether or not for profit, on any property owned, leased, or otherwise under the control of the HMDC without first having obtained a permit from HMDC's executive director.

a. 
Official opening time for HMDC facilities is approximately 9:00 a.m., and closing is sunset, approximately 5:00 p.m. Opening and closing times can be affected by the seasons, adverse ground and weather conditions, emergencies, and obstacles beyond the control of the HMDC.
b. 
No person shall skate, sled, walk, or go upon any ice, except at such times and upon such places as may be designated therefor and until such ice is declared by, or under the authority of the HMDC to be in a safe condition therefor.
c. 
No person shall coast with sleds, skis, toboggans, or other vehicles whether with or without runners, except at such places as may be designated therefor.
d. 
No person shall throw, catch, kick, or strike any base-ball, golf ball, football, basketball, or other object except in places designated therefor.
e. 
No person shall take part in or abet the playing of any games involving thrown or otherwise propelled objects such as balls, stones, arrows, javelins, horseshoes, quoits, or model airplanes except in those areas set apart for such forms of recreation. The playing of rough or comparatively dangerous games such as football, baseball, and lacrosse is prohibited except on the fields and courts or areas provided therefor. Roller skating and/or roller blading shall be confined to those areas specifically designed for such pastime.
f. 
No person shall set up tents, shacks, or any other temporary shelter for the purpose of overnight camping, nor shall any person leave in a park after closing hours any movable structure or special vehicle to be used or that could be used for such purpose, such as house trailer, camp trailer, camp wagon, or the like except in those areas designated by the HMDC for those purposes.
g. 
No person shall swim, bathe, or wade in any waters or waterways in any park, except in such waters and at such places as are provided therefor, and in compliance with such regulations as are herein set forth or may be hereinafter adopted. Nor shall any person frequent any waters or places customarily designated for the purpose of swimming or bathing, or congregate thereat when such activities are prohibited by the HMDC upon finding that such use of the water would be dangerous or otherwise inadvisable.
h. 
Golf driving and putting practice are not permitted at HMDC park facilities for safety reasons.
i. 
For patrons' safety, hiking is limited to only the specified hiking trails.
j. 
Kites, remote control model boats, and/or planes may be operated only where and when the HMDC allows such operation, in compliance with regulations and/or permit conditions that may be hereinafter adopted.

a. 
No person shall remain without permission in any building or upon any land or recreational facility owned, leased, or otherwise under the control of the HMDC after said building, land or recreational facility is closed. Any person found trespassing will be subject to a fine as established by the Municipal Court of the Township of Lyndhurst.

a. 
No person shall buy, sell, offer for sale, possess, drink or consume any or be under the influence of alcoholic beverages or illegal narcotic drugs upon any property owned, leased or otherwise under the control of HMDC.
b. 
Any person found possessing illegal drugs will be punished to the full extent of the law.

a. 
No person shall kindle, build, maintain, or use a fire in any park or other recreational facility owned or under the control of the HMDC.
b. 
No person shall throw away or discard any lighted match, cigar or cigarette within or against any building, or under any tree, in any underbrush, or anywhere else except designated receptacles.
c. 
No person shall have in his possession, or set, or otherwise cause to explode or discharge or burn any firecrackers, torpedo rockets, or other fireworks, firecrackers, or explosives of flammable material, or discharge them, or throw them into any such areas from lands or highways adjacent thereto. This prohibition includes any substance, compound, mixture, or article that, in conjunction with any other substance or compound, would be dangerous from any of the foregoing standpoints.
d. 
No person shall picnic or lunch in a place other than those designated for that purpose. Attendants shall have the authority to regulate activities in such areas when necessary to prevent congestion and to secure the maximum use for the comfort and convenience of all.
e. 
No person or persons shall use any portion of a picnic area or any of the buildings or structures therein for the purpose of holding picnics to the exclusion of other persons, nor shall any person use such areas and facilities for an unreasonable time if the facilities are crowded.
f. 
No person or persons shall leave a picnic area before all waste is placed in the disposal receptacles. If no such waste receptacles are available, then waste shall be carried away from the park area by the picnicker to be properly disposed of elsewhere.

Any person violating any of the provisions of this chapter or any rule or regulation promulgated pursuant hereto shall upon conviction be subject to the replacement, repair or restoration of any damaged park property and shall be subject to a fine as established by the Municipal Court of the Township of Lyndhurst.
