A. 
Any time an on-street public parking space is restricted or a public street, sidewalk or any part of the public right-of-way is closed, the responsible entity for the restriction/closure shall provide written notice to the City and property owners adjacent to, or situated upon, the parking space or street for which the parking is to be restricted or street closed at least 72 hours prior to starting work.
B. 
This notice shall be in writing to the City Engineer and/or Director of Public Works and must include the following information:
(1) 
Street location and/or address.
(2) 
Contact person.
(3) 
Duration of restriction/closure.
(4) 
Type/nature of work.
C. 
The City Engineer or Director of Public Works may require information in addition to § 515-46B.
D. 
In the case where a City department is responsible for the closure, such as for a street excavation, moving permit, dumpster permit or the like, the responsible department shall submit the notice.
E. 
In the event of an emergency, the responsible entity shall be required to submit the notice of restriction/closure within two hours of putting the restriction/closure in place.
F. 
Police and fire emergencies are exempt from this article.
Any entity that commences work without having properly submitted the notice as set forth in § 515-46 will be found in violation. Notice of this violation may be submitted by any City employee, and upon such notice all work will stop immediately. Work shall not resume until an approved notice form is completed and submitted properly. Any person violating the provisions of this article shall be fined not more than $300 per incident and, in default of payment of fine and costs, imprisoned not more than 90 days. Any entity fined under this section shall be prohibited from performing further work within the City until all fines are paid in full.
