The following words and phrases shall have the particular meaning
specified for the purpose of this chapter
ABANDONED VEHICLE
A.
Any vehicle (other than a pedal cycle) that:
(1)
Is inoperable and is left unattended on public property for
more than 48 hours;
(2)
Has remained illegally on public property for a period of more
than 48 hours;
(3)
Is without a valid registration plate or certificate of inspection
or title left unattended on or along a highway; or
(4)
Has remained on private property without the consent of the
owner or person in control of the property for more than 48 hours.
B.
Vehicles meeting any of the above criteria shall be considered
abandoned and in violation of this chapter. Vehicles and equipment
used, or to be used, in the construction, operation or maintenance
of public utility facilities, left in a manner which does not interfere
with the normal movement of traffic, shall not be considered abandoned.
ACCESS ROAD
The roadway used for ingress and egress from a Township or
state road providing private access to an oil and gas development
and/or related operations.
ACCESSORY BUILDING
A building which is on the same lot with, but detached from,
the principal building and which is customarily incidental and subordinate
to the principal building, including, but not limited to, storage
sheds and garages.
ACCESSORY FARM BUILDING
A detached structure on the same lot with the principal farm
resident, which is customarily incidental and subordinate to the principal
agricultural use of the lot, including barns, silos, stables and other
similar structures.
ACCESSORY STRUCTURE
A detached structure on the same lot with the principal building
or structure which is customarily incidental and subordinate to the
principal building or structure, including, but not limited to, carports,
swimming pools, docks fences, walls, gazebos, signs, air conditioning
units, heat exchangers, antennas and other similar structures.
ACCESSORY USE
A use of land or of a building or portion thereof, customarily
incidental and subordinate to the principal use of the land or building,
and located on the same lot with the principal use or structure.
ADULT-ORIENTED BUSINESS
A business or club which engages in one or more of the following
areas of sales, services or entertainment:
A.
ADULT BOOKSTOREAny establishment or place which has a substantial or significant portion of its stocks in trade consisting of the following items:
(1)
Books, magazines or other periodicals, films or other forms
of audio or visual representation which are distinguished or characterized
by an emphasis on depiction, description or display of sexual activities
or conduct or uncovered male or female genital areas; and/or
(2)
Instruments, devices, or paraphernalia which are signed primarily
for use in connection with sexual activities or conduct; and/or
(3)
To which the public is permitted or invited wherein coin- or
slug-operated or electronically or mechanically controlled still or
motion-picture machines, projectors or other image producing devices
are maintained to show images, with or without sound, where the images
so displayed are distinguished or characterized by an emphasis on
depiction, description or display of sexual activities or conduct
or uncovered male or female genital areas.
B.
ADULT THEATERAny theater, auditorium, concert hall or other place of assembly:
(1)
Presenting any form of audio and/or visual material, and in
which a substantial portion of the total presentation time measured
over any consecutive twelve-month period is or will be devoted to
the showing of material which is distinguished or characterized by
emphasis on depiction or display of sexual activities or uncovered
male or female genital areas; or
(2)
Featuring live performances on a regular basis which are distinguished
or characterized by emphasis on depiction, description or display
of sexual activities or by exposure of uncovered male or female genital
areas for observations by patrons.
C.
MASSAGE ESTABLISHMENTAny establishment or business which provides the services of massage and body manipulation, including exercises, heat and light treatments of the body, and all forms and methods of physiotherapy, unless operated by a medical practitioner, chiropractor or professional physical therapist licensed by the commonwealth. This definition does not include an athletic club, health club, school, gymnasium, reducing salon, spa or similar establishment where massage or similar manipulation of the human body is offered as an incidental or accessory service.
AGRICULTURE
The production, keeping, or maintenance, for sale, lease,
or personal use, of plants and animals useful to man, including but
not limited to forages and sod crops; grains and seed crops; dairy
animals and dairy products; poultry products; livestock, including
beef cattle, sheep, swine, horses, ponies, mules, or goats or any
mutations or hybrids thereof, including the breeding and grazing of
any or all kinds, including grapes, nuts and berries; vegetables;
nursery, floral, ornamental, and greenhouse products; or lands devoted
to a soil conversation or forestry management program. Home gardens
are excluded from this definition.
ALLEY
A service roadway that affords only a secondary means of
access to abutting properties and not intended for general traffic
circulation.
ALTERATION
Any change or rearrangement in the supporting members of
an existing building, such as bearing walls, columns, beams, girders,
or interior partitions, as well as any change in doors, windows, means
of ingress or egress, or any enlargement to or diminution of a building
or structure, whether horizontally or vertically, or the moving of
a building from one location to another.
ALTERATIONS, STRUCTURAL
Any changes in either the supporting members of a building,
such as bearing walls, columns, beams, and girders, or in the dimensions
or configurations of the roof or exterior walls.
APARTMENT HOUSE
A structure containing three of more dwelling units. See
"dwelling, multifamily."
APARTMENT UNIT
One or more rooms with private bath and kitchen facilities
comprising an independent, self-contained dwelling unit in a building
containing three or more dwelling units.
APPLICANT
An individual, corporation, entity that fills out the application.
AUTO BODY SHOP
Any structure or any building or part thereof that is used
for the repair and/or painting of motor vehicle bodies.
AUTOMOBILE LAUNDRY or CAR WASHING FACILITY
A structure used for the purposes of cleaning or reconditioning
the exterior and interior surfaces of automotive vehicles, but not
including an incidental one-bay washing facility in a gasoline service
station where washing facilities are associated with the operation
of said service station.
AUTOMOBILE SERVICE STATION
A retail place of business engaged in servicing of motor
vehicles, including and limited to one or more of the following activities:
the sale of petroleum products; sales, installation and service of
tires, batteries, automotive accessories and replacement items; washing
and lubrication services; the supplying of other incidental automotive
customer services and products; and the performing of automotive maintenance
and repair, excluding such repairs as spray painting, body, fender,
axle, frame, major engine overhaul or recapping/retreading of tires,
provided retail sale of petroleum products is part of the operation.
A service station may also include the operation of a convenience
food store, provided retail sale of petroleum products is a part of
the operation.
BASEMENT
A space having 1/2 or more of its floor-to-ceiling height
below the average level of the adjoining ground and with a floor-to-ceiling
height of not less than 6 1/2 feet.
BILLBOARD
See "sign, commercial outdoor advertising sign."
BOARDINGHOUSE
A dwelling unit or part thereof in which lodging and meals
are provided for compensation; personal and financial services may
be also be offered.
BOARDING STABLES
A structure designed for the feeding, housing, and exercising
of horses not owned by the owner of the premises and for which the
owner of the premises receives compensation.
BORE HOLES
Structures and appurtenant facilities to permit the introduction
from the surface to underground mining operations, or the removal
from underground mining operations to the surface, of electric power,
water (with or without treatment facilities), rock dust for safety
purposes, communication lines, compressed air and other gases, and
such other substances as may facilitate the mining and removal of
coal.
BUFFER YARD
Open spaces, landscaped areas, fences, walls, berms, or any
combination thereof used to physically separate or screen one use
or property from another to minimize or eliminate any potential negative
impacts (views, noise, signs, parking areas, dirt, glare of lights,
and litter) on adjacent uses.
BUILDING
A roofed structure enclosed by walls to be used for shelter,
enclosure or protection of persons, goods, materials, or animals.
BUILDING HEIGHT
The vertical distance from the basement floor or, if there
is no basement, the distance from the first floor to the highest roof
beams on a flat or shed roof, the deck level on a mansard roof, and
the average distance between eaves and the ridge level of gable, hip,
and gambrel roofs.
BUILDING LINE (SETBACK)
An established line within a property defining the minimum
required distance between the face of any structure to be erected
and the adjacent street right-of-way line.
BUILDING, PRINCIPAL
The building or buildings on a lot in which the principal
use or uses are conducted.
BULK
The volume of a building or structure indicating the total
space enclosed by the exterior walls and roof.
CAMPGROUND
A parcel of land used or intended to be used, let or rented
for occupancy by campers or by trailers, rooms, cabins, or sleeping
quarters of any kind.
CARPORT
A completely or partially open space for the storage of one
or more vehicles in the same manner as a private garage, which may
be covered by a roof supported by columns or posts except that one
or more walls may be the walls of the main building to which the carport
is an accessory building or extension.
CARTWAY
The paved area of a street, including travel lanes and parking
areas, but not including shoulders, curbs, sidewalks or wales.
CENTER LINE OF STREET
A line which is usually at an equal distance from both edges
of the improved portion of the street or established right-of-way.
CERTIFIED MODULAR LARGE VOLUME TANKS (MLVTs)
For the purposes of this chapter, MLVTs include any aboveground,
fully enclosed tank field assembled from multiple uniform factory
prepared components which provides primary containment for 100,000
barrels or more of fluids. By this definition, MLVTs are typically
field-assembled on an oil and gas location for temporary use or are
dismantled for movement to a different location following their use.
This shall include modular large volume tanks (MLVTs) that meet American
Water Works Association (AWWA) standards or standards deemed to be
acceptable by the Township. For use in association with oil and gas
development and related operations.
CERTIFIED WATER STORAGE FACILITIES
An aboveground assembly of fluid storage containers that
are each certified by a nationally-recognized testing laboratory or
organization such as the ASA, American Petroleum Institute, ASTM International,
the American Society of Mechanical Engineers, or the American Water
Works Association and used to hold fresh water and/or reuse water
for use in oil and gas development and related operations.
CHURCH
A building or structure, or groups of buildings or structures,
other than a dwelling, that be design and construction are primarily
used for conducting organized religious services and associated accessory
uses, such as rooms for religious education, social and recreational
activities, administrative offices and preschool or elderly day care.
CLINIC
Any outpatient establishment licensed by the commonwealth
where human patients are examined and treated by doctors or dentists.
CLINIC, VETERINARY
An establishment where animals are examined and treated by
licensed veterinarians and which may include kennels for temporary
boarding of animals during treatment.
CLUB
A group of people organized for a common purpose to pursue
common goals, interests, or activities and usually characterized by
certain membership qualifications, payment of fees and dues, regular
meetings, and a constitution and bylaws.
CLUSTER HOUSING
A single-family housing development where some or all of
the lots are reduced below the minimum lot size, but the overall project
meets the zoning density for the underlying zoning district by preserving
open space.
COAL TIPPLES AND CLEANING PLANTS
Structures and facilities usable and useful for bringing
of coal and other substances from mines to the surface, for the storing
of coal (including the separation of waste material and moisture therefrom),
for the processing and classifying of coal and for the storage and
loading of said coal for movement off the premises.
COMMERCIAL RECREATION
An enterprise operated for profit, by other than a public
entity, for the pursuit of sports, recreation and entertainment activities.
COMMISSION, PLANNING
The North Franklin Township Planning Commission of Washington
County, Pennsylvania.
COMPRESSOR
A device that raises the pressure of natural gas and/or by-products.
"Compressors" are any devices that create a pressure differential
to move or compress vapor or a gas. Any such device used alone or
in series to adequately move a vapor or a gas is considered a "compressor."
COMPRESSOR STATION
A facility designed and constructed to compress natural gas
that originates from a single well site or a collection of well sites
and to remove water or water vapor from the natural gas, which operates
as a midstream facility for delivery of gas to a transmission pipeline,
distribution pipeline, processing plant or underground storage field,
including one or more natural gas, electric compressors, associated
buildings, pipes (other than regulated or unregulated local distribution
system, gathering system or transportation lines served by the compressor
station), valves, tanks and other equipment.
COMPRESSOR STATION FACILITY FOOTPRINT
The site and/or fenced compound which will be developed and
constructed for use as a compressor station containing buildings,
compressors and related equipment necessary for the operations as
a compressor station for the transportation and treatment of gas that
will be traveling through a pipeline network. This site shall not
be used for the storage of pipeline, equipment, or construction trailers
during normal operations.
CONDITIONAL USE
An authorized use which may be granted only by the Supervisors
pursuant to express standards and criteria prescribed in this chapter,
review and recommendations by the Planning Commission and public hearing
by the Supervisors. In allowing a conditional use, the Supervisors
may attach such reasonable conditions and safeguards, in addition
to those expressed in the chapter, as they may deem necessary to implement
the purposes of this chapter.
CONTRACTOR'S YARD
A lot or parcel used for the permanent storage of construction
equipment and supplies, but not including the sale of supplies or
the repair or sale of heavy equipment.
CONVENIENCE STORES
Any retail establishment which caters to residents without
creating undue vehicular congestion, excessive noise or other objectionable
influences. To prevent congestion, convenience stores include only
those enterprises which normally employ less than 10 persons.
CONVENTIONAL WELL
A conventional gas well, also known as a "traditional well,"
is a well that produces oil or gas from a conventional formation.
Conventional formations are variable in age, occurring both above
and below the Elk Sandstone. While a limited number of such gas wells
are capable of producing sufficient quantities of gas without stimulation
by hydraulic fracturing, most conventional wells require this stimulation
technique due to the reservoir characteristics in Pennsylvania. Stimulation
of conventional wells, however, generally does not require the volume
of fluids typically required for unconventional wells.
CONVERSION APARTMENT
An independent complete living unit with separate entrance
added on to a single-family detached dwelling which maintains the
character of the single-family neighborhood.
DAY-CARE HOME
A facility located within a dwelling for the care of not
more than six children under 16 years of age (excluding the provider's
own children) on a regular basis during part of a twenty-four-hour
day.
DEEP INJECTION WELL (CLASS II WELL)
Wells used to inject fluids associated with the production
of oil and natural gas or fluids and compounds used for enhanced hydrocarbon
recovery. These wells normally inject below the deepest underground
source of drinking water (USDW) except in cases where the USDW contains
producible quantities of oil or gas and are defined as Class II Wells
by the United States Environmental Protection Agency (EPA).
DEP
The Pennsylvania Department of Environmental Protection (DEP),
the commonwealth agency responsible for overseeing and administering
environmental laws and regulations within Pennsylvania.
DISTANCE BETWEEN BUILDINGS
The horizontal distance measured between the two closest
points of two buildings located on the same lot.
DRILLING
Any digging or boring activity of a new well or reworking
of an existing well to explore, develop or produce oil, gas or other
hydrocarbons or to inject gas, water or any other fluids or substances
into the earth.
DRIVE-IN FACILITY
Any establishment that by design, physical facilities, service
or by packaging procedures encourages or permits customers to receive
services, obtain goods, or be entertained while remaining in their
motor vehicles.
DWELLING
Any building designed or used as permanent living quarters
for one or more families, not including hotels, motels, lodging or
boardinghouses.
DWELLING QUADRUPLEX
Four attached dwellings in one building in which each unit
has two open space exposures and shares one or two walls with an adjoining
unit or units.
DWELLING UNIT
One or more rooms for living purposes together with separate
cooking, sleeping, and sanitary facilities provided for the exclusive
use of a single family maintaining a common household.
DWELLING, MULTIFAMILY
A building containing three or more dwelling units that are
located one over the other. Multifamily buildings include garden apartments
and mid-rise and high-rise apartment buildings.
DWELLING, SINGLE-FAMILY
A residential building containing one dwelling unit designed
for occupation by a family or by a group of unrelated persons who
function as a relatively permanent household and have the generic
character of a family unit.
DWELLING, TOWNHOUSE
A one-family dwelling in a row of at least three such units,
which each unit has its own front and rear access to the outside,
no unit is located over another unit, and each unit is separated from
any other unit by one or more vertical common fire-resistant walls.
DWELLING, TWO-FAMILY
A residential building containing two independent dwelling
units, under either single or separate ownership, each having a separate
entrance, and which is the only principal building on the lot.
EDGE OF WELL PAD
This shall mean the edge of the disturbed area associated
with the operations.
ELECTRIC SUBSTATION
An assemblage of equipment for purposes other than generation
or utilization, through which electric energy in bulk is passed for
the purposes of switching or modifying its characteristics to meet
the needs of any land use.
ENLARGEMENT
An increase in the size of an existing structure or use,
including physical size of the property, building, parking, and other
improvements.
ESSENTIAL SERVICES
The erection, construction, alteration or maintenance by
public utilities, municipal, or other government agencies, of underground
or overhead gas, electrical, steam, fire alarm boxes, traffic signals,
hydrants, and other similar equipment and accessories in connection
therewith, necessary for the furnishing of adequate services by such
public utilities or municipal or governmental agencies for the public
health, safety or general welfare. "Essential services" do not include
buildings or cross-country transmission facilities.
EXPLORATION
Temporary geologic or geophysical activities such as drilling
in context with the zoning definition in this chapter, including seismic
surveys related to the search for natural gas or other subsurface
hydrocarbons.
EXTRACTION
The act or process of separating, obtaining or removing a
substance, such as a mineral, including but not limited to coal, sulfur,
petroleum, oil and/or gas, and including oil and gas development.
FACTORY AUTHORIZED EQUIPMENT DEALER
Any person, partnership, corporation, association, or other
form of business enterprise that is primarily engaged in the wholesale
and/or retail sale of equipment, including, but not limited to, commercial
grade vehicles, construction equipment, cars, trucks, vans, motorcycles,
trailers, recreational/utility vehicles and similar items.

FAMILY
A group of individuals not necessarily related by blood,
marriage, adoption, or guardianship living together in a dwelling
unit as a single housekeeping unit under a common housekeeping management
plan based on an intentionally structured relationship providing organization
and stability.
FARM
Any lot or group of contiguous lots under single ownership
containing at least 10 acres, on or in which agriculture and farming
operations are carried on as defined by this chapter, and shall include
the residence or residences of owners, occupants, or employees, and
any accessory farm buildings located on such land.
FENCE
An artificial barrier constructed of any material or combination
of materials erected to enclose, screen, or separate areas.
FLOOD PLAN
All land subject to the 100-year flood shown on the North
Franklin Flood Insurance Rate Map (FIRM) which accompanies the Flood
Insurance Study (FIS) prepared by the Federal Emergency Management
Agency (FEMA) dated July 4, 1898, or the most recent revision.
FLOOR AREA RATIO
A mathematical expression determined by dividing the gross
floor area of a building(s) by the area of the lot which it is located.
GROSS FLOOR AREA ÷ TOTAL LOT AREA = F.A.R. (FLOOR AREA
RATIO)

FLOOR AREA, GROSS
The sum of the gross area of the floors of a building measured
from the face of exterior walls, but excluding any space where the
floor-to-ceiling height is less than six feet.
FLOOR AREA, NET
The total of all floor areas of a building, excluding stairwells
and elevator shafts, equipment rooms, interior vehicular parking or
loading, and all floors below the first or ground floor, except when
used or intended to be used for human habitation or service to the
public.
FLOWBACK
The process of flowing a completed/fractured well for the
purposes of recovering water and residual sand from the gas stream
prior to sending gas down a sales line.
FRESHWATER
Any water obtained from a water purveyor or portion of the
generally recognized hydrologic cycle which occupies the pore spaces
and fractures of saturated subsurface materials. Freshwater does not
include exploration and production fluids such as produced water,
flowback fluids, or reuse water.
GARAGE, COMMUNITY
A garage arranged with a common means of access for the use
of occupants of the same or adjacent property, customers, or organization
members.
GARAGE, MUNICIPAL
A structure owned or operated by a municipality and used
primarily for the parking and storing of vehicles owned by the general
public.
GARAGE, PRIVATE
An accessory building or part of a principal building used
only for the storage of private motor vehicles and other personal
effects of the occupants of the principal structure.
GARAGE, REPAIR
Any building, premises, and land in which or upon which a
business, service, or industry involving the maintenance, servicing,
repair or painting of vehicles in conducted or rendered.
GARDEN APARTMENT
A residential building containing between three and 24 apartment
units, not exceeding three stories in height, and including related
off-street parking, open space and recreation.
GRADE
A.
The average elevation of a building.
B.
The percent of rise or descent of a sloping surface.
GRADE, NATURAL
The elevation of the ground level in its natural state before
construction, filling, or excavation.
GRADING
The stripping or excavation of any material and the filling
of any existing ground with natural or man-made material.
GROSS FLOOR AREA (GFA)
The total floor area of all buildings in the project, including
basements, mezzanines, and upper floors.
GROSS LEASABLE AREA (GLA)
The total floor area designed for tenant occupancy and exclusive
use for which the tenant pays rent.
GROUP HOME
A dwelling unit, licensed by the commonwealth, where room
and board is provided to residents who are in need of supervision
and specialized services shall be provided only by a governmental
agency or those properly licensed or certified agents. The facility
shall meet all minimum requirements of the sponsoring agency.
HEALTH SERVICES
Health care facilities, as well as establishments providing
support to the medical profession and patients, such as medical and
dental laboratories, blood banks, oxygen and miscellaneous types of
medical supplies and services.
HOME OCCUPATION
An accessory use of a service character conducted entirely
within a dwelling by the residents thereof, which use is clearly secondary
to the use of the dwelling for living purposes and which does not
change the residential character of the dwelling, and as regulated
by the requirements of this chapter for home occupation.
HOSPITAL
An establishment (including sanitarium) licensed by the commonwealth
for the short-term care of patients suffering from physical or mental
illness, but not including narcotics addition or those found to be
criminally insane, and which may include facilities for major surgery,
and which may be publicly or privately owned.
HOTEL, RESIDENTIAL
An establishment, other than in dwelling units, where lodging
is provided for compensation on a weekly or longer basis, and for
nine or more persons. Unless otherwise specified by district regulations,
residence hotels may serve meals for compensation only to occupants
and their guests.
HOUSE LOTS
A lot created for the provision of a residential dwelling
unit.
HYDRAULIC FRACTURING
The process of injecting water, customized fluids, sand,
steam, gas or other agents into a gas well under pressure to improve
gas recovery.
IMPOUNDMENT
A facility or part of a facility which is a natural topographic
depression, man-made excavation, or diked area formed primarily of
earthen materials, although it may be lined with synthetic materials,
and which is designed to hold an accumulation of liquid wastes or
wastes containing free liquids. The term includes holding, storage,
settling and aeration pits, ponds and lagoons. The term does not include
injection wells.
INDUSTRIAL PARK
A tract of land that is planned, developed and operated as
an integrated facility for a number of individual industrial uses,
which share common signage, driveways, parking areas, points of ingress/egress,
and other common facilities, and which generally share a common architectural
design theme.
JUNKYARD
Any area, lot, land, parcel or structure(s) or part thereof
used for the collection, storage, processing, purchase, sale, salvage,
or disposal of junk, including two or more scrapped, abandoned or
junked motor vehicles, machinery, equipment, inoperable farm equipment,
appliances, scrap metal, wastepaper, glass, rags, containers and other
discarded materials. Refuse or garbage kept in a proper container
for prompt disposal shall not be regarded as a junkyard.
JUNKED VEHICLE
Any vehicle that has been discarded in both maintenance and
in use and title thereto has been relinquished, providing that such
vehicle has been disposed of in a proper and orderly manner suitable
to the Township.
KENNEL
Any household or establishment where more than four dogs
or domesticated animals who are more than six months old are kept,
bred, boarded, trained or bred for profit.
LABORATORY
A place devoted to experimental study in any science or to
the testing and analysis of drugs and chemicals.
LAND DEVELOPMENT
Any of the following activities:
A.
The improvement of one lot or two or more contiguous lots, tracts
or parcels of land for any purpose involving:
(1)
A group of two or more residential or nonresidential buildings,
whether proposed initially or cumulatively, or a single nonresidential
building on a lot or lots regardless of the number of occupants or
tenure; or
(2)
The division or allocation or land or space, whether initially
or cumulatively, between or among two or more existing or prospective
occupants by means of or for the purpose of streets, common areas,
leaseholds, condominiums, building groups or other features.
C.
A land development does not include:
(1)
The conversion of an existing single-family detached dwelling
or single-family semidetached dwelling into not more than three residential
units, unless each such unit is interested to be a condominium;
(2)
The addition of an accessory building, including farm buildings,
on a lot or lots subordinate to an existing principal building; or
(3)
The addition or conversion of buildings or rides within the
confines of an amusement park, with the exclusion of newly acquired
acreage, until development plans have been approved by the proper
authorities.
LAND DEVELOPMENT PLAN
A plan which encompasses a proposed land development, which,
in addition to a plat of subdivision, if required, includes all covenants
relating to the use of the land; the proposed use, location and bulk
of buildings and other structures; the intensity of use or density
of development; streets, ways and parking facilities; common open
space and public facilities. The land development plan shall include
all of the written and graphic information required by this chapter.
LIGHT MANUFACTURING
The assembly, processing or fabrication of certain materials
and products where no process involved will produce noise, vibration,
water pollution, fire hazard or noxious emissions that will disturb
or endanger neighboring properties. Light manufacturing includes but
is not limited to the production of the following goods: home appliances,
electrical instruments, office machines, precision instruments, electronic
devices, timepieces, jewelry, optical goods, musical instruments,
novelties, wood products, printed material, lithographic plates, type
composition, machine tools, dies and gauges, ceramics, apparel, lightweight
nonferrous metal castings, film processing, light sheet metal products,
plastic goods, pharmaceutical goods, food products, not including
animal slaughtering, curing or rendering of fats, and similar activities.

LIGHT MANUFACTURING (HIGH-TECHNOLOGY INDUSTRIES)
The assembly of component parts or the production of finished
products, excluding any process that involves toxic or highly volatile
substances; but may include certain computer parts, electrical parts,
accessories and equipment; laboratory apparatus; robotics; optical
instruments; precision instruments; surgical, medical and dental instruments
and supplies; timers and timepieces; search detection and navigational
equipment; musical instruments; and photographic equipment, accessories
and other similar instruments and equipment. Said use may include
some light manufacturing (not to exceed 50% of the overall floor space),
including but not limited to the processing or fabrication of materials
and products which does not product noise or vibration which has detrimental
effects on adjoining properties, air or water pollution, fire hazards
or other disturbances or danger to other properties.

LANDFILL
A construction/demolition waste landfill or a municipal waste
landfill as defined herein.
LANDFILL, CONSTRUCTION/DEMOLITION WASTE
A facility using land exclusively for the disposal of construction/demotion
waste. The term includes land affected during the lifetime of the
operations, including, but not limited to, areas where disposal activities
actually occur, support facilities, borrow pits, offices, equipment
sheds, air and water pollution control and treatment systems, access
roads, associated on-site or contiguous collection, transportation
and storage facilities, closure and post-closure and maintenance activities
and other activities in which the natural land surface has been disturbed
as a result of or incidental to the operation of the facility.
LANDFILL, MUNICIPAL WASTE
A facilities using land for disposing of municipal waste.
The facilities includes land affected during the lifetime of the operation,
including, but not limited to, areas where disposal or processing
activities actually occur, support facilities, borrow areas, offices,
equipment sheds, air and water pollution control and treatment systems,
access roads, associated on-site and contiguous collection, transportation
and storage facilities, closure and post-closure care and maintenance
activities and other activities in which the natural land surface
has been disturbed as a result of or incidental or operation of the
facility. This term does not include a construction/demolition waste
landfill.
LANDOWNER
The legal or beneficial owner or owners of land, including
the holder of an option or contract to purchase (whether or not such
option or contract is subject to any condition), a lessee, if he is
authorized under the lease to exercise the rights of the landowner,
or other persons having a proprietary interest in land.
LOADING SPACE
A portion of a lot used for the standing, loading, or unloads
of motor vehicles.
LOT
A designed parcel, tract or area of land established by a
plat or otherwise as permitted by law and to be used, developed, or
built upon as a unit. (MPC definition.)
LOT AREA
That area measure on a horizontal plane bounded by the front,
rear and side lot lines, exclusive of any area within a street right-of-way.
LOT COVERAGE
That portion minimum frontage requirements and where access
to the public road is by a narrow private right-of-way or driveway.
LOT COVERAGE
That portion of the lot that is covered by buildings (principal
and accessory). See also "impervious surface coverage."
LOT LINE, FRONT
That line which bounds the lot contiguous with the street
right-of-way line.
LOT LINE, REAR
That line which is generally opposite to the front lot line.
LOT LINE, SIDE
Any lot line which is not a front lot line or a rear lot
line.
LOT OF RECORD
Any lot which, individually or as part of a subdivision,
has been recorded in the office of the Recorder of Deeds of Washington
County.
LOT WIDTH
The horizontal distance between side lot lines measure at
the building setback line. Lot width shall be measure tangent to the
building setback line.
LOT, CORNER
A lot bounded at least two sides by streets; the owner or
developer of a corner lot may specify which street lines shall be
the front lot line and the house must be built facing the front. The
required setback on all sides bounded by a street shall equal the
building setback line of the district in which the corner is situated.
LOT, FLAG
A lot not meeting minimum frontages requirements and where
access to public road is a narrow private right-of-way or driveway.
MANUFACTURED HOME
Manufactured homes refer to single-family dwellings built
off-site in a factory in accordance with the U.S. Department of Housing
and Urban Development's National Manufactured Home Construction and
Safety Standards which went into effect on June 15, 1976. Manufactured
homes are still commonly referred to as "mobile homes" in Pennsylvania,
and are referenced in this text as mobile homes for simplicity purposes.
Manufactured homes are intended for permanent occupancy which has
a minimum floor area of 720 square feet and which is contained in
one unit, or in two or more units designed to be joined into one integral
unit capable of again being separated for repeated towing, which arrives
at a site complete and ready for occupancy except for minor and incidental
unpacking and assembly operations and construed so that it may be
used without a permanent foundation. A manufactured home which is
used without permanent foundation shall be located within a mobile
home park, as defined and regulated herein; however, a manufactured
home which is rendered immobile by permanent placement on a continuous
masonry foundation or at least two concrete footers along the longer
dimension which project at least three feet below finished grade and
which is skirted and tied to its foundation in accordance with the
requirements of the American National Installation of Mobile Requirements
9NFPA No. 501-A1974, ANSI A119.3-1975), as amended, and which is connected
to all available utilities shall be regarded as a single-family dwelling,
as defined and regulated by this chapter.
MEDIATION
A voluntary negotiating process in which parties in a dispute
mutually select a neutral mediator to assist them in jointly exploring
and settling their differences, culminating in a written agreement
which the parties themselves create and consider acceptable.
MID-RISE APARTMENT
A structure containing not less than six and up to 100 units,
not exceeding six habitable stories in height, and often having private
balconies.
MINE DISPOSAL AREAS
Areas used for the deposit of mine waste, preferably in ravines,
valleys, or low-areas and located a minimum distance of 500 feet from
any other lot in a zoning district to minimize their visibility.
MINERAL EXTRACTION
Any extraction of any mineral for sale or other commercial
purpose that involves removal of the surface of the earth or exposure
of the mineral or subsurface of the earth to wind, rain, sun or other
elements of nature. The term "mineral" includes, but is not limited
to, anthracite and bituminous coal, lignite, including mining activities
carried out beneath the surface of the earth by means of shafts, tunnels,
other underground mine openings, limestone and dolomite, sand, gravel,
rock, stone, earth, slag, ore, vermiculite, clay and other mineral
resources.
MOBILE HOME
A transportable, single-family dwelling intended for permanent
occupancy, office or place of assembly contained in one unit, or in
two units designed to be joined into one integral unit, capable of
again being separated for repeated towing, which arrives at the site
complete and ready for occupancy except for minor and incidental unpacking
and assemble operations and constructed so that it may be used without
a permanent foundation. Note: "Mobile home" refers to homes built
prior to June 15, 1976, the date the Federal Manufactured Home Construction
and Safety Standards become effective.
MOBILE HOME LOT
A parcel of land in a mobile home park improved with the
necessary utility connections and other appurtenances necessary for
the erection thereon of a single mobile home. (MPC definition.)
MOBILE HOME PARK
A parcel of land under single ownership which has been planned
and improved for the placement of mobile homes for nontransient use,
consisting of two or more mobile home lots. (MPC definition.)
MODULAR HOUSING UNIT
Similar to a manufactured home with the exception that modular
homes are built in accordance with the state and local codes.
MOTEL/HOTEL
An establishment which provides transient lodging accommodations
to the general public and which may provide such additional supporting
services as restaurants, meeting rooms, recreation facilities and
living quarters for a resident manager or proprietor.
NATURAL GAS LIQUIDS (NGL)
Components of natural gas that are liquid at the surface
of in-field facilities or in processing plants. Natural gas liquids
can be classified according to their vapor pressures as low (condensate),
intermediate (natural gasoline) and high (liquefied petroleum gas)
vapor pressure. Natural gas liquids include ethane, propane, butane,
pentane, hexane and heptanes. The term is commonly abbreviated as
NGL.
NEIGHBORHOOD COMMERCIAL CENTER
A lot or group of lots designed as an integrated facility
to accommodate one or more of the following uses: convenience good
stores, bank, professional offices, personal services, or eating and
drinking establishment, excluding drive-in facilities, which are intended
to serve the needs of the residents of the immediate neighborhoods.
NET LEASABLE FLOOR AREA
The total floor area of a building designed for tenant occupancy,
excluding halls, corridors, sidewalks, elevator shafts, equipment
rooms, rest rooms, interior vehicular parking and loading areas and
other areas used in common by tenants of the building, expressed in
square feet and measured from the center line of joint partitions
and exteriors of outside walls.
NO-IMPACT HOME-BASED BUSINESS
A business or commercial activity administered or conducted
as an accessory use that is clearly secondary to the use of a dwelling
for residential purposes and that involves no customer, client or
patient traffic, whether vehicular or pedestrian, and no pickup, delivery
or removal functions to or from the premises in excess of those normally
associated with residential use.

NONCOMMERCIAL CHICKEN(S)
Female poultry or foul of the Gallus domesticus species for
personal/noncommercial use. This shall not include roosters.

NONCOMMERCIAL DUCK(S)
Any of the various wild or domesticated waterbirds of the
family Anatidae, characteristically having a broad flat bill, short
legs, and webbed feet.

NONCONFORMING LOT
Any lot which does not comply with the applicable area and
bulk provisions of this chapter, or subsequent amendment, which lawfully
existed prior to the enactment of this chapter.
NONCONFORMING SIGN
Any lawful sign which does not conform to the applicable
sign regulations of the district in which it is located, either on
the effective date of this chapter or as a result of subsequent amendments
thereto.
NONCONFORMING STRUCTURES
A structure, or part of a structure, manifestly not designed
to comply with the applicable use or extent of use provisions in this
chapter, or an amendment heretofore or hereafter enacted, where such
use was lawfully in existence prior to the enactment of this chapter
or amendment. Such nonconforming structures include, but are not limited
to, nonconforming signs.
NONCONFORMING USE
Any use, whether of land or structure, which does not comply
with the applicable use provisions in this chapter, or amendment heretofore
or hereafter enacted, where such use was lawfully in existence prior
to the enactment of this chapter or any amendment or prior to the
application of this chapter or amendment to its location by reason
of annexation.
NURSING HOME
An institution licensed by the commonwealth for the long-term
care of patients requiring skilled nursing or intermediate nursing
care, but not including facilities for major surgery or care and treatment
of narcotics addition. May also include facilities to provide personal
care.
OCCUPIED STRUCTURE
Any building, structure, appurtenances to buildings and structures,
land, water or air vehicle, or similar place adapted for overnight
accommodation of persons or occupied by persons for the purpose of
carrying on business or other activity therein. Proof that said structure
is not actually being occupied or used for such purpose is required
in order for the structure to not be considered occupied.
OFF-DUTY/PERSONAL USE COMMERCIAL VEHICLES
Vehicles with the following types of registrations: commercial,
contractor, omnibus, used car dealer and school bus. For the purposes
of this chapter, any vehicle containing advertising matter intending
to promote the interest of any business or any vehicle used in connection
with the business whether or not said vehicle is registered as a commercial
vehicle with the Pennsylvania Division of Motor Vehicles is considered
a commercial vehicle. This shall also include any type of truck/dump
truck and/or trailer used for transporting goods, equipment and/or
passengers for compensation including commodities, merchandise, produce,
freight, animals or passengers for hire. For purposes of this definition,
a connected trailer and commercial vehicle shall count as one vehicle.
Stand-alone trailers shall count individually.
OFFICE BUILDING
A building designed or primarily used for office purposes,
no part of which is used for manufacturing or a dwelling, other than
living quarters for a watchman or custodian.
OIL AND GAS
Crude oil, natural gas, methane gas, coal bed methane gas,
propane, butane and/or any other liquid hydrocarbons, constituents
or similar substances that are produced by drilling an oil or gas
well.
OIL AND GAS DEVELOPMENT
The well site preparation, well site construction, drilling,
hydraulic fracturing and/or site restoration associated with an oil
and/or gas well of any depth; water and other fluid storage, impoundment
located on the same parcel as a well site; and the installment and
use of all associated equipment, including tanks, meters and other
equipment and structures, whether permanent or temporary. This also
includes the site preparation, construction, installment, maintenance
and repair of other equipment and activities associated with the exploration
for and production of oil and gas. This does not include oil and gas
pipelines, compressor stations and natural gas processing plants or
facilities performing the equivalent functions that operate as midstream
facilities that are only authorized consistent with this chapter as
a conditional use.
OIL AND GAS DRILLING
The removal of oil and natural gas resources for sale or
other commercial purposes, including the structures and equipment
necessary to accomplish the removal.
OIL AND GAS PIPELINES
All parts of those physical facilities regulated by federal,
state or local agencies such as PHMSA, the Pennsylvania Department
of Environmental Protection and/or the Federal Energy Regulatory Commission
through which oil and/or natural gas moves in transportation, including
pipe, valves, and other appurtenances attached to pipes, compressor
units, metering stations, regulator stations, delivery stations, holders,
launcher/receiver stations and fabricated assemblies. This shall also
include temporary water pipelines (in place for less than 12 months).
OPEN SPACE
Any parcel or area of land or water essentially unimproved
and set aside, dedicated, designated, or reserved for public or private
use or enjoyment, or for the use and enjoyment of owners, occupants,
and their guests of land adjoining or neighboring such open space.
OPEN SPACE, COMMON
Land within or related to a development, not individually
owned or dedicated for public use, that is designed and intended for
the common use or enjoyment of the residents and their guests for
the development and may include complementary structures and improvements.
OPERATOR
Any person, partnership, company, corporation, and its subcontractors
and agents who has an interest in real estate for the purpose of exploring
or drilling for, producing, developing or transporting oil or gas.
OUTDOOR AMUSEMENT
An enterprise operated for profit by other than a public
entity which is conducted wholly or partly outside an enclosed structure
for the pursuit of sports, recreation and amusement activities, including,
but not limited to, such establishment as drive-in theaters, areas,
stadiums, racetracks, swimming pools, ballfields, parks, tennis courts,
miniature golf courses, golf driving ranges, and similar facilities.
OUTDOOR SALES
A business conducted outdoors, which may be permanent or
temporary in nature. It may include sidewalk displays, restaurants,
carnivals, sales of seasonal fruits and vegetables, art and craft
shows, exhibits, fund-raising activities, parking lot sales, and seasonal
sales, such as Christmas tree lots.
PARKING AREA
A portion of a lot designed for the parking of motor vehicles
in accordance with the requirements of this chapter.
PARKING SPACE
A portion of a parking area designated for the parking of
one motor vehicle in accordance with the requirements of this chapter.
PAVED AREA COVERAGE
The maximum ground area expressed as a percentage of the
total lot area which may be covered with an impervious material for
purposes of parking, loading, driveways, storage areas or like uses.
PERMITTED USE
An authorized use allowed by right which may be granted by
the Zoning Officer upon compliance with the provisions of this chapter.
PERSONAL CARE BOARDING HOME
A facility licensed by the commonwealth located within a
dwelling where room and board is provided to more than three residents
who are not relatives of the operator and who are mobile or semimobile
and require specialized services in such matters as bathing, dressing,
diet and medication prescribed for self-administration for a period
exceeding 24 consecutive hours, but who are not in need of hospitalization
or skilled nursing care or intermediate nursing care.
PERSONAL SERVICES
Any enterprise providing services pertaining to the person,
their apparel, or personal effects commonly carried on or about the
person, including, but not limited to, shoe repair, tailoring, clothes
cleaning, watch repairing, barbershops, beauty parlors and related
activities.
PETS, DOMESTIC
An animal kept for pleasure rather than utility that lives
near or about the habitation of humans.
PHMSA
Pipeline and Hazardous Materials Safety Administration of
the U.S. Department of Transportation that regulates the design and
installation of pipelines.
PLANNED RESIDENTIAL DEVELOPMENT
A site under single ownership and control which is proposed
to be developed as a single entity for a number of dwelling units
or combination of residential and nonresidential uses, the development
plan for which does not correspond in lot size, bulk, type of dwelling,
use, density, lot coverage and required open space to the regulations
established in any one zoning district.
PLANNING CODE
The Pennsylvania Municipalities Planning Code, Act 247 of
1968, as amended.
PLAT
A map, plan or layout of a subdivision or land development
whether preliminary or final. (MPC definition.)
PORCH
A covered or uncovered area normally located at a front,
side or rear door including areas commonly referred to as "patios"
or "stoops."
PORTAL, COAL MINING
Structures and appurtenances facilities utilized for the
access and egress into deep mine operations.
PRINCIPAL BUILDING
The building or buildings on a lot in which the principal
use or uses are conducted.
PRINCIPAL STRUCTURE
The structure or structures in which the principal use or
uses are conducted.
PRINCIPAL USE
The primary or predominant use of any lot or structure.
PRIVATE
Anything not owned by the public including any procedure
or establishment
PROCESSING PLANT
A facility designed and constructed to remove materials such
as ethane, propane, butane, and other constituents or similar substances
from natural gas to allow such natural gas to be of such quality as
is required or appropriate for transmission or distribution to commercial
markets but not including facilities or equipment that is designed
and constructed primarily to remove water, water vapor, oil, or naturally
occurring liquids from the natural gas, including dew point control
facilities. When used in this chapter, the term shall include any
similar facilities performing the equivalent or similar functions.
PROTECTED STRUCTURE
Any (public/private) hospital, school, cemetery, religious
institution or other public building located within 1,000 feet of
an oil and gas development site.
PUBLIC
Owned, operated or controlled by a government agency, federal,
state, county or local.
PUBLIC HEARING
A formal meeting held pursuant to public notice by the Township
Supervisors, or the Planning Commission, intended to inform and obtain
public comment, prior to taking action in accordance with this chapter.
PUBLIC MEETING
A forum held pursuant to notice under the Act of July 3,
1986 (P.L. 388, No. 84), known as the "Sunshine Act."
PUBLIC NOTICE
Notice published once each week for two successive weeks
in a newspaper of general circulation in the Township. Such notice
shall state the time and place of the public hearing and the particular
nature of the matter to be considered at the public hearing. The first
publication shall not be more than 30 days and the second publication
shall not be less than seven days from the date of the public hearing.
PUBLIC SERVICE FACILITIES
A municipal facility designed to serve the public in matter
of protection, maintenance service, and related governmental services.
Such facilities may include police and fire stations and municipal
maintenance buildings.
PUBLIC SERVICE FACILITIES
Leisure-time activities, including but not limited to sports
and entertainment, that are open to the public without restriction,
except for reasonable fees, rules and standards of conduct and use.
PUBLIC UTILITY TRANSMISSION FACILITY
An intermunicipal, intrastate or intrastate transmission
facility operated by a public utility necessary to supply services
to the general public outside of the Township.
REENTRY DRILLING
The act of reentering an approved oil and gas development
to refrack, stimulate, etc., drilled wells and/or to drill additional
wells within the number of wells the site has been approved for. (Example:
John Doe Site approved for eight wells and only four wells have been
drilled. If Operator comes back to drill an additional four, this
shall be considered reentry drilling.)
REENTRY RELATED OPERATIONS
The conduct of any related operations at a Township-approved
site that were not included in a previous approval (permitted or conditional).
REUSE/RESIDUAL WATER (WASTEWATER)
Water which has been previously used for industrial, municipal,
domestic or other purposes including those associated with fracking,
drilling flowback, and other drilling related activities, and cannot
be returned to a surface water or groundwater source.
RECREATION FACILITIES
A place designed and equipped for the conduct of sports and
leisure-time activities.
RECREATIONAL FACILITY, PRIVATE
A recreational facility operated by a nonprofit organization
and open only to bona fide members and guests of such nonprofit organization.
RELATED OPERATIONS
The activities and operations that are ancillary to oil and
gas drilling, such as processing plants, compressor stations, certified
water storage temporary work and bunk trailers, storage depots. traffic
control sites and truck staging areas.
RESIDENTIAL FLOOR AREA
The floor area of each floor in a dwelling including stairways,
halls and closets built but not including basements, porches, garages
or carports.
RESIDUAL WASTE
Nonhazardous industrial waste. It includes waste material
(solid, liquid or gas), impaired fluids and flowback produced by industrial,
mining and agricultural operations. It excludes certain coal mining
wastes and wastes from normal farming activities.
RESTAURANT, FAST SERVICE
An establishment where food and beverages are served for
consumption either on or off the premises and where the primary method
of operation involves the serving of food in edible or disposable
containers.
RETAIL STORES
Business establishments located entirely within an enclosed
building which sell goods, services or merchandise to the general
public for personal, household or office consumption and which shall
not include wholesaling, manufacturing or processing of the goods
offered for sale.
RIDING ACADEMY
Any establishment where horses are kept for riding, driving
or stabling for compensation or incidental to the operation of any
club, association, ranch or similar establishments.
RIGHT-OF-WAY
The total width of land reserved or dedicated for use as
a street, crosswalk or for other public or private purpose.
ROOMING HOUSE
An establishment for from three to eight persons, other than
a motel (hotel), where only lodging is provided for compensation to
anyone who may apply on an extended basis.
ROOSTER
Male poultry or foul.

SCHOOL, (PUBLIC) OR (PRIVATE)
An accredited institution of learning that offers elementary-
and secondary-level instruction or that offers associate, bachelor
or higher degrees in the several branches of learning required by
the Commonwealth of Pennsylvania.

SETBACK
See "building line (setback)."
SHOPPING CENTER
A site under single ownership and control which is developed
as a unit for two or more retail establishments in one or more buildings
and designed so that parking, loading and access facilities are shared.
SIGN
Any device visible from a public place whose essential purpose
and design is to convey either commercial or noncommercial messages
by means of graphic presentation of alphabetic or pictorial symbols
or representations. Noncommercial flags or any flags displayed from
flagpoles or staffs will not be considered to be signs.
SIGN, COMMERCIAL OUTDOOR ADVERTISING SIGN
A permanent off-premises sign erected, maintained or used
in the outdoor environment for the purpose of providing copy area
for commercial or noncommercial messages. See "sign, off-premises."
SIGN, OFF-PREMISES
A sign whose message content may not necessarily bear any
relationship to the activities conducted on the premises on which
it is located, or to the expression of any commercial or noncommercial
speech by the owner or bona fide user of the premises on which it
is located.
SPECIAL EXCEPTION
A use which must be approved by the Zoning Hearing Board
following public hearing to permit the use of lands and/or buildings
in a specific zoning district for purposes other than specifically
allowed as a use by right or conditional use in accordance with the
specific standards established by this chapter for that use.
STABLE
A structure used for the shelter or care of horses and cattle.
STORAGE DEPOT
A permanent off-street facility designed as a point for collection
and/or storage of materials, supplies, equipment, and/or other solid
by-products from oil and gas development.
STORY
That portion of a building included between the surface of
any floor (to include the basement floor) and the surface of the floor
next above it or, if there is no floor above it, then the space between
the floor and the ceiling next above it.
STREET
An existing or platted way for use by vehicular traffic or
pedestrians, whether public or private, which has been graded and
paved, or is to be graded and paved, in order that the general public
has the right to pass and to use it at all times for all purposes
of travel, transportation or parking to which it is adapted, devoted,
and not otherwise restricted.
STREET, ARTERIAL
A public street which serves large volumes of high-speed
and long-distance traffic. Roads classified as arterials in the Township
are Franklin Farms Road Park Avenue (SR 18) Washington and Prosperity
Pike (SR 18) U.S. Route 40 East of I-70. (Source: Exhibit 5, Road

STREET, COLLECTOR
A public street that intercepts local streets and provides
a route for carrying local traffic to arterial roads and community
facilities. A collector street also provides access to abutting lots.
Streets classified as collector roads in the Township are Road Stone
Road Sanitarium Road Scenic Drive U.S. Route 40 West of I-70. (Source:

STRIP MINING
Mining any commercial substance from the earth's surface
by stripping the overburden.
STRUCTURE
Any man-made object having an ascertainable stationary location
on or in land or water, whether or not affixed to the land. (MPC definition.)
SUBDIVISION
The division or redivision of a lot, tract or parcel of land
by any means into two or more lots, tracts, parcels or other divisions
of land including changes in existing lot lines for the purpose, whether
immediate or future, of lease, partition by the court for distribution
to heirs or devisees, transfer of ownership or building or lot development;
provided, however, that the subdivision by lease of land for agricultural
purposes into parcels of more than 10 acres not involving any new
street or easement of access or any residential dwelling shall be

SUBDIVISION PLAT
A map or plan, either preliminary or final, indicating the
subdivision consolidation or redivision of land or a land development.
SUPERVISORS
The Board of Supervisors of the Township of North Franklin,
Washington County, Pennsylvania.
SURFACE AREA OF SIGN
That area enclosed by one continuous line, connecting the
extreme points or edges of a sign. The area shall be determined using
the largest sign area or silhouette visible at any one time from any
one point. This area does not include the main supporting sign structure,
but all other ornamental attachments, inner connecting links, etc.,
which are not part of the main supports of the sign shall be included
in determining the sign area. For signs painted on walls, this will
mean the area of the smallest triangle, rectangle or circle which
can wholly enclose the surface area of the sign. For two sided signs,
only one face is counted in computing the surface area.
SWIMMING POOL
A water-filled enclosure, permanently constructed or portable,
having a depth of more than 18 inches below the level of the surrounding
land, or an above-surface pool, having a depth of more than 30 inches,
designed, used and maintained for swimming and bathing.
TEMPORARY OUTDOOR ACTIVITY
Activities that are carried out primarily out-of-doors for
a fixed period of time, and including flea markets, fireworks, displays,
speeches, farm stands, seasonal sales, swap and shop markets, race
meets, circuses, carnivals, concerts and parades.
TEMPORARY STRUCTURES
A structure without any foundation or footings that is removed
when the designated time period, activity, or use for which the temporary
structure was erected has ceased.
TEMPORARY WATER PIPELINE
A temporary pipeline in place for a period not to exceed
12 months, typically located above ground and used to transport water
to and from various oil and gas development, drilling and related
operations.
THEATER
A building, or part of a building, devoted to the showing
of movies, musical performances, dance, or theatrical production,
usually on a paid admission basis.
THEATER, DRIVE-IN
An open land or part thereof, with its appurtenant facilities,
devoted primarily to the showing of movies or to theatrical productions,
usually on a paid admission basis, to patrons seated in automobiles.
TIPPLES, COAL
Facilities utilized for the processing, loading and storing
of coal.
TOWNSHIP
The Township of North Franklin, Washington County, Pennsylvania.
TRAFFIC CONTROL SITES
An area used as a stopping place or assembly point designed
to accommodate trucks during their course of travel to an oil and
gas development and intended to be used for four months or fewer during
a twelve-month period. This definition does not include the transfer
of loads to, from or between trucks.
TRUCK STAGING AREA
An off-street facility used for the transfer of loads to,
from or between trucks for oil and gas development or a traffic control
site.
TRUCK TERMINAL
A facility to accommodate the service, repair and storage
of trucks and other motorized equipment and trailers, and which may
incidentally provide warehousing activities and transfer facilities.
UNCONVENTIONAL WELL
An unconventional gas well is a well that is drilled into
an unconventional formation, which is defined as a geologic shale
formation below the base of the Elk Sandstone or its geologic equivalent
where natural gas generally cannot be produced except by horizontal
or vertical well bores stimulated by hydraulic fracturing. (Example:
Marcellus, Utica, Mandata, Huron, Rhinestreet, and Upper Devonian.)
USE
The purpose or activity for which land or buildings are designed,
arranged, or intended or for which land or buildings are occupied
or maintained.
USE BY RIGHT
Any use within a given zoning district that is specifically
allowed as a matter of right and is so stipulated by the zoning regulations
governing that district.
USE BY SPECIAL EXCEPTION
An authorized use which may be granted only by the Zoning
Hearing Board pursuant to express standards and criteria prescribed
in this chapter following a public hearing. The Board may attach such
reasonable conditions and safeguards, in addition to those expressed
in the chapter, as it may deem necessary to implement the purposes
of this chapter.
VARIANCE
A departure from the strict letter of this chapter as it
applies to specific properties, as authorized by the Zoning Hearing
Board in accordance with the terms of this chapter and the Pennsylvania
Municipalities Planning Code.
VENTILATING SHAFTS
Structure and appurtenant facilities to permit the introduction
of air, or evacuation of air and other gases, from underground coal
mines, and whether or not there shall be incorporated in said structures
and appurtenant facilities emergency escape facilities for men, and
also whether or not certain of the functions permitted for bore holds
shall also be incorporated.
VETERINARY CLINIC
A place where animals are examined and treated by licensed
veterinarians and which may include kennels for temporary boarding
of animals during treatment.
WELL PRODUCTION PAD
The area of the limits of the surface of the perimeter used
for drilling operations as shown on the site plan.
WELL SITE
The area of surface operations surrounding the surface location
of a well or wells. The site can include facilities, structures, materials,
water containment devices and equipment whether permanent or temporary,
necessary for or incidental to the preparation, construction, drilling,
production or operation of an oil or gas well. Such area shall not
include an access road to the well site.
WIRELESS COMMUNICATION FACILITIES (WCF)
The antennas, support structures and other equipment or apparatus
necessary for providing personal wireless services and information
services.

YARD
A required open space located on a lot which is unobstructed
by any portion of a principal structure other than certain projections
expressly permitted by this chapter.
YARD LINE, FRONT
A front yard line bounds the front yard and is parallel to
the front lot line or structure.
YARD LINE, REAR
A rear yard line bounds the rear yard and is parallel to
the rear lot line.
YARD LINE, SIDE
A side yard line bounds the side yard and is parallel to
the side lot lines.
YARD, FRONT
A front yard is the yard extending along the full length
of the front lot line and being the minimum horizontal distance between
the front lot line (or street right-of-way) and the building setback
line (or the building or any projection thereof, other than the steps).
YARD, SIDE
A space extending from the front building line to the rear
building line between the principal building and the side lot line,
and measured perpendicular from the side lot line to the closest point
of the principal building.
ZONING CERTIFICATE
A certificate issued by the Zoning Officer prior to the use
of any structure or land or the construction, reconstruction, alteration,
enlargement, removal or relocation of any structure which certifies
that the proposed use or construction is in compliance with the requirements
of this chapter for the zoning district in which the proposed use
or construction is located, but which does not include approval of
the structure integrity of the proposed construction or the material
methods of construction proposed.
ZONING HEARING BOARD
The Zoning Hearing Board of North Franklin Township, Washington
County, Pennsylvania.
ZONING MAP
The Zoning District Map adopted by the Township Supervisors,
together with all subsequently adopted amendments.
ZONING OFFICER
The designated official or an authorized representative appointed
by the Supervisors whose duty it shall be to administer this chapter.
