The membership of the Planning Board of the Village of Larchmont shall be decreased from seven members to five members pursuant to New York Village Law § 7-718(7), to take effect upon the next two expirations of terms.
This article shall apply to the appointment, terms, functions and powers of alternate members appointed to serve on the Planning Board in the Village of Larchmont.
This article is adopted for the purpose of providing for the appointment of alternate members of the Village Planning Board. Such alternate members are to serve in the event of membership vacancy, absence, disqualification, resignation, or conflict of interest of any regularly appointed member of the Planning Board. This article is adopted pursuant to New York Municipal Home Rule Law, §§ 10 and 22, intending to modify, enlarge and supersede the provisions of § 7-718 of the Village Law to the extent this article contradicts § 7-718.
As used in this article, the following terms shall have the meanings indicated:
ALTERNATE MEMBER
An individual appointed by the Mayor and approved by the Village Board of Trustees to serve on the Village Planning Board when a regular member will not be participating on an application or matter before the Planning Board for reasons described in § 298-3 above.
MEMBER
An individual appointed by the Mayor and approved by the Village Board of Trustees to serve on the Village Planning Board pursuant to § 7-718 of the Village Law.
PLANNING BOARD or BOARD
The Planning Board of the Village of Larchmont as established by the Village Board of Trustees pursuant to the provisions of § 7-718 of the Village Law.
The Mayor, subject to the approval of the Board of Trustees, is hereby authorized to appoint up to three alternate members to the Planning Board. These individuals may serve when: there is a membership vacancy; regular member(s) are absent; or regular member(s) are unable to participate on an application or matter before the Board because of disqualification, resignation, or conflict of interest.
Upon designation by the Planning Board Chair, alternate members shall sit as members of the Planning Board exercising full power as if they were regular members.
Alternate members of the Planning Board shall serve for a term of three years.
This article is hereby adopted pursuant to the provisions of §§ 10 and 22 of the New York Municipal Home Rule Law. It is the intent of the Village Board of Trustees to supersede the provisions of any existing law relating to the appointment of members to the Village Planning Board to the extent that this article is contrary to § 7-718.
