A. 
For the purpose of protecting the health, welfare and safety of the community and its residents, all outdoor open fires shall be prohibited in the Village, including on beach areas. Any outdoor open fires that comply with the following requirements shall be permitted, provided the property owner demonstrate to the Village compliance with the below requirements:
(1) 
The outdoor open fire is located on a premises containing a single-family dwelling, and is not within 10 feet of the property line and not on a beach area;
(2) 
The outdoor open fire is contained within a commercially manufactured or permanent structure specifically designed for the primary purpose of cooking over flame, charcoals or embers, having a flame not exceeding the top of the structure in which it is contained; or
(3) 
The outdoor open fire is within a contained commercially manufactured or a permanently built structure, for which a building permit and certificate of occupancy have been issued, and is specifically designed for outdoor open fires, such as a firepit or fireplace.
B. 
Outdoor open fires not meeting the above standards and requirements may only be permitted and allowed upon a grant of a special event permit by the Board of Trustees, provided there is a finding by the Village Board that the outdoor open fire will not present a health, welfare or safety concern to the community, Village residents, and neighboring properties.
C. 
A property owner that causes, permits or allows an outdoor open fire to be started or maintained on the owner's property or a beach area not in compliance with the above, or for which a permit has not be issued, shall be deemed in violation of this chapter. A property owner shall be fully responsible and liable under this chapter for the actions of guests and invitees. A first violation of this chapter shall subject the property owner to a fine of $500. For every additional violation within a one-year period the fine shall be $1,000.
