The purpose of this chapter is to promote the serenity of public parks and recreational and gathering areas in the Village, ensure a healthier and cleaner experience for Village residents and visitors, and promote and protect the health, safety and welfare within the Village of Sea Cliff, by prohibiting smoking in certain public areas.
SMOKE
The act of smoking.
SMOKE-FREE AREA
Location where smoking is prohibited.
SMOKING
Burning of a lighted cigar, cigarette, pipe, bong, hookah, any matter or substance that contains cannabis or tobacco, and any matter, substance or electronic smoking device that creates an aerosol or vapor.
A. 
The following areas, owned by, or under the control of, the Village, are hereby designated as smoke-free areas: Village-owned property, including, but not limited to, buildings, structures, parks, playgrounds, pavilions, beach, parking lots, sidewalks, boardwalks, and any other Village-owned open spaces or recreational areas.
B. 
Smoking is prohibited in all smoke-free areas.
A. 
Any person who violates any provision of this chapter shall, upon conviction, be guilty of a violation which shall be punishable by a fine of not less than $50 and not more than $500, unless the penalty sum is pre-empted by the provisions of the New York State Penal Law, Public Health Law or Marihuana Regulation and Taxation Act, in which case the penalty shall be as provided therein.
B. 
In addition to any other penalty provided by law, the Village Clerk may revoke any and all Village-issued beach permits held by an individual in violation of this chapter, and an individual in violation of this chapter may be removed from, and refused admission, to any area identified in § 108-3A.
