The Township hereby establishes a separate and distinct sewer district to be known as the Piatt Off-Site Sewer District, which is defined and described in the plan and specifications Nichols & Slagle Engineering, Inc., Consulting Engineers, Piatt Off-Site Sewer District Reimbursement Tapping Fee Report dated October 2014. The description of said Piatt Off-Site Sewer District is attached to the Nichols & Slagle report. A copy of said description is attached hereto and made a part hereof and marked Exhibit "A."[1]

The following schedule of sewage service rates for the Piatt Off-Site Sewer District be, and hereby is, adopted by the Township; provided, however, that no charges shall be made and billed until complete sewage and collection service is being rendered all charges and tap fee are subject to change:
A. 
Sewage treatment per thousand gallons used: gallons as set by Canonsburg-Houston Joint Authority.
B. 
Chartiers Township tap fee: $1,500 per EDU, subject to change by the Chartiers Township Board of Supervisors.
C. 
Canonsburg-Houston Joint Authority tap fee: $1,600 per EDU, subject to change by the Canonsburg-Houston Joint Authority.
The sewage service rates imposed by § 272-281 hereof shall become effective upon adoption of this article.
Out of the Township tap fee, the amount of $500 per tap fee paid for connection to the Piatt Off-Site Sewer District shall be paid to Piatt Estates Chartiers, L.L.P. for a period of 10 years from the date of the adoption of this article. Five percent of the reimbursement or $25 per tap will be retained by Chartiers Township for administrative expenses. There is no reimbursement from tap fees paid for taps in the Piatt Estates Plan. The maximum amount of reimbursement is $290,000.
Bills for said sewer service shall be rendered by and in the manner and in the form prescribed by the Township or its designated agent. All bills for sewer service shall be rendered to the owner of the premises to which sewer service is furnished, and such owner shall in all cases be liable for payment of such bills.
The Board of Supervisors of the Township, or its designated agent shall have charge and management of the Piatt Off-Site Sewer District and shall issue such rules and regulation governing the use, operation and maintenance of said sewer system as they shall deem necessary, and which may be those governing the other sewer systems in the Township.
The Township, or its designated agent shall collect and receive all sewer rates and charges prescribed by this article. All such money shall be deposited to the credit of a special fund designated the Chartiers Township Sanitary Sewer Fund, which shall at all times be a separate and distinct fund of the Township.
Sewer charges imposed pursuant to this article shall be due and payable immediately upon receipt by the owner or the tenant. The net bill is due and payable within 20 days following the date of billing. The penalty for late payment of said bills shall be 10% if the sewer charge is not paid within 20 days following the date of the billing, plus costs and legal interest.
A copy of the rules and regulations governing the imposition of charges and the use of the Piatt Off-Site Sewer District shall be filed with the Township Manager and made available for inspection by the public.
In accordance with Township ordinances and the Second Class Township Code[1] connection to the said sanitary sewer must be within 60 days of receipt of a Notice to Connect from Chartiers Township.

All adjoining and adjacent property owners to the sewer lines constructed for the Piatt Off-Site Sewer District are required to connect with and use the said sanitary sewer system.
All adjoining and adjacent property owners are subject to the charges, costs and fees set forth herein upon connection to the sewer system or within 60 days of notice to connect whether such required connection is completed.
If any owner of property adjoining or adjacent to or whose principal building is within 150 feet from the sanitary sewer fails to connect for a period of 60 days after notice to do so has been served by the Board of Supervisors, either by personal service or by registered mail, the Board of Supervisors or their agents may enter the property and construct the connection and assess the costs against the property as provided by law.
All ordinances, resolutions and regulations or parts of all ordinances, resolutions and regulations in conflict with this article are hereby repealed.
Invalidity of any section, clause, sentence or provision in this article shall not affect the validity of any other section, clause, sentence or provision of this article which can be given effect without such invalid part of parts.
The Township of Chartiers, through its duly qualified officers, reserves the right to amend this article in part or in whole in accordance with the law whenever it may deem necessary.
This article shall take effect upon adoption.
