For purposes of this article, the following phrases and words shall have the meanings indicated:
ELECTRIC VEHICLE
A vehicle that is licensed and registered for operation on public and private highways, roads, and streets; and operates, either partially or exclusively, on electrical energy from a charging station or other electric energy source that is stored in the vehicle's battery for propulsion purposes. "Electric vehicle" includes a battery electric vehicle; a plug-in hybrid electric vehicle; a neighborhood electric vehicle; and electric scooters or electric motorcycles.
ELECTRIC VEHICLE SUPPLY/SERVICE EQUIPMENT or (EVSE)
The equipment, including the cables, cords, conductors, connectors, couplers, enclosures, attachment plugs, power outlets, power electronics, transformer, switchgear, switches and controls, network interfaces, point of sale equipment, and associated apparatus designed and used for the purpose of transferring energy from the electric supply system to a plug-in electric vehicle. "EVSE" may deliver either alternating current or, consistent with fast charging equipment standards, direct current electricity. "EVSE" is synonymous with "electric vehicle charging station."
The Township may designate parking spaces for use as electric vehicle charging stations. Use of said charging station spaces shall be limited and restricted in accordance with the following:
A. 
It shall be unlawful for any person to park or leave standing a vehicle, including an electric vehicle subject to the requirements of the article, in a designated EVSE parking space unless the vehicle is an electric vehicle and is connected for electric charging purposes. Only one electric vehicle shall occupy any space designated as an electric vehicle charging space or EVSE, and no person shall park except within the boundaries of the defined space.
B. 
Nonelectric vehicles are prohibited from parking in any designated EVSE parking spaces.
C. 
Electric vehicles are only authorized to park in designated EVSE parking spaces during the time that a vehicle is connected for electric charging purposes, up to a maximum of four hours. When a vehicle is no longer charging, the owner or operator of said vehicle shall be required to remove the vehicle from the designated EVSE parking space.
No more than 10% of the total parking spaces available at a parking facility, lot or area owned and operated by the Township shall be designated for electric vehicle charging.
The fee to use a designated electric charging station parking space within the Township shall be within the range of $1.50 per hour to $50 an hour. Upon the adoption of this article, the initial fee shall be established at $2 per hour for first two hours of charging, and $5 an hour thereafter, up to the maximum of four hours referenced in § 325-8(3) above. The fees set forth herein may be changed or increased by Council by way of adoption of a resolution.
This article shall be enforced by the Zoning Officer and/or Police Department.
Unless otherwise provided by law, statute or ordinance, any person(s), entity or organization charged with violating any of the provisions of this article shall, upon conviction thereof, be subject to the provisions of Chapter 1, Article II, Penalty of the Township Code.
