As used in this article, the following terms shall have the meanings indicated:
PUBLIC AREA OF THE VILLAGE
A. 
Public roadways, streets and sidewalks;
B. 
Public rights-of-way and grassy areas adjacent to a public roadway, street or sidewalk;
C. 
The area between a curbline or lateral line of a roadway and the adjacent private property line; and
D. 
A garage, driveway, yard, parking lot or other property owned or leased by the Village.
PERSON
An individual, association, group or legal entity such as a corporation, partnership or limited-liability company.
COMBUSTIBLE MATERIAL
Material that, in the form in which it is used and under the conditions anticipated, will ignite, burn, support combustion or release flammable vapors when subjected to fire or heat.
No person may engage in any of the following activities or conduct in a public area of the Village:
A. 
Block free movement of another person;
B. 
Create any unreasonable noise;
C. 
Drink any alcoholic beverage or possess any opened or unsealed container of alcoholic beverage;
D. 
Consume any prohibited controlled substance;
E. 
Urinate, defecate or expectorate;
F. 
Endanger the safety of others, engage in fighting, assaulting another person or threatening another person with such conduct;
G. 
Enter or attempt to enter any area which is locked or otherwise restricted from public access by any means;
H. 
Leave or cause to be left any vehicle, cart, wagon, box, barrel bale or other movable property either owned by said person or in the custody, control or possession of said person;
I. 
Operate any motorized vehicle, excluding a wheelchair, except as authorized by the NYS Vehicle and Traffic Law or by Chapter 83 of the Village Code;
J. 
Operate any bicycle, skateboard, skates or wheeled device except as authorized by Chapter 83 of the Village Code;
K. 
Install or maintain any equipment or material intended to be used for play;
L. 
Leave or deposit, or cause to be left or deposited, any material intended for excavation or construction, except as otherwise authorized by this chapter;
M. 
Leave or deposit, or cause to be left or deposited, any combustible material;
N. 
Place or maintain, or cause to be placed or maintained, any shed or booth except as otherwise authorized by this chapter;
O. 
Install, maintain or use, or cause to be installed, maintained or used, any equipment or material which poses an increased risk of fire, including, but not limited to, barbecues and grills (however powered); open or protected fires; fire pits; flame heaters; and fireworks;
P. 
Encumber, obstruct or obstruct any public area in such manner as to hinder, impede, delay or interfere with the free flow of pedestrian or vehicular traffic;
Q. 
Litter, or place, drop or throw any glass, nail or other destructive matter;
R. 
Vandalize, injure, remove, destroy or deface any property owned or under the control of the Village;
S. 
Engage in ballplaying or other sports;
T. 
Lead, ride or drive any horse, livestock or animal other than a leashed dog or cat;
U. 
Post, place or hang, or cause to be posted, placed or hung, any commercial placard, poster, billboard or sign;
V. 
Engage in any commercial activities except as otherwise authorized by this chapter;
W. 
Install, maintain, or cause to be installed or maintained any bollards or barriers; and
X. 
Install, maintain, or cause to be installed or maintained, any tables or chairs for the purpose of serving customers in a food-service establishment unless authorized by the Village Superintendent of Building in accordance with guidelines adopted by the Village Board of Trustees.
The Village Board of Trustees, after written application and a public hearing, may issue a special permit authorizing activities otherwise prohibited herein, and may establish such conditions as it deems necessary and appropriate for the conduct of such activity, including, but not limited to, security, insurance and cleanup. The fee for such a permit application shall be $250, which may hereinafter be modified by resolution.
The provisions of this article shall not apply to the described activities when conducted by a Village employee or agent who has been authorized by the Village Board.
Any person who violates any provision of this article shall be subject to a fine up to the following amounts, plus imprisonment for a period not exceeding 15 days: first violation – $250; second violation within a twelve-month period – $350; third and additional violations within a twelve-month period – $500.
