The Colchester Fire and Emergency Medical Services is hereby established pursuant to Section 7-301 of the Connecticut General Statutes. The Colchester Fire and Emergency Medical Services shall be responsible for the protection of life and property in the Town from fire and other casualties, and for the enforcement of the laws, ordinances and regulations relating to fire prevention and fire safety. The Fire Chief shall make and enforce the rules and regulations for the conduct and duties of emergency personnel. The Colchester Fire and Emergency Medical Services is authorized to purchase supplies and equipment necessary for its operation. The Board of Selectmen shall neither appoint nor dismiss Town employees associated with fire protection services except as recommended by the Fire Chief.
The Board of Selectmen shall appoint the Fire Chief of the Colchester Fire and Emergency Medical Services in accordance with the Town Charter and the General Statutes. The Board of Selectmen may remove the Fire Chief for cause shown, subject to the applicable provisions of the Town Charter and Section 7-302 of the Connecticut General Statutes.
Upon the recommendation of the Fire Chief, the Board of Selectmen may enter into an agreement with any volunteer fire company or companies within the Town for assistance with fire prevention and fire safety, providing emergency medical services or other emergency services. Any agreement shall include, but not be limited to, conditions pertaining to financial assistance and the observance of Town regulations relating to fire prevention and fire safety.
A. 
Upon the recommendation of the Fire Chief of the Colchester Fire and Emergency Medical Services, the Board of Selectmen, in accordance with Section 29-297 of the Connecticut General Statues, shall appoint a local Fire Marshal and such Deputy Fire Marshals as may be necessary. In making such appointments, preference shall be given to a member of the regular or volunteer fire department of the Town. Each local Fire Marshal shall be sworn to the faithful performance of his or her duties by the Town Clerk and shall continue to serve in that office until removed for cause. Such Town Clerk shall record his or her acceptance of the position of local Fire Marshal and shall report the same in writing to the State Fire Marshal within 10 days thereafter, giving the name and address of the local Fire Marshal and stating the limits of the territory in which the local Fire Marshal is to serve.
B. 
Upon the recommendation of the Fire Chief of the Colchester Fire and Emergency Medical Services, the Board of Selectmen may, upon the death, disability, dismissal, retirement or revocation of certification of the local Fire Marshal, and in the absence of an existing Deputy Fire Marshal, appoint a person who holds a Fire Marshal certification issued pursuant to Section 29-298 of the Connecticut General Statues as the Acting Fire Marshal for a period not to exceed 180 days.
