The following words, terms, and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
AUTHORIZED LITTER RECEPTACLE
Means a litter storage and collection receptacle.
GARBAGE
Means decomposable animal and vegetable wastes, including but not limited to wastes that result from the handling, preparation, cooking and consumption of food.
LITTER
Means garbage, refuse and rubbish, as defined in this section, and all other waste material which, if thrown or deposited as prohibited in this article, tends to create a danger to public health, safety and welfare.
PARK
Means a park, reservation, playground, beach, recreation center or any other public area in the city, owned or used by the city, and devoted to active or passive recreation.
PRIVATE PREMISES
Means any dwelling, house, building or other structure designed or used either wholly or in part for private residential purposes, whether inhabited or temporarily or continuously uninhabited or vacant, including any yard, grounds, walk, driveway, porch or steps belonging or appurtenant to such dwelling, house, building or other structure.
PUBLIC PLACE
Means any street, sidewalk, boulevard, alley or other public way and any public park, square, space, grounds or building.
RAT OR VERMIN HARBORAGE
Means any material, substance, food, trash, debris or other objects that support rats or other vermin.
REFUSE
Means all decomposable and nondecomposable solid wastes, except body wastes, including garbage, rubbish, ashes, street cleanings, abandoned automobiles and solid market and industrial wastes.
RUBBISH
Means all nonputrescible solid waste, excluding ashes, consisting of both combustible wastes such as paper, cardboard, plastic containers, yard clippings, wood and noncombustible wastes such as tin cans, glass and crockery.
VEHICLE
Means every device in, upon or by which any person or property is or may be transported or drawn upon a highway, including devices used exclusively upon stationary rails or tracks.
A. 
Disposal, placement, discard, and/or deposit of litter, garbage, and/or refuse other than in an authorized litter receptacle creates a danger to the public health, safety, and welfare and impairs the environment of the people of the town and wildlife.
B. 
No person shall throw, drop, deposit, discard, or otherwise dispose of litter, garbage, or refuse upon any roadway, public place, park, or upon private property in the Town not owned or occupied by him or her, or at the beachfront, waters of any beachfront, pond or lake, in the Town, except into an authorized litter receptacle in a manner that the litter will be prevented from being carried away by the elements.
A. 
Fines:
(1) 
A first violation would be punishable by a $125 fine, plus court costs.
(2) 
A second violation would be punishable by a $250 fine, plus court costs.
(3) 
A third violation would be punishable by a $500 fine, plus court costs.
B. 
Violators shall be prosecuted by the Chief of Police of the Town of Charlestown or his/her designee by issuance of a summons in the Charlestown Municipal Court.
