By the adoption of this chapter, the Town Board of the Town of Sullivan declares its intent in doing so to be to regulate and control, in a manner consistent with the interest of the citizens of the Town of Sullivan, the dumping, storage and disposal of rubbish and garbage within the Town of Sullivan. Said Board hereby declares that such activities can constitute a hazard to property and persons, and be a public nuisance. Such materials may be highly inflammable and sometimes explosive. Such matter may also contain acid or various poisons harmful or potentially harmful to humans. Such materials frequently contains sharp metal or glass edges or points upon which a human could receive serious cuts and abrasions. The presence of rubbish and garbage may also attract rats and other vermin and be a health hazard. The presence of such materials even in areas zoned for business or industry is unsightly and tend to detract from the value of surrounding land of said property.
As used in this chapter, the following terms shall have the meanings indicated:
GARBAGE
Includes all waste food, papers, dead animals or parts thereof, ashes, offal, vegetables, dross, cinders, shells, straw, shavings, and all waste material which shall be inflammable or capable of fermentation or decay.
PERSON
Includes an individual, society, club, firm, partnership, corporation or association of persons and the singular number shall include the plural.
RUBBISH
Includes waste metal, tin cans, ashes, cinders, glass, pottery, fabric, paper, remains of destroyed or substantially destroyed buildings or other structures, auto parts and all discarded substances of a solid or combustible nature.
This chapter shall apply to garbage or rubbish on all lands, private or public, within the Town of Sullivan.
No person shall throw, cast, lay, bury or leave or direct, suffer or permit any servant, agent or employee to throw, cast, lay, bury or leave any rubbish or garbage of an amount in excess in bulk of two cubic yards on any lands in the Town of Sullivan except at the Madison County Landfill Transfer Station designated for that purpose or except in fully covered containers and then only so long as the contents of said covered containers are removed every 10 days or at shorter intervals.

Nothing herein contained shall prevent a person from burying an animal on his or her own land.
B. 
Nothing herein contained shall prohibit the carrying on of normal and proper agricultural procedures, and storing and maintaining of agricultural products.
A. 
Any person who commits or permits any acts in violation of any of the provisions of this chapter shall be guilty of an offense and, upon conviction, shall be subject to a fine of no more than $250 per day for every day the offense occurs or by imprisonment for a period not to exceed 15 days, or both.[1]

B. 
In addition to the above-provided penalties and punishment, the Board may also maintain an action or proceeding in the name of the Town in a court of competent jurisdiction to compel compliance with or restrain by injunction the violation of such law.
