It is the purpose of this article to comply with the mandatory statewide recycling program (P.L. 1987, c. 102) and the Clean Communities and Recycling Act, N.J.S.A. 13:1E-92.
As used in this article, the following terms have the meanings indicated:
ALUMINUM
Recyclable aluminum cans.
ALUMINUM CANS (MUNICIPAL/COMMERCIAL)
Beverage containers made of a lightweight, silver-white, metallic element.

CONSTRUCTION AND DEMOLITION DEBRIS ("CD") (COMMERCIAL)
Source-separated nonputrescible recyclable material generated from the construction, alteration, repair, maintenance and/or demolition of structures within Bergen County. This material shall include concrete, bricks, block, ferrous and nonferrous scrap, asphalt, asphalt shingles, recyclable wood scrap and any and all other material generated from the construction, alteration, repair, maintenance and/or demolition of a structure or structures within Bergen County that a municipality may deem recyclable.

CORRUGATED CARDBOARD (COMMERCIAL)
Structural material shaped in parallel furrows and ridges for rigidity, used to make packing and shipping containers.

DESIGNATED RECYCLABLE MATERIALS
Those recyclable materials, including metal, glass, paper or plastic containers, food and waste, corrugated and other cardboard, newspaper, magazines.
DISPOSITION or DISPOSITION OF DESIGNATED RECYCLABLE MATERIALS
The transportation, placement, reuse, sale, donation, transfer or temporary storage for a period not exceeding six (6) months of designated recyclable material for all possible uses except for disposal of solid waste.
DWELLING UNIT
Includes a one-family home and a two-family home.
FERROUS SCRAP (MUNICIPAL/COMMERCIAL)
All metal scrap containing steel and/or cast iron.

GLASS
All products made from silica or sand, soda ash and limestone, which are transparent or translucent and used for packaging or bottling of various matter and all other materials commonly known as "glass," excluding, however, blue and flat glass commonly known as "window glass."
GLASS BEVERAGE CONTAINERS (MUNICIPAL/COMMERCIAL)
All containers made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling of various matter and all other material commonly known as "glass," excluding, however, blue glass, plate glass commonly known as "window glass."

GRASS (MUNICIPAL)
Green herbage sending up spike-like shoots or blades.

HIGH-GRADE PAPER (COMMERCIAL)
White typing and ledger paper, white note pad paper, copier paper, carbonless computer printout, manila tab cards and file folders.

LEAVES
Includes vegetable matter commonly known as "leaves" but shall not include grass clippings, brush or other growing matter.

LEAVES (MUNICIPAL)
Those materials naturally formed from trees and bushes that are suitable for composting and mulching purposes.

MAGAZINES
Includes all magazines or periodicals printed on glossing stock or paper of heavier quality than that commonly recognized as newsprint.
MIXED PAPER (COMMERCIAL)
Source-separated mixture of all types of paper, including but not limited to, corrugated, high-grade paper, newspaper, magazines, telephone directories, wrapping paper, box board, books, grocery bags and junk mail.

MUNICIPAL SOLID WASTE STREAM
All residential and commercial solid waste generated within the boundaries of the township as measured in tons.
NEWSPAPER (MUNICIPAL)
Paper of the type commonly referred to as "newsprint" and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest. Magazines and periodicals as well as all other paper products of any nature are not considered "newspaper."

PAPER
Includes all newspaper, high-grade office paper, fine paper, bond paper, offset paper, xerographic paper, mimeo paper, duplicator paper and related types of cellulosic material containing not more than 10% by weight or volume of noncellulosic materials, such as laminate, binders, coatings or saturants.
PAPER PRODUCT
Any paper items or commodities, included but not limited to paper, napkins, towels, corrugated and other cardboard, construction material, toilet tissue, paper and related types of cellulosic materials containing not more than 10% by weight or volume of noncellulosic materials, such as laminates, binders, coatings or saturants.
PLASTIC CONTAINER
A container hermetically sealed or made airtight with a metal or plastic cap and with a minimum wall thickness of not less than 0.010 inch, and composed of thermoplastic synthetic polymeric material.
RECYCLABLE MATERIAL
Those materials which would otherwise become municipal solid waste, which may be collected, separated or processed and returned to the economic mainstream in the form of raw materials or products.
RECYCLABLE PAPERS
Paper having total weight consisting of not less than 50% secondary waste paper material.
RECYCLED PAPER PRODUCT
Any paper products consisting of not less than 50% secondary waste paper material.
RECYCLING
Any process by which materials which would otherwise become solid waste are collected, separated or processed and returned to the economic mainstream in the form of raw materials or products.
RECYCLING CENTER
Any facility designed and operated solely for receiving, storing, processing and transferring source-separated nonputrescible or source-separated commingled nonputrescible metal, glass, paper, plastic containers, corrugated and other cardboard or other recyclable material approved by the Department of Environmental Protection.
RECYCLING SERVICES
The services provided by persons engaged in the business of recycling, including the collection, processing, storage, purchase, sale or disposition, or any combination thereof, of recyclable material.
REGULATIONS
Includes such rules, implementation dates, schedules of time and such other requirements promulgated by the Director of the Department of Solid Waste and approved by the Township Committee as may be necessary to carry out the purposes and objectives of this Article.
SOURCE-SEPARATED RECYCLABLE MATERIALS
Recyclable materials, including but not limited to paper, metal, glass, noncommingled food waste, office paper and plastic which are kept separate and apart from residential, commercial and institutional solid waste by the generator thereof for the purposes of collection, disposition and recycling.

TIN CANS (FERROUS CONTAINERS) (MUNICIPAL)
Cans made of steel or tin. The most common are tin-plated steel cans which contain food.

A. 
On or after the effective date of this article, it shall be mandatory for all persons who are owners, lessees and occupants of residential property in the Township of South Hackensack to separate the recyclable materials designated in § 186-6 above from all other solid waste.
B. 
From October 1 to December 31 of each year, the owner, lessee or occupant of every property within the Township of South Hackensack shall separate leaves from solid waste generated at that property. Leaves shall be placed into large plastic bags, securely tied and placed at curbside no later than 7:30 a.m. on designated pickup days.

Newspapers shall be separated and secured in bundles not to exceed 12 inches in height. Such bundles shall not be contained in plastic bags.

D. 
Aluminum shall be separated and secured in suitable and reusable containers supplied by the owner, lessee or occupant.
E. 
Glass shall be separated and secured in suitable and reusable containers supplied by the owner, lessee or occupant.
F. 
Corrugated cardboard shall be secured in bundles not to exceed 12 inches in height. Such bundles shall not be contained in plastic bags.
The Director of the Department of Solid Waste Management shall promulgate reasonable regulations establishing the commencement dates for mandatory separation of recyclables and the manner, dates and times of the collection of same in accordance with the terms of this article. Any such regulations promulgated by the Director of the Department of Solid Waste Management shall be approved by the Township Committee and may be changed, modified, repealed or amended in whole or in part by majority vote of the Township Committee. A copy of such regulations promulgated by the Director of the Department of Solid Waste Management, as provided, modified or amended, shall be available for public inspection at the office of the Township Clerk during regular business hours.
The Recycling Coordinator may be authorized, from time to time by bid or by contract approved by the Township Committee, to sell and deliver recyclable material so collected in order to obtain the best possible price.
Nothing in this article shall be deemed to prohibit any owner, lessee or occupant from disposing of recyclable materials privately through a sale or gift, provided that in no event shall such recyclable materials be left at the curb for any private pickup, and further provided that in no event shall any such recyclable materials be disposed of as part of the solid waste pickup by the Township of South Hackensack in accordance with the normal pickup by the Township of South Hackensack.
From the time recyclable materials are placed at the curb by the owner, lessee or occupant for collection by the Township of South Hackensack, such recyclable materials shall become the property of the township. It shall be a violation of this article for any person unauthorized to collect or pick up or cause to be collected or picked up any such recyclable materials for any purpose whatsoever once the same has been placed at the curb. Any and each such collection in violation hereof from one (1) or more premises shall constitute a separate and distinct offense punishable as hereinafter provided.
The Recycling Coordinator shall annually submit a recycling tonnage report to the New Jersey Office of Recycling.
A. 
The Recycling Coordinator shall, no later than December 6, 1987, notify all persons owning, leasing or occupying property within the Township of South Hackensack of the township's recycling opportunities and the source separation requirements of this article. This notice shall be done by posting a notice in public places where public notices are customarily posted by the township and by a mailing to all residential taxpayers.
B. 
Every six months after the initial notification, the Recycling Coordinator shall notify all persons occupying residential and commercial premises within the township of South Hackensack of the source-separation requirements of this article. Said notifications shall be done by posting a notice in public places where public notices are customarily posted by the township.
This article shall be referred to the Planning Board of the Township of South Hackensack for a revision of the Master Plan in accordance with N.J.S.A. 13:1E-99.16(c). The Planning Board shall also make recommendations to the Township Committee for the amendments to Chapter 208, Zoning, and Chapter 192, Subdivision of Land, in accordance with this section.
The Department of Public Works Superintendent or his or her designated assistant or the Recycling Coordinator are hereby authorized and directed to enforce this article.

Any person, firm or corporation violating the provisions of this article shall be liable to the maximum penalty at the discretion of the Judge of the Municipal Court of the Township of South Hackensack of a fine not exceeding $1,000, imprisonment for a term not exceeding 90 days, a period of community service not exceeding 90 days, or any combination thereof.

A. 
Effective May 1, 1989, it shall be mandatory for all owners, lessees and occupants of business and/or commercial and industrial properties, to separate the recyclable materials set forth in Subsection B below which are produced by such business and/or commercial and industrial properties for private collection/deposit and the ultimate recycling of said material.
B. 
The following are identified as mandatory recyclable materials for commercial and industrial and/or business properties:
(1) 
Automotive waste oil.
(2) 
Corrugated cardboard.
(3) 
Glass.
(4) 
Ferrous metals (white metals).
(5) 
Food waste.
(6) 
High-grade office paper.
(7) 
Aluminum.
(8) 
Newspapers.
(9)

C. 
All recyclable material set forth in Subsection B shall be separated and disposed of by private scavenger. If the commercial business or industrial user is either unable or unwilling to secure a market and collector for designated mandatory recyclable materials, the Township of South Hackensack, through its Recycling Coordinator, shall secure such markets if required by law and enter into contracts on behalf of the commercial business or industrial user for the collection and disposal of designated recyclable materials; provided, however, that the commercial business or industrial user shall be responsible for any and all expenses associated with said contract.
D. 
It shall be the responsibility of all owners, lessees and occupants of business and/or commercial properties and industrial properties to register annually with the Municipal Recycling Coordinator on forms provided by the township. The annual registration must be filed with the Recycling Coordinator on or before January 10 of each year. New businesses and/or commercial properties and industrial properties must file within 45 days of the issuance of a certificate of occupancy.
E. 
It shall be the responsibility of owners, lessees and occupants of business and/or commercial properties and industrial properties to report semiannually to the Recycling Coordinator on or before March 1 for the proceeding six-month period of July 1 through December 31, and on or before September 1 for the proceeding six-month period of January 1 through June 30. The report, which shall be on forms prescribed and provided by the Recycling Coordinator, shall include the quantities of materials recycled.
F. 
Exemptions. Exemptions from the mandatory municipal recycling program may be requested by any owner, lessee or occupant of business and/or commercial properties or industrial properties. The request shall be made to the Recycling Coordinator in writing on a form prescribed by the Recycling Coordinator. The Recycling Coordinator shall grant the exemption provided for herein, provided that the applicant for exemption can demonstrate that solid waste generated at the applicant's property is being transferred to a private scavenger who is source-separating materials and reporting to the Recycling Coordinator as provided by this article.
