No human body shall be buried within the territorial limits of the Township of South Hackensack except in a cemetery or burying ground duly constituted as such under the laws of the State of New Jersey and for which said cemetery or burying ground a permit for such purpose shall have heretofore been obtained from the governing body of the Township of South Hackensack and the Board of Health thereof.
No human body shall be buried or disinterred in any such cemetery or burying ground except and unless there shall be a full compliance in every respect in relation thereto with all the statutes of the State of New Jersey, the rules and regulations of the State Board of Health and any and all rules and regulations promulgated by this Board. The language of this section shall be construed to apply to any statute, rule and regulation of the State Board of Health or of this Board adopted in the future.
It shall be the duty of the Secretary of this Board from time to time to make an inspection of any and all cemeteries and burying grounds within the Township of South Hackensack and ascertain and determine whether the terms and provisions of this chapter are in all respects being complied with and, in the event of any violation, to make such complaint as may be proper or to take such other action as may be appropriate in relation thereto.
No grave for the burial and disinterment of a human body shall be opened in any cemetery or burying ground in the Township of South Hackensack without a permit so to do first being obtained from this Board. Such permit shall be issued by the Secretary of this Board upon application, and the Secretary shall be entitled to charge and receive a permit fee of two dollars ($2.) for each and every grave opened or to be opened; provided, however, that such permit and payment of such burial fee shall not be required as to any grave located in that portion or area of any cemetery or burying ground the consent for the operation of which said portion or area was granted by the governing body of the Township of South Hackensack prior to January 1, 1936.
The Secretary of this Board shall keep full and complete records in respect to any and all burials and disinterments and the opening of any and all graves in any cemetery or burying ground within the Township of South Hackensack and shall, at least once a month, make a report in respect thereto to the Township Committee of the Township of South Hackensack and at such time remit and turn over to the said Township Committee any and all burial fees received for burial permits issued by him or her in accordance with § 220-4 hereof, which said burial fees shall be and constitute the funds of the Township of South Hackensack, to be appropriated and disbursed as other Township funds may be.
Any person, corporation or other organization operating any cemetery or burying ground within the Township of South Hackensack shall, within 60 days after the passage of this chapter, file with the Secretary of this Board a map or plan showing by number or other designation or description the location of any and all graves according to the existing layout of said cemetery or burying ground, and shall appropriately indicate on said map or plan which of said graves are unused. In the case of any future change, alteration or relocation in the layout of any such cemetery or burying ground, there shall be filed with said Secretary a supplemental or additional map or plan showing such change, alteration or relocation.
Any person, corporation or organization who shall open any grave in any cemetery or burying ground in the Township of South Hackensack without first having obtained the permit so to do or without first having paid the permit fee required under § 220-4 hereof or who shall in any other way violate any of the provisions of this chapter shall, for each violation, be subject to a penalty not to exceed $500 and not less than $5, to be recovered as prescribed by the laws of this state.
