No firm, person or corporation shall excavate in or under any Town highways, Town streets or public grounds in the Town of Killingworth without a written permit, obtained at least 48 hours prior to excavation, from the Board of Selectmen or its duly authorized representative.
The Board of Selectmen may prescribe conditions for the issuance of permits, including the length of time allowable for the completion of the work and the restoration of the Town highway, Town street or public ground to the same condition as it was prior to the excavation. The Selectmen may also provide that in the event that the work is not completed in the allowable period or the excavation results in an unsafe condition of the highway, street or ground, the Selectmen may complete the work or remedy the unsafe condition and charge the cost to the permittee. A bond in an amount sufficient to cover the work shall be required, except in the case of a public service company as defined in § 16-1 of the Connecticut General Statutes.

Any person, firm or corporation found guilty of any violation of this chapter shall be subject to a fine not exceeding $250 for each day of the violation.
