As used in this article, the following terms shall have the meanings indicted:
MOTOR VEHICLE
A vehicle which is generally operated or driven upon a public highway and which is propelled by any power other than muscular power, except electrically driven mobility assistance devices operated or driven by a person with a disability.
No motor vehicle shall be parked or stopped in an area of the public right-of-way designated and used as a pedestrian sidewalk in the Borough of Media.
No portion of curbing in the Borough of Media shall be cut or overpaved for the purpose and use of the traversing of vehicles from the cartway onto property adjacent to the curbed area or area in which a pedestrian sidewalk is located without a license. Crossing a sidewalk area and traversing a curbed area by a motor vehicle without a curb cut and driveway license permit is forbidden. Licenses therefor shall be issued upon application to the Secretary of the Borough of Media.
No license shall issue without submission of plans for the construction of the curb cut and for the paving of the driveway area in such a manner that the curbing and sidewalks of the Borough of Media will be adequately protected and preserved. All plans shall show the dimensions and location of the hard-surfaced parking area upon which motor vehicles are to be parked. All hard-surfaced parking areas shall meet the Borough specifications for the paving of parking areas, a copy of which is maintained in the office of the Secretary of the Borough of Media.
No license shall issue for the construction of a motor vehicle parking area if the parking of vehicles in such area will create a hazard and threat to the safety of persons in the Borough of Media.
All motor vehicle parking areas, if feasible, shall be designed so as to permit vehicles to enter upon and leave the parking area moving in a forward direction so as to avoid motor vehicles backing across a pedestrian sidewalk and backing into the flow of traffic.
Nothing herein is intended to apply to existing paved driveways, parking areas and existing curb cut areas. This article is intended to regulate the traversing of all sidewalks and curbing and paving of unpaved parking areas in the Borough of Media.
This article shall be effective within 30 days of enactment. Notice of the enactment shall be given by posting a notice of the general contents of this article throughout the Borough.

Anyone guilty of violation of this article shall, upon summary conviction before a District Justice, pay a fine of not more than $600, plus costs of prosecution and, in default of payment of such fine and costs, be imprisoned for a period not exceeding 90 days.
