This article shall be known and may be cited
as the "Borough of Morrisville Recycling Ordinance."
The following words and phrases, when used in
this article, shall have meanings (unless a different meaning is clearly
required by the context) as follow:
Empty all-aluminum beverage and food containers.
Empty food or beverage containers which consist of ferrous
sides and bottom and an aluminum top.
Those properties used primarily for commercial or industrial
purposes and those multiple-dwelling residential buildings which contain
more than five dwelling units.
Empty steel or tin food or beverage containers.
Bottles and jars made of clear, green or brown glass. Expressly
excluded are noncontainer glass, plate glass, blue glass and porcelain
and ceramic products.
Printed matter which contains miscellaneous written pieces
published at fixed or varying intervals. Expressly excluded, however,
are all other paper products of any nature whatsoever.
Paper of the type commonly referred to as newsprint and distributed
at fixed intervals, having printed thereon news and opinions, which
contain advertisements and other matters of public interest. Expressly
excluded, however, are newspapers which have been soiled.
A natural person, firm, partnership, association or corporation
who or which is an owner, lessee and/or owner of a residence or commercial
establishment.
Empty plastic containers. Due to the large variety of types
of plastic, the recycling regulations to be adopted from time to time
may stipulate specific types of plastic which may be recycled.
Those materials specified by the Borough to be recycled,
namely glass containers, aluminum cans, newspapers, magazines and
periodicals and plastic containers.
Any occupied single or multifamily dwelling which has up
to five dwelling units per structure from which a municipal or private
hauler collects solid waste.
All refuse (garbage and rubbish) and other discarded solid
material normally collected by municipal or private hauler.
There is hereby established a program for the
mandatory separation of recyclable materials from solid waste by all
persons within the Borough of Morrisville (hereinafter referred to
as "the Borough.")
Recyclable materials shall be placed at the
curb in containers which are approved by the Borough, separate from
solid waste, for collection at such times and dates as may be hereinafter
established by regulation.
It shall be a violation of this article for
any person, who has not been so authorized by the Borough, to collect
or pick up or cause to be collected or picked up any such recyclable
material. Each such collection in violation hereof shall constitute
a separate and distinct offense punishable as hereinafter provided.
The Borough Manager is hereby authorized, empowered
and directed to enforce this article, and to establish and promulgate
reasonable regulations as to the manner, days and times for the collection
of recyclable materials in accordance with the terms hereof and any
other matters required to implement this article. The Borough may
change, modify, repeal or amend any portion of said rules and regulations
at any time.
Except for a violation of the provisions of § 360-5 hereof, any action by any person, firm, corporation or other entity which violates or does not comply with any provision of this article or any regulation promulgated hereunder shall be punishable by a fine not to exceed $10 upon a first conviction; $25 upon a second conviction; and $50 upon a third or subsequent conviction. A violation of § 360-5 hereof upon conviction shall be punishable by a fine to not to exceed $300.
The Borough may enter into agreements with public
or private agencies or firms which authorize and provide for such
entities to collect all or part of the recyclable materials from curbside.
This article shall not be effective until such agreements are executed
and delivered.
Any person may donate or sell recyclable materials
to individuals or organizations which are authorized for such disposition
by the Borough in its recycling rules and regulations. Such materials
either must be delivered to a collection site as designated by such
individual or organization, or may be placed at the curb for collection
by such individual or organization on days which are not designated
as recyclable material collection days by the Borough. Such individuals
and organizations shall not collect recyclable materials on, or within,
the twenty-four-hour period which immediately precedes a regularly
scheduled curbside collection day.
