The purpose of the Mobile Home Park Overlay Zone is to recognize and encourage the continued existence of age restricted mobile home parks currently existing within the Township of Brick and to permit the mobile home park to relocate or replace existing mobile home units within the park while establishing restrictions applicable to said parks.
Provided all of the following restrictions are complied with, existing mobile home parks within the Township of Brick shall be permitted to relocate or replace mobile home units within the park, provided such relocation or replacement does not increase the number of existing mobile home units within the mobile home park.
A. 
The property is subject to a recorded deed restriction establishing the park as an age-restricted mobile home park restricted to residents age 55 years or older in accordance with the provisions of the "Housing for Older Persons Act of 1995," 46 USC 3601, and 24 CFR 100.300 et seq., as may be amended from time to time.
B. 
Prior to relocation, replacement or demolition of any mobile home, the mobile home park shall obtain a permit and inspections from the Township of Brick.
C. 
The property shall provide an on-site resident manager or provide an on-site office which shall be staffed Monday through Friday, excluding legal holidays, from 9:00 a.m. until 5:00 p.m. At all other times, the property shall be serviced by a twenty-four-hour telephone service to address emergencies.
D. 
Conspicuously posted at the on-site office shall be a copy of the mobile home park bylaws and a copy of the standard lease provisions and fees applicable to all mobile home park units within the complex.
E. 
All mobile homes which are moved or replaced within the mobile home park shall be situated to not be located in a setback location. Building setbacks shall be 75 feet for a front yard setback along New Jersey state highways, 20 feet along arterial roadways, 10 feet along municipal roadways, five feet from interior roadways and 10 feet for a rear or side yard setback. Additionally, no mobile home shall be moved or replaced in a location within a ten-foot perimeter of an existing mobile home unit or within five feet of a shed. For purposes of measuring setback requirements, distance shall be measured from the outside walls of a mobile home unit, exclusive of stairs.
F. 
The proposed improvements shall not include changes to internal roadways, extension or relocation of utility services, including water and sewer mains, and the installation of stormwater drainage facilities without benefit of a full site plan review under § 190-237, Part 4, Site Plan Review, Article XXXII, of the Township of Brick Land Use Ordinance.
